      I entered a contract with Georgetown Deck Builders on August 21, 2022 to remove my current deck and replace it with a new deck. I paid $18,932 on 8/21/22 to order materials, paid $2,244 on 8/26/22 for removal and disposal of old deck, paid $2,878 on 9/9/22 for the framing of the new deck (all per the terms of the signed contract). I have text exchanges with GDB since 9/9/22 asking for updates and bottom-line is they have never ordered the decking material. I have minimal responses from GDB since and they won't return calls from the decking supplier who has supplied GDB with a materials list and are waiting GDB's confirmation to place the order. At this point, they have taken payment and have no intentions on completing the contracted work. Communication details and timeline attached. Signed contract attached.

      I am responding today in regards to the Complaint Letter dated **********

      I would like to formally explain my portion of the situation in regards to *** *********

       

      First off I want to apologize for the situation that Mr. Preston has been placed in financially by Mr. Faulkner and let it be known that he has done similar, although not to the same degree, with me.

      My marketing business (UBP Consulting; full contact at bottom of this email) created the asset Georgetown Deck Builders (GDB) with the sole intention of helping to connect clients seeking Decking services with local contractors to complete the project.

      With this type of asset creation by my business, a local contractor pays me for the rights to receive contacts through my asset by a rental fee based upon a percentage of the profit from each completed project.

      In this case Mr. Faulkner was the local contractor, and exclusive recipient, to receive the clients being directed through my asset (GDB) as my service does not send out client's contact to multiple contractors as with many larger marketing companies.

       

      Mr. Faulkner's company is Faulkner's Home Improvement LLC and he is in no way an employee, or ownership partner, of my marketing service/asset titled as Georgetown Deck Builders.

      He had simply entered into agreement with me on 2022/06/23 for marketing services rendered via receipt of the before mentioned local contacts seeking services rendered.

      Please see attachment for the agreement Mr. Faulkner signed with my company in which all of the before mentioned details are explained further.

       

      To date I am in the process of terminating all services with Mr. Faulkner, as he has not only created this adverse situation with you personally, but he has also become delinquent in at least a minimum of $500 in profit sharing; possibly even in excess well of $1,000. As per my attached agreement, and delinquency notice to Mr. Faulkner, the complete termination will occur by 2022/12/14.

       

      I have additionally received the communication from the KY Attorney General's Office and have shared this same information, in full transparency efforts, within this email to them as well.

      I have offered the open invitation to discuss this matter further directly with Mr. Preston and I have offered to assist with whatever information should be required to see our situations with Mr. Faulkner are resolved.

      Finally I have asked that since this matter is not originated by my business (UBP Consulting or GDB) that Mr. Preston could begin to consider repealing the continued actions with the BBB, KY Attorney General, and Google Business Review.

      Again, I am completely open to continuing this discussion in hopes of quick and mutual resolution.

      I am rejecting this response because I still have an unfinished deck that I have paid for.  I reached out to and entered a contract with Georgetown Deck Builders.  From my point of view, GDB subcontracted the work to ****** *********  As shown in the previously sent timeline, I reached out to *** **** on three different occasions and he ignored my requests and now accepts no responsibility.  He has only now reached out because I have given poor reviews of his "business" on Google and Yelp.
