      Had a membership at Lex Athletic while I was a student at *** When I was no longer a student and moved back to my home city I gave notice to Lex athletic to cancel. I gave it a month for them to process. Talked to a manager and she said send a copy of my ID and a bill/mail with my name on it from that address. My Mom sent everything in writing via USPS as well. Have again been charged 34.45 today 2/16/23. I be moved out of lexington on 10/23/22. Since we followed all the rules and stipulations we are logging a complaint here prior to going to our family attorney. 172.25 deducted from my checking account after I moved (34.45 monthly) I am 22… they prey on young people who move away and I do not have money to pay this. It means I cannot pay my water bill this month. Terrible predatory practice considering I followed all the roles to a “T” and my Mom even helped me make sure I followed the contract.

      As stated in ******* signed Membership Agreement (attached), cancelling a contract when moving requires proof of move, like a lease, deed or utility bill, and we have not received any documentation from ******  However, as of February 15, ***** can also cancel if he submits in writing his 30 day notice or signs a cancellation request at LAC, as he is now a month-to-month member.

      ******* mom has also tried to cancel his membership, however, her name is not on the contract and she never forwarded proof of move either (like the water bill she mentioned in complaint)

      I am rejecting this response because:

      Moved “home” with parents 10/24/22. 
      Therefore I have no utility services in my name as it is my parents house. 
      I did send in mail with my name on it and my home address in Louisville. I will resend if you need that. I am attaching here mail showing I am receiving all mail at my parents house in Louisville. It is from the State of Ky ( drivers licensing) so it should suffice.  I want to be disenrolled from this contract immediately as I no longer live in lexington. I feel I am entitled to a refund due to supplying this info via USPS mail previously .

      I live in Southeastern KY but was working in Lexington for the 4 months that I paid for a membership to the Lexington Athletic Club. I met with someone there in the business office when I initially signed up. I clearly stated that I only needed a membership for that length of time I was living in Lexington. I have not set foot in the gym since the end of the four months, but there is a clause in their membership form that states they automatically renew your membership even though I had clearly stated during enrollment that I only wanted to be a member for the four months that I would be living in town. If that was not allowed, I should have been informed. After the four months, LAC continued to bill me under the name, ABC financial. I had to research what ABC financial was to find out where the charges were coming from. Then, I had to physically go to the facility and sign their form that stated that I did not want them to renew my membership. I provided my official driver's license and a bill that was mailed to my address outside of Lexington. The business office offered to refund one month of the membership fees, but they refused to refund the other 4 months. I think their practice to renew memberships without informing the customer is bad business and I should be refunded for the other four months. I also believe that the debits from members' bank accounts should somehow reflect that it is a gym not a financial institution. Both practices are misleading to their customers.

      Memberships at Lexington Athletic Club automatically renew on a month to month basis.  However, the renewal terms may be canceled with a 30 day written notice.  Ms. ******’s signed contract agreeing to these terms has been uploaded.  The signed contract also shows where she initialed the automatic renewal terms section and the contract indicates that ABC is our billing company.

      I am rejecting this response because I personally met with a young man who told me I could get a membership for only the amount of time that I was staying in Lexington. According the person I met with after the fact said that I shouldn’t have been allowed to join if I didn’t have a Lexington address.  To me that sounds like someone on their end is responsible for letting me join in the first place.   The fact that he verbally told me it would be no problem, means absolutely nothing.  The extra money that was deducted from my account under a financial institution name (ABC Financial)  instead of LAC is very misleading.  LAC’s  lack of transparency is ugly business. If the BBB thinks this is good business, then I’ve been poorly misled.

      It seems Ms ****** may have misunderstood or misremembered what the staff said to her, which is why we rely written contracts that state the auto-renewal terms and have the member initial that section in the contract.   We have been in business since 1984 and have always maintained an A+ ranking with the BBB.   We successfully and amicably cancel hundreds of membership agreements every year and try to make canceling as painless as possible so the member will someday consider joining us again.

      I had to cancel my membership as we were looking to move. I came in, signed my notice, and confirmed the date and amount of my last payment to LAC. I was then billed for a biannual maintenance fee on my last month of membership, when I have not used the gym in several months. When I was in office signing my cancellation notice, the employee confirmed the final date and payment amount to me. They absolutely refuse to refund the fee.

      Business Response /* (1000, 5, 2022/03/11) */ Attached is Ms. ******'s cancellation request and Membership Agreement. Page one is her signed cancellation request documenting that her membership will expire on 4/2/22. Page 2 of her signed membership agreement explains how members are billed the maintenance fee every March and September. Possibly Ms. ****** did not remember that the maintenance fee would hit in March before her membership expires on 4/2/22. Consumer Response /* (3000, 8, 2022/03/15) */ (The consumer indicated he/she DID NOT accept the response from the business.) When I came into the gym to sign my cancellation agreement, I was told by the membership specialist who assisted me in canceling that my final charge would be on 3/2, and that the amount would be $32.86 Business Response /* (4000, 10, 2022/03/21) */ Ms. ****** is correct that her last monthly dues payment was $32.86 ($31+tax), however as previously stated, March is also the month that one of the $20 (not taxed) maintenance fee's are scheduled to bill. Perhaps this was misunderstood when she completed her cancellation request or there was confusion over remaining dues vs fees. (See previously attached membership agreement and cancellation request) Unless Ms ****** doesn't think the agreement terms apply to her situation, I'm not sure how to make the agreement any more clear.
