      On April 28, 2022 I paid Harris Federal $5000 for representation regarding medical retirement after a serious injury suffered at work. Around August of 2022, my Doctor retired from medical practice. After dealing with the Department of Labor and finding a new Doctor, I was not able to see the new Doctor for an examination until 2023. I was placed on a waiting list. After my first meeting/ exam, the new Doctor informed me that he does not support medical retirement and created a new treatment plan. These new events renders me ineligible for medical retirement. I requested a refund of my retainer from Harris Federal but they only withdrew representation and I was told they would keep my $5000 retainer. This is unreasonable and I am requesting a refund. The only work they completed was simple document preparation which was completed by one of their "Case Managers" not an actual Attorney. I am willing to pay them $500-800 for the document preparation which is reasonable for the little work they had to do. I am requesting a refund for the rest of my retainer fee of $4500-$4200.

      I am rejecting this response because:

      Shortly after paying my initial retainer to Harris, my main treating Doctor retired from medical practice and I was no longer able to receive care from her. She was the Doctor that supported medical retirement. I was forced to find a new Doctor. My new treating Doctor does not support medical retirement. That fact and the fact that my medical condition has improved, render me ineligible for medical retirement. This is a unique situation that is out of my control and should not be treated as a "store credit" from Harris Federal. It is unreasonable that Harris Federal simply wants me to move forward and submit a claim of medical retirement to the O***** ** ********* ********** ***** at this time. Moving forward with a claim of medical retirement at this time would be considered fraud by the **** Harris Federal is being unreasonable and does not have a right to seize my $5000 retainer. I am entitled to a refund of my retainer. I have worked with other attorney groups in the past with different issues and no other attorney group has ever simply seized the retainer. Despite their "stonewalling" Harris Federal can discuss the situation without discussing specifics about my medical conditions, diagnosis, etc... The remedy that I have previously proposed to Harris Federal is reasonable. Once again, I am willing to pay them for "document preparation." I will permit Harris Federal to keep $500 for "document preparation." The remaining $4500 should rightly be refunded to m account. I wish to seek arbitration against Harris Federal.

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. I stand by the fact that I am currently unable to move forward with medical retirement due to the professional medical opinion of my current treating physician. I accept the businesses proposal of a 50% ($2,500) refund of my initial $5,000 fee and find this a somewhat reasonable conclusion. Thank you for your help with this matter Kentucky BBB.
