      Davenport Extreme Pools & Spas told us in early June 2021 that we would be “swimming by the end of September 2021”. We gave them a 40% deposit per personal check for $34,750.00 on June 9, 2021 and it was cashed the following day. Per Davenport’s contract terms, the order/purchase of the pool shell would occur the same day the deposit was received. Davenport then ghosted us and did not return 10 emails and many phone calls. No response from a company that had taken a personal check from my hands for $34,750.00! After 6 MONTHS of silence from Davenport Extreme Pools & Spas, we retained legal counsel. We’ve learned our pool shell was never ordered from Thursday Pools. This is a common theme with Davenport. DEPAS has now filed Chap 11 bankruptcy in hopes of reorganizing so they can continue to do business, or should I say, defrauding people. *All legal proceedings now halted b/c of bankruptcy filing*. I would like my $34,750.00 returned plus legal fees. DEPAS has listed approximately 100 people/businesses as creditors on their bankruptcy filing. 60+ of these creditors are pool customers. Supply chain issues or cost increase in pool shells have NOTHING to do with the cause of this bankruptcy. This company took people’s money and delivered nothing. Instead, they purchased toys and luxuries for themselves. BEWARE of any dealings with these people. Lastly, let me point out that many families PAID IN FULL anywhere from approximately $90,000.00 to upwards of approximately $150,000.00 and received NOTHING but a bad experience. For those who did receive a pool shell, many jobs were not finished completely plus yards, driveways, retaining walls, and surroundings were destroyed and in need of repair/replacement. Some customers have had to hire another pool company to repair the shoddy work done by Davenport Extreme Pools & Spas. If you are not listed on the creditor list and have been conned by the Davenports, please contact ****** ******** the KY Attorney General.

      We signed a pool contract with Davenport Extreme Pools and Spas on 6/27/2022 with an installation date for late October 2022. Since then (after our deposit of $39k+), they have continuously lied about the status of the pool project. They continuously move the date by stating they are behind on other installs. The truth is, they never paid the deposit to the manufacture to have the pool built, and now it is January 7, 2023. We have all of the evidence reflecting that this company is not dealing ethically and, in our opinion, committed various crimes including breach of contract. In addition, there are MANY MANY other Customers going through the same issues. NOW, although Davenport Extreme Pools and Spas have filed Chapter 11 bankruptcy, should not protect them from the crimes committed.

      We hired Davenport to build a pool at our home on December 31, 2021. The contract stated they would start the work on 6/23. Leading up to the contract they were fantastic and responsive but as soon as we signed the contract and paid them a down payment they never returned calls, screened calls and were basically unresponsive. They finally started the pool work 8/15 after we continued to call and ask for when it would start. After nearly 4 months with a pool shell in the ground and no concrete (but an additional payment made for concrete) we have begun to research this company. We have found that we are one of many customers who have been promised a number of things, made payment and are not seeing follow through. We just want the pool to be completed or our second payment returned so we can contract with another more trustworthy company. They now will not return any calls or text messages. Most recently they claimed a wet deck (which was part of our contract) was received damaged and shipped again and after calling the home company Thursday pools we learned they never ordered our wet deck. That was when we learned this company was not just unresponsive but dishonest and lying to us. I would like a full refund of the $98,514 paid to this company.

      DAVENPORT EXTREME POOLS AND SPAS, INC. 7 March 2022 first check for $40,000.00 9 March 2022 second and final check for $49,350.00 Total paid = $89,350.00 (checks attacked) I contracted with DAVENPORT EXTREME POOLS AND SPAS, INC. in early March 2022 to install a swimming pool at my residence. I was told by their agent “****** ***************” that if I was willing to buy a fiberglass swimming pool that they had from a previous sale that did not go through that my pool would be installed and finished in May 2022. This was witnessed by ******* *******. I agreed and paid the first $40,000.00. Then a few days later I wrote the remaining check for $49,350.00. This has been a nightmare from the start. Here it is mid-July and all I have is a shell (see the pictures attached). I was promised the pool would be complete by mid May… I should of done something about it two months ago as my pool did not have to be made, it was a pool that was already purchased and they would use my money to refund the individuals that initially purchased it. The company is doing a Ponzi scheme with customers. They take the money from one job to finish other jobs. Promise you everything and deliver NOTHING. This company should be banned from doing any work till all previous work is complete. I am seeking for this job to be complete within 10 days or a total refund to be made within 21 days. They can come and get the pool as summer is half over. I am going to contact the Attorney General’s office to have this company flagged as a fraud and to file a consumer fraud complaint. I have made over 30 calls to the supposing owner with not a single call returned. After filing with you my intention is to get local news media from Louisville to come see the pool and do a story about it. Hopefully I can prevent others from making the mistake I have made. I am a disabled retired veteran and I believe that they absolutely took advantage of me. Please help inform the whole KY/IN community about this comp

      Please be advised that this firm represents Davenport Extreme Pools and Spas, Inc. This complaint, filed by ****** ******* is totally without merit. I have attached a copy of correspondence sent to Mr. ******* in response to a complaint he filed with the office of the ******** *******. As you can see in that correspondence Mr. *******’ pool was set and prepared ready for concrete in record time. The inspection took longer than we would have liked, but we performed under our contract an extremely prompt fashion. We are now waiting for the concrete to be poured. As you may not know, since the **** battery plant has begun construction, concrete has become extraordinarily difficult to get in the ************* area.

      Our contract that Mr. ******* executed recites that we have 365 days from the first dig to complete the project. Apparently, Mr. ******* has convinced himself that the project would be completed within nine weeks. As we all know, the written contract controls.

      No one from Davenport Extreme Pools and Spas, Inc. ever made a promise as to the completion date to Mr. *******. This complaint is a result of unrealistic expectations by a consumer.
