I bought a car under a 30-day warranty for the transmission and motor if it went out they would fix it the same day I bought the vehicle the car would not go up a hill and was having problems it broke down they told me it was spark plugs it was taken to a to z Auto sales in Mayfield they denied to fix the problem which was the transmission and several other mechanic shops and scanners told me the problem was the cylinders in the transmission they said they refuse to fix that and put new spark plugs and that was it the car continued to have these problems but they told me that it was not the problem the transmission I have proof from other mechanic shops even AutoZone scanner that the fluid in the transmission was contaminated and needed to be drained out or it would ruin something major a week after my 30-day warranty was up the vehicle transmission fully went out a through z has been very rude to me hanging up on me all because I brought up the law underneath the lemon law so they had the car towed without my permission I told them no if I had to pay for it now they are charging me almost $300 to even get the car back because they chose to tow it when I asked them not to they said it is their vehicle and they needed to look at it they are not willing to work with me on anything and I put $4,000 down on this vehicle and my payments were always made 15 days earlier than should have been I'm asking for help to resolve this issue because they have no right to do this to me I tried to return the car the next day and 4 days later they would not give me my money back or a new car or grant me the 30-day warranty as they promised when we signed that warranty me and my daughter have been left without a car I lost my job have proof of everything stating the transmission was the problem and needed to be fixed and while under warranty they did not Grant the warranty they masked the problem gave me the card back and it went out a week afterBusiness response

This is a response to a complaint from ****** ********. Yes she purchased this 2009 Honda Civic from our Paducah lot on 11-15-22. She test drove the vehicle before purchasing it and it had no problems at that time. On 11-17-22 she brought the vehicle to the Mayfield lot having some issues. We scanned it and noticed it needed new spark plugs. We put new ones in at no charge to her thou our warranty shows she is responsible for the parts. We drove the vehicle several miles and it had no issues. We showed her the bad spark plugs when she picked the vehicle up. We also tried explaining that parts stores are not mechanics and that there report states bad fuel not bad transmission fluid. if she called either store location and left a message we would have returned her calls. Our hours are 9am till 6pm and have had no voicemails from ******. On 1-3-23 she called the Paducah lot and asked us to look at her vehicle. ***** told her we will have to tow it to our lot and she would be responsible for the tow bill to get it to our shop. She said to tow it so we could look at it. We have never told any customer that if there is a problem with a vehicle we will fix it same day. That is not doable when we can't always get it in the shop the same day and parts are not always available the same day. On 1-6-23 ***** spoke with her after diagnosing the vehicle and stated it needs a transmission. We checked threw our suppliers and there is not one available at this time. Also we informed her that her warranty was up on her vehicle because of miles as well as 30 days. The miles when she purchased were 163659, miles when towed to us was 165664. She has put 1985 miles on the vehicle. She told ***** she will come pick up the vehicle and that she found a cheap transmission and will have someone else put it in. She then told ***** she will call her lawyer. ***** said that fine you can then have your lawyer contact my lawyer and we can go about it that way. Witch she still has not picked up the vehicle, because she hasn't paid the tow bill of $242.74 that was owed. ****** is also mistaken regarding her down payment witch was actually $2466.00 including taxes not $4000.00 and she actually is behind on payments. We show that there was not contact from her between 11-17-22 until 1-3-23 when she called and wanted us to tow it and diagnose this vehicle. We also did not charge her to diagnose. If there is anything else you might need from us regarding this customer or vehicle just let us know.
