I'm having a garage built. I have added up contract and change orders to be 102,320.99. I have paid him 94,019 so far. So I still owe 10,496. There is still a lot of work to be done and he is wanting me to pay him a final full amount much higher. He hasn't shown me any paperwork with everything itemized and why I would even owe him that much. He refuses to meet even though I said I would pay for the underground utilities of 2,195. I keep telling him I will pay the remainder when the job is finished under KFCA laws and that I don't feel comfortable paying a full amount before we do a walk through. He has tried getting more money out of me before multiple times and has even threatened me both physically (by about knocking me over and getting in my face) and also on the phone saying he would punch me in the face and text saying Kiss my *** and so on. Now he is threating with a lien for some reason and saying he will sit on the job and is being very very unprofessional.

      Business response

      08/03/2021

In response to the complaint filed by Mr. ******: 1) The contract price and change orders/add-ons stated by Mr. ****** is incorrect. There were numerous changes & additions to the as it progressed. We can provide signed contract if needed. Mr. ****** agreed to pay in draws according to his contract. He contacted me (*** *******), to meet and give me a payment telling me all was good. When I arrived at the site, he told me "I have changed my mind, and am not paying today." Mr. ****** became confrontational and irate. Insisting the amount of draw/payment was not correct. Mr. ****** was well aware of all extra costs incurred on the project each time there was an addition or change. 2) Mr. ****** did not make timely payments according to contract, even when provided with his invoices 3) As to the accusation of physical contact, this is absolutely incorrect! There were other people at the site. An affidavit can be provided as proof that at no time did I physically accost him. 4) As to the mention of KFCA laws, these laws do not entitle Mr. ****** to simply not pay his invoices because he "changed his mind". 5) Mr. ****** also should be aware of the fact that he should not slander the reputation of our company. Mr. ****** contacted us in March 2021, he received a written estimate, and signed his contract March 18, 2021. Throughout the process he has been satisfied up until the cost of his project rose due to his changes & additions. We have been in business since 1995, and while we cannot say we have never had a complaint, we have always been able to reach an agreement with our customer without physical altercations or damage to our reputation. All contractors & subcontractors from time-to-time, have disagreements on a project. It is the responsibility of the General Contractor to see that his customer's complaint is addressed and taken care of promptly and to all parties satisfaction. As we have attempted with Mr. ******.
