****** & his son we're made aware by the lead foreman at the start of install that the removal of the bottom portion of his shelf would be required to make the area accessible to jack hammer to do his drain tile system.He suggested they just tilt the jack hammer,but that’s not safe, we could injure an employee or cause damage to his foundation, both risks we cannot take.We must remain OSHA compliant.We reiterated what would have to be done to move forward with the work,*** ******* said to go ahead with the job. Per our contract & checklist that Thomas signed,if we need to remove material to do the work correctly, we will do so to ensure the system will do its job.We made him fully aware before removing said section that we had to,& that per our contract,we do not replace building materials and would be unable to put it back. *** ******* called back 3 days after the install & explained he wanted us to come and put the shelving back together.I explained that he signed the checklist prior to starting our work that stated on point 3 "Tile, Paneling, baseboards, drywall-if deemed necessary to remove any building material to provide warranty contractor not responsible for breakage,of any kind, or reinstallation and or replacement." & that it had to be removed in order to do the system correctly & to provide him with a warranty.I apologized for the inconvenience and offered to refer a company to help,he said we needed to fix it.I told him once more we don’t replace building materials.I offered to send copies of the documents,& he said he did not care what he signed we needed to put it back. I have attached a photo of the area that shows the portion that was removed.The freshly poured concrete (against the foundation wall) is where we needed to jackhammer to install the drain tile system, apply the white plastic sheeting on wall &why the shelf had to be removed to get back there.It was the only safe and proper way to install his drain tile system and to provide the warrantyCustomer response
