      On July 5, 2022 **** **** the owner of WCK Foundation Repair met me at my house to give me an estimate. He told me that they had to drill multiple holes to install piers. Some of the holes required removing bushes in the front of the house. He said they'd reinstall the bushes but they couldn't guarantee they'd survive. Other holes had to be dug underneath either concrete or brick pavers. He said they would do the entire job for $12,500, including reattaching a broken drain pipe which took water away from my house to the lake behind it. I asked them to do this when **** told me that the company was expanding and now starting to also do drainage jobs in addition to foundation repair. On July 26, his son ***** who was not the crew chief, came to look at the job with me. The contract called for the crew chief to meet with me prior to the job beginning but ****** the crew chief did not come until the day work began. When ***** left we still had the same agreement. Prior to ***** coming I asked them if they could do the job for any less and they said they would do it for $12,000. Therefore I didn't get any other estimates from competing companies. The job was completed in mid August. After they left, we had rain and I noticed 2 places where they had reinstalled the pavers, were now collecting water. They had not been reinstalled properly. I had the pavers installed to begin with, to move the water away from my house. The WKC warranty specifically states that it is not valid if the house does not have proper drainage. The house had proper drainage prior to the pavers being reinstalled. Water above these pavers, now collects & can drain down to where the piers are installed. They created this issue. When I told **** **** about the problem he said that he wasn't going to do anything about it. He said that it wasn't in the contract for them to reinstall pavers. They did this work, improperly. It was included in the original job scope as we had discussed.

      The contract you signed specifically said we do not remove pavers.  The reason for this is because we are a foundation repair company, not a general contractor or a flooring company.  We removed and tried to replace them for free because we want to try to satisfy our customers the best we can.  As you mentioned we also gave you a significant discount and did some drainage work for you for free.  This should be more than enough compensation to cover a professional paver company to repair those small areas of concern.  We always try to overcompensate for our deficiencies or misunderstandings.  However, unfortunately, there are occasions where we are not ever able to satisfy every customer.  As we all have had similar experiences in life.

      I am rejecting this response because:

      It was never stipulated during our verbal agreement for what the job would be, that the paver portion of the job was any different than that of removing the bushes or the concrete. 

      You did this paver work as part of the negotiated job. You created an improper drainage issue. Because you did the work as part of the negotiated job you're responsible for correcting this drainage issue. You cannot use the fact that it says you do not remove pavers in the contract when you DID in fact remove the pavers and reinstall them. Because you did this, you should be responsible for the quality of your work.
