We were charged for a transmission the truck did not need. Then charged us for the part it really needed. They admitted we did not need the transmission and there would be no additional charges. That doesn't seem to be the case.

      Business response

      01/27/2023

Business Response /* (1000, 8, 2023/01/12) */ We diagnosed it needing a transmission and the customer told us they'd already had the transmission worked on once or twice. After replacing the transmission there was still an intermittent shift problem that needed to be addressed. So that the customer wouldn't feel that we were just milking them for additional money, we replaced the transmission control module and also rewired the module at no charge to them. We did this on a 14 year old truck that has over 100k miles on it. I feel that we were very fair in fixing the problem while also keeping the charges down as much as possible.

09/21/2022 Drove from Memphis to Lousiana to get a car. Spent $3,500 I got a 2017 Blue Nissan Maxima. I noticed it was missing a piece on the back door, he told he would get me the missing piece. When doing the test drive I didn't kick up the speed I only did about 45 mph. I had to drive all the way back to Tennessee, when I got back I noticed that tires were BALD & had a foreign object in my right back tire, called my car salesman ****** Brooks & told him about my issue & he stated he would get me new tires. Going on a month now & I have yet received my tires or the missing car part on my back door panel. Also I haven't receive my tags and registration, when going to registration place in Memphis Tennessee, they're asking for a tracking number, I called ****** & he stated he would call me back in a minute. It's been well over 1 month & he hasn't done anything that he said he would do. I called the dealership, they were no help at all. I'm very furious, really would like to give the car back but since I signed a contract I'm stuck w/it? But nobody is helping me correct their wrongs. I need some help.

      Business response

      12/05/2022

Business Response /* (1000, 10, 2022/11/22) */ I've spoken to ****** and our parts dept on this. The trim piece was supposed to have been ordered but we've had some change over in personal in our parts and service departments and this piece has fallen through the cracks. Please send ****** a picture of the missing area so we can be sure to get the right piece coming. As far as the tires, we are in disagreement that the car car needed tires. We looked at the tires and the tread depth was within reason for a 2017 with 139k miles on it. As of receiving this letter the tag papers have already been resolved with you from our accounting office. Please get this to ****** so we can get the right trim piece coming. Thank you.

I purchased a vehicle with a $2000 down payment over 24 hours ago and still no vehicle my daughter passed on And I was specific and let them know that time was of the essence and basically they took my money I have no money back or a vehicle.

      Business response

      07/07/2022

Business Response /* (1000, 5, 2022/06/22) */ The customer placed a deposit and agreed to terms on a car that was in transit and was told it may be a few days before the car was delivered. The car arrived 3 days after the customer placed her deposit on the car. At that time she signed the contract and took delivery of her car. She signed multiple agreements stating that it was earnest money towards the car she wanted as she wouldn't accept any other cars in stock. She only wanted to wait for this one to come in. This has been resolved and the case can be closed.

On March 26, 2021 I entered a consumer credit transaction with WELLS FARGO AUTO and as a result they used my credit card (as described in 15 USC 1602) and was extended credit in a consumer credit sale. I acquired a vehicle from PERFORMACE DODGE CHRYSLER JEEP RAM, a 2021 RAM 1500. PERFORMACE DODGE CHRYSLER JEEP RAM demanded that I pay them a down payment which is illegal violating ** *** § ****** which clearly says that the finance charge does not include charges of a type payable in a comparable cash transaction.

      Business response

      05/24/2022

Business Response /* (1000, 5, 2022/03/31) */ This customer is gravely mistaken. His social media has him talking about how to get out of contracts and even charges people to clean up their credit bureaus. He's just fishing to get out of binding contract that nothing was misrepresented on and everything was covered up front. He is just looking for a free ride. Consumer Response /* (3000, 7, 2022/04/01) */ (The consumer indicated he/she DID NOT accept the response from the business.) Wow where is the proof of this claim? Why is my social media relevant to the pure fact they VIOLATED FEDERAL LAW Pursuant to ** *** § ************** I am CLEARLY exercising my right of Rescission and the company responded with vague and false claim that I'm "fishing for a free ride". ONCE AGAIN I NEVER SPOKE ABOUT GETTING OUT OF CONTRACTS. I do participate in credit repair by exercising FEDERAL LAW, I also manage a trucking company and wash dishes on Mondays since were throwing irrelevant information out there. Notice the company did not respond to the proof I clearly provide in my complaint. Once again Performance Dodge Chrysler Jeep Ram, also named has failed to clearly & conspicuously disclose my right to rescind. I **** ******* participated in a consumer credit contract and not a loan Pursuant to 16 CFR § 433.l(i), which clearly states "Consumer credit contract. Any instrument which evidences or embodies a debt arising from a "Purchase Money Loan" transaction or a "financed sale" as defined in paragraphs ( d) and ( e) of this section. Performance Dodge Chrysler Jeep Ram asked for a down payment of $1,000 violating 12 CFR § 1026.4 which clearly says that the finance charge does not include charges of a type payable in a comparable cash transaction. Pursuant to The Truth in Lending Act (Regulation Z) you can be fined up to $5,000.00 for giving false, inaccurate, and fails to provide information which he is required to disclose and in this case Performance Dodge Chrysler Jeep Ram willfully did when you failed to disclose and provide all information clearly to me a consumer. By their response its plain to see they're a unlawful company and should be held accountable for their actions. Business Response /* (4000, 10, 2022/04/14) */ Our attorney has reviewed this dispute and we find it to not be of any legal merit whatsoever. It's our belief that Mr. **** **** is not interpreting correctly the laws he mentions in his complaint. We are interpreting his request to be that the truck be given to him with no payment requirements which is outrageous. We will not be sending him a refund of his cash down payment either. There is no legal reason to do so. And he has been getting all the benefits of owning that truck for over a year now. There is no "3 day right to rescind" when you purchase a vehicle from a car dealership so there is no reason we would have given him notice of such. We will look forward to seeing Mr **** in court and hopefully he will hire an attorney to properly advise him between now and then.

I purchased the vehicle October of 2020. I've had so many issues starting a month later. When I called the company to make them aware I was disrespected and told that's what happens when u purchase a used vehicle. I've put about $5000 worth of work into the vehicle starting from February 2021 to currently and all attempts to resolve have been shot down. I'm really frustrated and at the point of a breakdown. I've never had to deal with something like this in my life.

      Business response

      03/16/2022

Business Response /* (1000, 5, 2022/02/22) */ I'm sorry but we don't have a ****** ****** in our system. I even pulled all of our sales from Oct of 2020, and we didn't sell anyone that lives in Lafayette a vehicle that month. I can't help you with this complaint. Consumer Response /* (3000, 7, 2022/02/24) */ (The consumer indicated he/she DID NOT accept the response from the business.) ****** ****** and I've emailed documentation proving the purchase of the vehicle in 2020 Business Response /* (4000, 10, 2022/03/14) */ With the corrected information I was able to locate the purchase. The Land Rover was purchased back in Sept of 2020. Ms ****** also purchased a service contract which covers the major mechanical components of the car in the powertrain. The service contract company has even replaced a water pump for her. While I hate to hear of any problems she's having or unsatisfaction she's feeling I don't see where any repairs are our responsibility. She does have major mechanical protection which she has already used. I will offer the opportunity for us to trade her out of the car if she'd like to look at something else. We have a wide range of new or preowned cars that are still under factory warranty that will give her bumper to bumper protection. I'll be glad to discuss more if she would like to contact me. Consumer Response /* (4200, 12, 2022/03/15) */ (The consumer indicated he/she DID NOT accept the response from the business.) I am willing to discuss things, don't know how much of a resolution we will have because even though the part was covered, the other components to fix that part were not. I had to pay for that myself. Along with a manifold that was not covered, thermostat that was not covered, all the parts that went with the cooling system in the truck that were not covered under warranty. I also had to replace a cracked push start, that was cracked upon purchase. So a conversation is definitely necessary.
