      Hired company to build house. Contractor did not paint under the window seal stools. Told about during the build and they did not do it. After closing company is claiming that I need to make a “warranty claim” to get it painted. We paid for them to paid there and they are refusing to. We want this painted and not have to do a warranty claim on something that was never there in the first place.

      2/28/2023 contacted the company through company portal to remedy complaints of front door warping and won't close without the dead bolt locked, exterior door knobs falling off 5 times since move in, interior doors are not cut to recommended specs of proper ac flow and roof Crack given multiple explanations. I went in person twice and spoke to warranty manager of all issues. They do not contact be according to our aggreement

      I have reviewed the response made by the business in reference to complaint ID 20469153, and find that this resolution is satisfactory to me, pending the contractor comes out Tuesday at 9:30 AM to finish the agreed upon repairs.

      We signed a contract in January 2021 to build a house. The contract was for 6 months from the date of slab pour (8/19/21). We are now almost a year from that date and the house is still not completed. Nothing has been done correctly and everything has to be redone several times to get it close to right. They keep giving me a date to close and that date has come and gone over and over for over 3 months now. I want my house finished and to be done with this contractor. At this point I would like to hire someone else to finish the job and deduct that from what I owe ****** Builders.

      Attached is our contract signed with ****** Builders in January 2021. We are now almost a year into the construction part that was supposed to take 6 months. If they are unable to timely finish the job then I would like to hire someone to finish it and deduct what it cost from ****** Builders payment. We have received new closing days every week (except one week we were out of town) for over a month now and they still cannot mange to get the job complete.

      Our aim is a satisfied customer and it is clear that we are not there.    We are showing that this customer closed with us on 8/5/22 with no outstanding punch list.  If the customer is reporting any items that are not complete or done correctly, we would like to know about them to review.  We want to complete every home within the number of days defined in the contract and if we don’t, follow the remedy defined in the contract. (See below)

      4.2 Substantial Completion. Subject to any delays (Article 4.3), contractor shall substantially complete its portion of the work for the Home within 180 calendar days for homes with 2300 living square feet or less and within 270 calendar days for homes with more than 2300 living square feet. In addition, if the home is a 1 ½ - 2 story and/or the total home price including all options and change orders exceeds $375,000 Contractor shall have an additional 90 days to substantially complete its portion. The date of the slab pour shall mark the beginning of the construction time count. Substantial completion occurs either when the Home is suitable for the purpose for which it was intended; or when a certificate of occupancy is issued by a local building official (if applicable).
      If contractor fails to obtain substantial completion within the designated time, the Owner’s sole recourse against Contractor for such delay shall be an assessment of liquidated or stipulated, damages at $20 per diem for every calendar day that the Contractor is late in achieving substantial completion. A walk-through with Owners & Contractor will be scheduled at substantial completion.


      4.3 Delays. In the event that there is a delay in work due to a government agency, weather conditions, fire, labor shortages, strikes, material shortages, change orders, Owner delays, Owner work, acts of war, acts of terrorism, acts of God or other normal variations in the construction process including, but not limited to, the selection, ordering, manufacturing and/or installation of Owner work, the date of completion shall be extended accordingly at Contractors option

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID 17666633. We did in fact go ahead an close on the home on 8/5/22 because we were at the end of our rope dealing with the company and their inability to get the work done correctly. We are still waiting to hear back on when the leaking carport will be fixed because they weren't sure at the time of closing if it had been fixed or not (It has not) and we have since discovered that the granite countertop is cracked and are waiting to hear back from that. I bought some stuff and took care of all the paint all over the floors that they could not get up myself. I was advised it would be 3 weeks or more before I would know anything about this per diem they pay for going over their contract date.
