we hired Scott ******* to do a custom pool. the pool included a custom water feature. He has not completed the water feature but has charged $25,000 plus for materials and labor for this project (copper water feature, bricks for the structure, plumbing and electrical that had to be done ahead of time when pool was being constructed, pool equipment which has been installed. he also charged us $2000 for an engineer fee for the feature. We have paid him over $175,000 for the pool and this incudes all the materials listed above. he refuses to finish the water feature even though we have paid for all the materials and labor, not to mention he also added 20%. we have contacted several other pool places to see if we can get this finished but no one wants to come behind and finish another contractors unfinished stuff. we meant we lawyers in dec 2022 and he agreed to finish the project if we made a final payment to him, we were uncomfortable doing this bc we feared he wouldnt finish the project, but he assured his lawyer and ours that once he was paid, he would come and complete the water feature. now he refuses to complete and refuses to honor warranty on our pool. we have not paid for the labor portion of the water feature install, but we have paid in full for design work, engineering plans, bricks, copper water fall, plumbing, electrical, commision fees, in full, and not we are stuck with all this stuff and no water feature. he also installed peacock pavers around the pool deck and did not complete the sealing of this material, which makes the decking so slippery we can barely walk to it. he also charged us b/c he said cost had increased, this was due to his own negligence b/c it took him almost a year, the pool was supposed to be done in 3 months. pictures show what completed project should look like according to his drawings that were given to us, uncompleted work, materials left in yard for this project and decking around pool that needs to be sealed.
