    Consideration of an alleged violation for bidding and/or performing home improvement contracting services without possessing a State Home Improvement Registration at 561 Section Line Road ($13,000.00), Leesville, Louisiana. La. R.S. 37:2175.3(A)(1).

    Ms. Morgan gave a summary of the allegations. No one was present on behalf of AUSTIN MAXWELL D/B/A MAXWELL CONSTRUCTION LLC. Investigator Brad Hassert, who was previously sworn, was called to the stand. Mr. Hassert reviewed the exhibit packet and provided testimony to the board. Mr. Landreneau entered the exhibit packet into evidence and it was admitted. Mr. Morse made a motion to find AUSTIN MAXWELL D/B/A MAXWELL CONSTRUCTION LLC to be in violation, to assess a fine of ten percent of the project value plus $1000 in administrative costs and to issue a cease and desist order. Mr. Fine seconded. The motion passed.

    I hired Maxwell Construction Company to build a fence using every available post I had in my possession as well as every available piece of metal. I let it be known clearly that I did not know exactly how much metal I had. I gave a very close approximation as to the number of posts I had. The original agreement was for 600 ft of fence using my materials. But since I did not know exactly how much metal I had we agreed on just installing what I did have. I didn’t think I had enough metal for the full 600 ft. The company completed less than 200 foot of fence. 6 bags of concrete were left on the ground and have ruined. I gave him $5.00 a foot assuming 600 foot total and an extra $300 for materials I.e. concrete and 2x4’s. His excuse was that I “kept changing my mind”. In this regard, in our initial conversation at the property, everything I said to him, his response was “no problem”. The “change” In question is the direction of the fence which he had not yet begun. He did not perform work and then me go back and say “change this”. The work I wanted changed was work that had not yet begun in regards to the location of different parts of the fence. I actually hired another person to clean the fence row where I wanted to place some fencing. I have a stack of posts leftover as well as a stack of metal not to mention the 6 bags of wasted concrete. He was supposed to hang two gates and build a 3rd a smaller one. He told me it would be done in a short time, which I wasn’t worried about but it took him almost 2 months to do way way less that our agreement. I have asked for my money back to no avail. I was unable to upload photos of leftover materials and ruined concrete. I also have the receipt from him for $3300.00 cash
