On March 18, 2023 *********************** *** came to give a stucco repair estimate for 82 ********, ******. Estimate of $3,600 was received on March 18. On March 20 *********************** *** asked for a check in the amount of $2000 which he promptly came and picked up and cashed. We came to an agreement on a paint match on March 31. Following is summary of communications since that time - 25 days ago:- April 1 texted me. Said he would be out April 3 at 1:30 PM to discuss. He then pushed meeting back to 3:30 PM but never showed. Later contacted me by text and said he would be out April 4. No show again.- April 5 I texted him and asked when he would be out. Said color came in today and checking on weather now.- April 15 I texted Brayan***. And asked when I would hear from him since it had been 10 days since I last heard from him. His reply is that he would be out April 17 to schedule and discuss warranty which he previously made no mention of. No show again on April 17. Texted to ask when he would be out.- April 18 he texted and said he would be out on morning of April 19.- April 19 was again a no show. Asked for a firm date work would be finished. No reply. - April 20 at 9:17 AM, *********************** *** texted me and said he would call shortly. He did not call.While I cant prove he did not call during this time, I feel the burden of proof is on him to prove that he DID call me.He has scaffolding set up on my neighbors property to be able to access my property for nearly a month. This is potentially a liability issue with my homeowners insurance. I realize it must be dry to paint but there have been mostly dry days in the past month and the past week.I consider Brayan Stucco, *** in default since there has been no communication since April 5. That is nearly 3 weeks ago.DESIRED RESOLUTION:Remove scaffolding immediately and do no further work on my property. The $2,000 already paid is to be full and final payment for work completed and no additional payments will be made.
