      ************************* D/B/A ******** Foundation Repair was contracted to level the center of my house & repair termite & water damage as a condition of the act of sale. He pushed the repair date back until after closing, cashed the check and claimed work was complete, and then failed to complete the terms of his contract. The items that he did complete were subsequently found to be in need of correction. He insisted that the terms of his contract were complete, until a third party inspection verified that the terms of his contract had not been met. He has made no attempt to complete the terms of his contract once he was finally forced into admitting that they were not complete, and refuses to acknowledge that other parts of his work are in need of correction/remediation. Instead he has put his energy into arguing and attempting to intimidate and exhaust me into giving up seeking to come to a fair and reasonable resolution. I no longer have any faith that, were he actually willing to correct & complete the work, that he could be trusted to do it in fashion that complies with industry regulations and norms. Subsequently to all this developing, I have discovered that although **************** advertises himself as licensed and insured, he does not in fact hold either a residential or a commercial contractor's license (although he does have a certificate from the state licensing board -- which unlike the licenses requires no testing or compliance with various standards of practice). He has violated 7 of the 8 standards for BBB accreditation is barely a month of our business dealings together, caused me loss of use of my house, and significant pain and suffering. I have significantly more documentation than the file limit size of this form allows, but am happy to share it with you. For these reasons I am seeking a refund of the amount paid to him, requesting that he cease contact with him, and that he cease advertising himself as a licensed foundation repair specialist.

      I tote 24 years of experience. I have met all the requirements to obtain a Home Improvement Registration Certificate with the *********************************************** in which a license was issued ******. Which covers- Home improvement projects on existing residential structures only with a value exceeding ***** but not in excess of ****** including labor and material. I have been holding this Certificate for 6 years. I have been a member of BBB since ****. Accredited since 2019. I have a A+ rating with the BBB. I'm writing this in response to the untruths, ill advise and bad understanding of *************** to defame my character, professionalism and or skills of my trade. *************** has repeatedly stated untruths, listened to bad counsel and ignored the facts and findings of a engineer whom she hired to inspect the property and the work that I performed. The content of my email may be to long to contain all of the untruths or lack of understanding by ***************. So let's dive right into this! I entered into a verbal agreement with *************** on or about December 13, 2023 and sent a email to her and her real estate agent and another agent describing the work to be performed. The agreement reads as follows: ******** Foundation Repairs will return on December 26, 2023 to complete the following foundation concerns 1. ***** center of house approx 25ft 2. Install three floor joists under bathroom floor. 3. Install subfloor in right side bathroom and hallway. 4. Shim piers as needed. 5. Replace approx 40ft of *****. I received a check in the amount of ***** from the seller which was paid from the sale of the house by the seller for the repairs to be completed, not by ****************  It was the responsibility of *************** to demo floors and subfloor prior to us arriving in the hallway and bathroom. We arrived on December 26,2023 as scheduled to find *************** and another person attempting to demo floors and subfloor. We did not start due to the floors not being removed. We arrived the next day December 27th 2023 to find *************** and two guys from ****** parking lot attempting to demo floors. The floors were demoed incorrectly. No flooring or subfloor was removed from under bathroom or hallway walls. This will become very important later in her email to me requesting or complaining that I didn't Install subfloor under the bathroom or hallway walls. Where in fact it was her responsibility to demo subfloor so that we could install subfloor under the bathroom and hallway way. Floors were demoed not from joist to joist, but between joists. One half of the kitchen floor was demoed  which was not in our agreement to install. She demoed it anyway and expected me to install it. I then discovered during the demolition that there were two floors on top of the floor joists. I advised *************** that our agreement was not for installing two subfloor but one and that I would not charge for labor would she be willing to pay for  material which came to ****** she verbally agreed. I proceeded on to completing the foundation repairs that was in our agreement. To this day the following repairs were completed. 1.Replaced 40ft of ***** 2. Sistered three floor joists under bathroom. 3. Re-shimmed piers as needed. 4. Subfloor was installed in hallway and bathroom 5. *****ed center of house to outside walls and front of house as close as possible.  However the house is still unleveled from the highest point which is the back of the house. Therefore exterior walls, center and front of the house is still unleveled  ****. At this point I tried to explain to *************** that the exterior walls, center of the house and front of the house has to come up all together. This is where the lack of understanding came into play. She was only concerned with me raising the center 4 inches without raising the front or exterior walls. I made her aware of what would happen if she only wanted the center raised. I then advised her to sign a waiver releasing me from any and all liabilities or damage this may cause. She agreed and then retracted on her decision and filed this complaint with the BBB. These are some of the foundation  additions that were completed as a compliment to *************** at no charge because the house was in such bad condition. 1. 6x6 ***** were added throughout the crawlspace with 9 piers to support unsupported walls. Half of kitchen was installed because she demoed half the floor. She was not charged for this work. Shored wall that led from dining area to living room. Shored outside bedroom wall. This wall was a additional charge. *************** was advised it would cost ***** to place a 6x6 with two piers underneath. Once again she verbally agreed and never paid. *************** has constantly acted in bad faith and she has been ill advised throughout this process. As a result of this *************** is not *********** any refunds. The scope of work we did and beyond to compliment her does not warrant any refunds. There are other emails that exhibit bad faith or untruths which are not attached.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      Im exhausted.

       I have not attempted to defame Mr. ********************** character, professionalism,or the skills of his trade. For several weeks now, I have attempted in good faith and with the utmost amount of ***** and patience that I can muster to come to an agreement with **************** to have him remedy issues found with some of the work he completed at my house, and to fulfill all of the terms of his contract to complete additional items of work to my house most notably to level the center of my house.

      Having spent the past several weeks attempting to bring that to fruition, I have turned to BBB to mediate the situation. **************** and I have gone round and round about each and every one of these particulars. Whenever any particular assertion he has made has been addressed, he bounces back to another (mutually exclusive) assertion in order to draw out the disagreement rather than showing any effort to come to an agreement to complete the terms of his contract.I am simply out of energy to once again address them in an orderly fashion. The only thing new that he has added is (1) his claim that I agreed to sign a waiver and now refusing to do so. This is what he proposed in our 1/22 meeting and I said if he wrote it up I would review and consider (although now new information regarding the foundation has come to light, so Im not sure what would justify him in insisting that the terms of his contract need revision) and (2) his claim that I have been acting in bad faith and have been ill-advised.

      I am attaching transcripts of our phone call from our 1/17/24 phone call and our 1/22/24 meeting. Two of Mr. ********************** employees also took video recordings of the 1/22 meeting if a clearer picture of events is necessary. Together with the documents previously sent in with my submission of this complaint, BBB now has the entirely of our interactions since 1/1/24. I hope and trust that you can see the interactions and facts of the matter clearly as an impartial third party, and can come to a fair judgment on how it can or should be resolved.

      On January 22, **** I met with ***************, her real estate agents. Three more other guys. Also present was two of my employees who videoed the meeting. At the end of the meeting *************** was attempting and intending to defame and discredit my name and reputation. Utterly and maliciously attacking my credentials. *************** also attempted to publish to the BBB website her attempts to defame or discredit me by writing the following: I advertise as a licensed and insured, but I do not hold a residential or commercial license (although he does have a certificate from the state licensing board which unlike licenses requires no testing or compliance with various standards or practice. She stated that I violated 7 of the 8 standards for BBB accreditation and that I'm barely a month into our business dealings together. *************** ends her complaint requesting that I cease contact with her and that I cease advertising myself as a licensed foundation specialist. 

      If this is not an attempt to defame or discredit me than what is? Not only does she maliciously attempt to discredit my credentials but she also pre-judged what I violated within the BBB accreditation. She stated I violated 7 of 8 accreditations. Without allowing the BBB to mediate or arbitrate. She has consistently acted in bad faith and demonstrated her lack of knowledge. I have met all the requirements to obtain a Home Improvement Registration Certificate with the *********************************************** in which a license was issued ******.       *************** writes that she exhausted as she should be. If I had acted in bad faith and told untruths consistently I would be exhausted as well. She has yet to admit she verbally agreed and approved any additional work. She further states she wishes to remedy issues at her house and that I fulfill all the terms of my contract to complete additional items of work at her house. What additional items? In my email sent to *************** on January 17th **** I stated ******** Foundation Repairs is WILLING to meet with *********************, contractors, or whomever to rectify any issues on the inspection report or what is written in my original agreement. I have always been WILLING to meet and I have met with *************** whenever requested. I have never sought to draw away from the truths. In fact *************** has exhausted every effort to draw away from her verbal agreement for the additional work that was performed. 

      On January 18th **** in her email she complained that there was no subfloor installed under hallway walls and bathroom walls. She retracted that complaint because I stated to her it was her responsibility to demo subfloor from under the walls.she did not demo the floors under the walls so that we could install subfloor. This is an example of acting in bad faith and making accusations or being ill advised.  She complained from the inspection report that I did not support a unsupported splice. You can plainly see from the inspection report picture the splice could not be supported because of pipes in the way. She retracted there also. She also complained that the floors were not nailed down with enough nails. I reminded her she said not to nail the floors because the plumber had to work after we were finished. She also identified in her email that a pier did not have a proper footing. Once again without merit or proof of the depth of the footings she pre-judged and told untruths and acted in bad faith. In her email she outlined five items. She has retracted on four and has not addressed them thus far. I brought up the unsupported splice at our meeting on 1-22-24 I have her on video stating she did not want to discuss that. But she complained about it in her email as a issue. 

      She has also never acknowledged 7 more piers that were added with 6x6 ***** in various areas to support unsupported walls at no additional cost. *************** verbally agreed to pay for two additional piers and a 6x6 sill under a middle wall and has not paid for the completed work. *************** also demoed one half of the kitchen floor which was not in our agreement. I installed the subfloor at no additional cost. 

      *************** has constantly and consistently acted in bad faith, been ill advised and have definitely told untruths throughout this process.

      Again, I have provided BBB with transcripts of all communications between myself and **************** over the past month. I have consistently, politely, and in good faith attempted to get **************** to remedy 5 issues with work he did in the course of (partially) executing his contract at my house: 

      1. The center of house is not yet level
      2. Correct footings are still needed 
      3. Splice needs further support
      4. Subfloor in hallway & bathroom needs to run from joist to joist
      5. Subfloor throughout has not been sufficiently secured

      Most recently, when compelled to acknowledge that the center of the house was not level, he said he would write up a revised contract which would require me to waive unspecified damages incurred by him leveling the center of the house. No contract was received after 72 hours, and given the tone with which he left that conversation I had little reason to expect that any effort would be made on his part to complete the terms of his contract and rectify work that needed rectification. Consequently, I turned to BBB to help us find a solution. **************** has still offered nothing by way of rectifying this central item of the contract that is still very far from complete. This is not unexpected, and why the remedy I am seeking is a refund for an incomplete contract so that I can afford to pay someone else to complete the work. This is why I am exhausted. I feel like I have been talking to a brick wall. I just want my house to be livable. I am asking BBB to mediate or arbitrate.

      Once again *************** has consistently and constantly wrote to the BBB untruths, she demonstrates bad faith and lacks understanding to what is written in our agreement dated 12-13-2023 in which she verbally agreed to the following foundation repairs in front of her real estate agent and another agent which reads as follows.

      Turner's Foundation Repairs LLC will return on December 26,2023 to complete the following foundation concerns. ***** center of the house approx 25ft. Install three floor joists under bathroom floor. Install subfloor in right side bathroom and hallway. Shim piers as needed. All of these items in our agreement has been completed. 

      She writes 5 items in her complaint. First of which is level center of the house. In which we agreed to level the center approx 25ft. We leveled the center of the floor to the height of the front of the house and exterior walls. Which is indicated in the inspection report she obtained. The house is not leveled to the highest point which is the back of the house. In order to level the house further to the highest point the center, exterior and front of the house have to be leveled simultaneously to achieve a leveled house. I have explained this on 1-22-24 and now again. She constantly lacks understanding and wishes to go against my expertise. It is not in my agreement to level the exterior and front of the house. I have explained to *************** over and over again what will happen to her house if we only jack the center without jacking the front and exterior walls. I have a video of me explaining to her three more other guys, two of my employees, her real estate agent and one other lady what needs to happen to level the house properly. 

      Here we are again 2-5-24 with untruths, lack of understanding, or acting in bad faith of **************** 

      1. She writes the center of the house Is not yet leveled. Once again I have explained to her over and over again what has to happen to achieve a proper level of the center. If she wants just the center to be leveled without leveling the front of the house and exterior walls simultaneously then agree to accepting the liability and or damage that might occur to the property. It's just that simple.

      2. She writes correct footings are still needed. This is not in our agreement. From my description of work to be performed footings are not in our agreement. She wants something done that she did not pay for. The footings that she is speaking about was poured as a compliment to her by my company at no charge. But she writes this is needed. She's claiming something that had nothing to do with our agreement. Another example of bad act of faith. 

      She writes splice needs further support. Once again this is a lack of understanding. From the inspection report the inspector writes to a complimentary beam that I installed which is not in our agreement and she did not pay for. The inspector wrote that a splice is unsupported. I explained to *************** that a pier could not go under the sill because pipes were in the way. I have video of me explaining that her on 1-22-24 in which she states ****** that not why we are here. 

      4. She writes subfloor in hallway and bathroom needs to run from joist to joist. Indeed it does. Here is the untruth of ***************. The subfloor in which she is speaking about is the subfloor she did not demo from under the walls. Our agreement which was understood on 12-13-23 by myself, ***************, her real estate agent and another agent was for her to demo all floors and subfloors before we arrive on December 26,2023. We arrived on the 26th to floors not demoed. We arrived on December 27, 2023 to find *************** and two guys from ****** parking lot demoing floors incorrectly and not from joists to joists.

      5. She states subfloor throughout has not been sufficiently secured. Here is another untruth. After we installed subfloor in the bathroom and hallway she advised me not to nail the subfloor to the joists because her plumber was doing work after us. She has consistently and constantly told untruths. She is ill advised and lacks understanding. Seems like she has moved on from trying to defame or discredit my credentials and reputation by constantly stating untruths.

      She has yet to write, admit, or explain anything about her verbal agreement to do additional work in which she has not paid for. She has yet to acknowledge all of the additional piers and 6x6 ***** that were added to support unsupported walls. None of which she was charged for. She has yet to admit she demoed one half of the kitchen floor which was not in our agreement and that I installed one half of the kitchen floor at no cost to her after the ****** parking lot guys demoed the floor.

      This is really a case of untruths, lack of understanding and bad advise given to *************** throughout this complaint.
