      This contractor was hired to repair my patio roof. He stripped the roofing from the patio and dining room. Left it open, rain came and flooded the dining and living rooms. He said he wasn't responsible for the damage. He quit the job and left me with the mess. He also kept the $5000 deposit. Also he never pulled a permit to start the job. The damages are about $40,000.

      Always love how someone gives such little info when making a complaint leaving out tons of details. This client hired us to remove and replace a patio that was literally falling down, exposure to the home was already there and leaking inside their walls. Once we removed the cover and started exposing everything it started raining and yes more rain came inside and it collapsed the ceiling in the nook area, however this exposed even more damage that was already existing. The walls were literally falling in, mold behind the wall and inn the ceiling which means it had already been leaking for a while as mold cannot show up in 1 hours time. 

      We showed them all this and have pictures of all this and video. We did pull permits and that’s public record so not sure how they are claiming that. Then the biggest part they are leaving out is we had to call the cops on them as the owners sons girlfriend started raising **** to the point of calling the cops, trying to claim we were doing all this damage to their home even though this person literally works in the roofing and restoration business and she was just mad that the parents didn’t give them the job. 
      We politely was trying to leave and she was laying on top of our stuff, screaming and cursing and so I called the cops to escort us and our stuff off the property. They technically owe us more money and I was trying to be nice considering the real problem was not with the homeowner but this girlfriend. The wife was literally crying when we were leaving and begging me not to leave and I apologized and told her mam, you need to get this women out of your house and off your property and I will come back and never heard from them again until this complaint. 

      I also told them I would not press charges against that women or come after them for the additional money but if this is what they want to come and claim, then we have everything recorded, on video and pics and a police report and I would hate to have to take it to that but we will if we need to.

      The contractor opened the roof, left it open.  Rain came and flooded the house.  Contractor said he was not responsible for the damage and quit the job,  kept the money.  I had to hire a new contractor to cover the roof and repair the contractor's damage and do the original job.

      This will be our last response to this misinformation. We have the text and recorded phone calls between me (****** ******* the owner) and the homeowner, so we have undeniable proof of what happened. I love how they are saying we quit, if someone reads our first response, we literally had to call the police on these people just to get off the property which is insane, I've never had to do that in 22 years of doing construction. So if you call that quitting, then yeah, we quit! LOL 

      Took their money ? yes, we took a $5000 deposit in which we performed more than $5000 in work and anyone can read our response to them once we excited the property which included permits (in which they say we didn't get) demo of structure, hauling of the trash and disposal fees and all the prep work we did perform. We had 7 people there that day, plus the demo/haul crew for partial the next day. 

      ONly further response we will do at this point is pressing charges for the abuse against our workers and a lawsuit for the additional money owed to us, which will now include slander against our company.

      I am rejecting this response because: I reject. The contractor failed to do the job.His negligence caused thousands of dollars damage that he refused to accept responsibility for. Changed the original contract many times. Was caught trying to cut corners by not building to code. Did all this without a building permit and shut down twice (in 2 days) by the city inspector. Added enormous amounts of false charges to the bill to cover cleaning the mess he created.

      I had Blue Tide exteriors replace the end of my driveway with a new culvert as well as a new patio. I believe was in July 2022. Within two to three weeks I noticed cracking on the patio. I called ******* I don’t remember his excuses in the beginning, but naturally it’s not his fault, but since he is nice he will fill in the cracks. He said that they clearly wouldn’t match the original pour but he would make them flush with the concrete and it would still look good. I told him I would think about it for the time being and get back with him if it gets worse. It continued to get much worse. I contacted him in July is 2023 stating the patio is spiderwebbed with cracks and there is one crack completely going through the patio from one side to the other. Half dropped and is no longer on the same plane as the half closest to the house. He says the cracked up unstable patio is not his fault because we have water and soil issues causing it. I told him she should have told me before the work was done so that I could address any issues before having work done. He told me there was no way he could predict if I would have had future soil problems, nor did he ever say his work would not solve my problem. On the contrary. I hired him because he said he could fix my problem. He offered to come out to fill the numerous cracks but only because he is being nice. He said he is under no obligation to do even that because according to him, this is not a workmanship issue, it is my issue. The number one reason I chose ****** because he said he fully warrants his work. That is what made me finally choose him over the other company. The problem is that I have soil issues and had the issues when I hired him. It is easy for him to say he will warranty his work when he can later say the problem is mine because of soil issues. In my opinion, he offered his warranty on bad faith as he knew he would never guarantee his work because he had my soil he could blame.

      We always do not like hearing when we have not lived up to someone's expectation and satisfaction and it's always 100% our goal to be polite, professional and complete jobs in a professional and code manner. With that said, here would be our response to this complaint from our perspective. 

      Notice in his  complaint, he outlines a couple of issues, one being te clean up after the job, in which he follows it up that he called us, we came and we cleaned it up, so I'm not sure why this is even brought up to be a complaint? Yes, sometimes guys will not always finish well or clean up after themselves the way they should or there might be a punch list. This is part of construction and we happily came out to do it.

      He claims it was a nightmare from the start. Not sure how because we have good open communication, we did exactly what we said we would do and what the contract said, which he even points out the xtras we sold him on to make it better and we did them. There has been no problem with this guy until months later and now the official complaint of spider cracking, which is actually better known as shrinkage cracks. We did the job, everything went smooth other then him asking for clean up, which we did, he paid, end of story!

      Complain about front culvert. There is 100% absolutely nothing wrong with his front culvert, we did what we said, what was needed and I cannot confirm or deny what my project manager said but if he did in fact say those words he was out of line and would not be correct but the bottom line is there is no mistakes with culvert so not sure why this is being brought up.

      Lastly is the spider cracking as he says: This is shrinkage cracks, they are not all the way through the bottom of the slab and notice how he even notates and added pictures showing we came out to grind them out and backfill. We were very upfront they would not match but he asked for it and even though not required by us and I even have the recorded phone call of me telling him were not responsible for the way it will look and I'm not coming back after I do it, he asked for it and now complains about it.

      I have explained to this man 3 times, he has a tree root problem, water problem and elevation problem and he explains to me that is somehow our responsibility to have told him that upfront, made suggestions to remedy it or have included that in our contract? First, he literally has exposed framing on  the back of his home and rotten boards all across the bottom, and we did offer to do an estimate and he said no, not at this time maybe later and he had some friend who was coming over t o help with all that including the fascia boards, literally falling off his home. 

      Secondly, if anyone thinks it's our responsibility as a concrete and exterior contractor to not only know but handle elevation issues, tree root problems and water problems in your yard, then please don't hire us cause that's ridiculous. 

      I will certainly offer any past experience or observations we have but if someone, like this guy chooses not to follow that but proceed forward with the job, then don't come complaining to me later about things that are causing problems with the job and having literally nothing  to do with us.

      Anyone can see on our contracts, they are very clear and we have people say all the time it's the most detailed they have see. our contracts not only outlay line by line, it even says when things are not included then has another 5-6 pages of contract with it that's been reviewed by 2 attorneys. 

      We always try to put our best foot forward and we have even told this man, if he can give me some facts as to how we did our job unprofessionally, not up to code or against normal concrete practices, I would be more than happy to address that concern and he has provided none.

       

      We offer a lifetime workmanship warranty, not product warranty, not something is happening to your house or land that is causing a problem. Something if we did is done incorrectly causing a problem, we will fix it.

      ****** ******* is lying as I’m the beginning I was continually contacting about issues.  The bottom line is that he does not stand by his work.  Look at the pictures.  I know of nobody who would pay for that workmanship.

      Im sorry BBB is a toothless lion.  At least I’ve had other review sites contact t me that they have given my review about Blue Tide Exteriors to potential clients.  His shoddy workmanship will catch up to him even if BBB refuses or is unable to do anything.

      Date of original transaction: 2/28/23 On February 28, 2023 I signed an agreement with Blue Tide Exteriors for that company to construct a patio cover for $13, 748.55. I sent $6999.96 to Blue Tide Exteriors as a down payment on 2/28/23 for the proposed construction work. On June 7, 2023 Blue Tide Exteriors presented me with a second proposed agreement for $16,723 and a third proposal on June 29, 2023 for $15,973. Each of these proposals came with an option to decline. I declined the last proposal on June 30, 2023 and asked for my down payment back since I did absolutely nothing to contribute to this construction delay or the 21% price increase of the proposal. On August 8, 2023 Blue Tide Exteriors refunded $2751.91 of my down payment, but refused to provide me with an itemized accounting of the services that equates to the remaining $4248.05 portion of my down payment.       We are very sad this deal had to end this way! We always try to have open clear communication with our customers and we do feel as though we have done that with this mans patio cover but as you can see by his complaint, he is the one who chose not to move forward, this has nothing to do with us not doing the job, trying not to, doing a bad job or not delivering what we said we would. 

      It is a little frustrating he is trying to make it look like we delayed the job, didn’t do it, then just asked for more money and he denied, then we only return partial funds. While the basis of that is true, it’s only part of the truth.

      #1 We have recorded phone calls, text and emails showing he received multiple communications in regards to his project, throughout the entire process. First, we waited on him almost a month for how approval, then once we had that we submitted for his rendering and site plan, in which was back in about a week, then submitted for architectural plans which then took another week (all of this explained up front) so the first 5-7 weeks was waiting on his how, then for getting the site plan, rendering and architectural plans to submit for permitting.

      #2 Permit office gave us tons of run around as this man had an existing concrete pad he wanted us to build on then just resurface the pad at the end, which we agreed to and that’s what he was charged and is lined out very clearly in his contract. The permit office took almost 2 months going back and forth which is not normal but we updated him weekly of the delays and letting him know what we were dealing with. Ultimately the permit office determined we were not allowed to put it on his existing slab and would have to add footers, so we changed the architectural plans and resubmitted for approval and that is the change order he received. he claims we should of just installed footers for free. Not sure if he thinks were a non profit or something but it would of taken 3 guys 1 day plus a concrete saw, jack hammer and mixer to tear out those section, pour them and clean up which is a $2000 job he wanted for free and was completely black and white in the contract he was not getting and we were using existing slab.

      This is what he is reffering to that he denied. I then offered him to make some changes to the contract to not do the resurface or not do the screen room so that he could stay within his budget and he said no 3 times, to 3 suggestions. His last time however, was I will get back with you and never did. 

      #3 he became non responsive. We have it recorded with multiple text, calls and email trying to get a hold of him for over a month, with no response. He failed to mention that. He never asked for a refund, never said I don’t want to do the job, nothing, crickets!

      I then had no choice but to send an email laying out what we had done at that point, he was not responding (even though my records show him opening the text and email, so I know he saw it) and I told him if he did not respond by the following day we would be cancelling the job per the contract and sending him a refund for unused funds, which is exactly what we did and he cashed the check (which we have record of)

      He still never responded to any of that but he had no problem cashing the check!

      We explained to him, we paid for the site plan, rendering, architectural plans, plus the change of them and the permit. The permit alone was almost $1100 not including us doing it and all the other stuff was over $1000 not including our time and work. Our contract is clear that it is a non cancelable contract after 3 days and confirmation call, which we were way way past both. It’s also is non refundable for delivered goods and specialty items which obviously you cannot return a permit, site plan, rendering or architectural plans, all of which he still has possession of if he was to consider still doing the project and would lose nothing. 

      We have undeniable proof of every text, call and email, all of which is recorded and we have proof of delivering to him a site plan, rendering and drawings and paid for permit. We did all the upfront work for this job to be done and he became unresponsive and uncooperative, so I’m not sure how I can even rectify a situation if someone won’t even communicate or not be willing to change anything on their own job. 

      We have the most detailed contract and estimate in this community and get feedback on it all the time, even had clients who were other contractors and attorneys compliment us on it. We do a confirmation call after the sale with me the owner/project manager going over timelines, expectations and the entire estimate making sure we didn’t make a mistake, even though sometimes we do and that’s usually when things are corrected. 

      We are not perfect but in this particular situation, I’m not sure how it could be handled any different and we even refunded his unused funds on our own with no response from him even though our contract clearly states there is not want. I’m not looking for a thank you but a complaint is certainly not what I expected.

      The Blue Tide Exteriors response is NOT satisfactory and is replete with mischaracterizations. However, I am simply asking the company to provide me itemized listings of what services Blue Tide Exteriors performed that justify the $4248.05 withhold after the proposed contract was cancelled and no construction was performed. The Blue Tide Exteriors response did list a permit cost of almost $1100 and "other stuff" for $1000. That leaves $2148.05 unaccounted for as represented by the following:

      Cost of Permit per Blue Tide:                   -$1100.00
      Cost of “Other Stuff” per Blue Tide:          -$1000.00
      Remaining Refund Withheld:                     $2148.05

      In regards to this dispute and my request for an itemized listing of Blue Tide services that justify them keeping my down payment, I think it would be fair and professional of Blue Tide Exteriors to clarify what constitutes “other stuff” and to provide an itemized listing of the services conducted for the remaining $2148.05.
