      With permission, My husband traded in his 30,000 dollar slingshot to autoplex 2000 in lake Charles la in August 2022, they financed the truck through A&D financial, he signed the contract they provided to him, then a week later they called and said that he had to come back to the dealership to sign a 2nd contract because A&D didn’t wanna finance the vehicle for the time period that was stated on the 1st contract so they raised his car payments up, the car dealership even pushed his first payment back to November, so his paperwork was suppose to be processed in August to receive his plates within 30 days, the vehicle was suppose to be registered in Texas so it would be transferred in his name , 30days went by no plates , I called A&D they said they was still waiting for the dealership to send over paperwork, another 30days went by still no plates truck still never got transferred to his name, and by September the temp tag had went out , keep in mind we traded in a $30,000 vehicle paid for used that as downpayment, another 30 days went by and the dealership said A &D wanted there vehicle back they was closing the deal because they thought we was gone use the truck for work which I didn’t understand why did it matter what we used the vehicle for if we was making payments , then they said no insurance but we had insurance on the vehicle they didn’t list A &D correctly on the insurance, so we got everything fixed correctly, I made my payment in November still no plates and vehicle still wasn’t transferred that was 3 months went by , I made another payment and still he never received plates or title transfer , then this January they told us they was going to report the vehicle stolen , because of non payments but we never received plates and they never attempted to transfer the title , they reported the vehicle stolen but I traded my vehicle in , made payments but they never took the step to get my plates nor transfer anything, then tell me 5 months later they just sent papers for plates

      A & D Financial wishes to respond to the items addressed in the customers (******* *****) statement of problems and to the desired settlement.

      Statement of problems:

      1. A&D Financial originally entered into a rent-to-own agreement with Mr ***** on Aug 1, 2022.  The downpayment was in the form of trade credit for a slingshot.  The trade credit and downpayment was for $15,500 (not $30,000) and was reflected in the customers contract.  The customers first due date was September 1, 2022.

      2. At the time of financing and verification of the customers insurance A & D noted that the vehicle that was being rented was going to be utilized for transport services.  Per the mileage clauses in the customers contract A & D informed the customer that because of the potential excessive mileage the original term of the contract had to be amended to a shorter period.  This did result in an increase in payment amount and a shorter termed contract.  Mr ***** agreed to the new terms and re-signed on September 19, 2022. The new first payment due date was October 20, 2022 and payments are semi-monthly ending August 5, 2027.

      3. License Plate issues: Once Mr ***** agreed to re-sign the agreement, A & D began the process of registering the vehicle and applying for a license plate by requesting the title from the dealership.  A & D Financial received the title work for the vehicle from the dealership on October 20, 2022.  A & D Financial mailed via certified mail the title and required documentation to the Jefferson County (TX) tax office on October 27, 2022.  A & D Financial has logs of the correspondence between A & D and the Jefferson County tax office throughout the duration of this process.  A & D Financial did not receive the license plate and vehicle registration until January 19, 2023.  The customer was still responsible for rental payments as per his payment schedule.

      4. To date the customer has only made two (2) payments.  The October 20th and November 5th payments.  The customer has not paid the November 20th, December 5th, December 20th, January 5th, January 20th and February 5th payments.  It is company policy not to provide the license plate when an account is that delinquent.

      5. A & D financial did try and repossess the vehicle after the account was delinquent 3 payments and we were not able to obtain proof of insurance from the customer. The Vehicle was never located, A demand letter for return of the vehicle was sent after 10 days of not being able to locate the vehicle.  A complaint for failure to return a leased or rented vehicle was made with the Calcasieu Parish Sheriffs Office on Jan 20, 2023.  This complaint is actively being worked by the Sheriffs Office. 

      Desired Settlement

      On February 7, 2023, A & D Financial Services spoke to Mr *****.  We offered to return his slingshot in exchange for returning the truck and paying for the mileage/wear and tear of the vehicle since August 1, 2022.  The customer seemed dis-interested in returning the vehicle and asked what it would take to keep his truck and get his license plates.  I informed the customer that at this point since we have issued a criminal complaint that A & D will not continue to honor our rental agreement for the vehicle.  I informed Mr ***** that I would inquire with our owner as to if there is anything he would be willing to do in order for Mr ***** to keep the vehicle.  I tried to call Mr ***** on February 9th to inform him that Autoplex agreed to try and find another institution that would finance the vehicle and if they couldn't he would have to surrender the vehicle, pay for the usage of the vehicle and he would be provided his slingshot trade back.  Mr ***** did not answer and has not called me back.
