11/13/24 THE PURCHASE AGREEMENT WAS SIGNED FOR A SAFETY TUB WITH TUBBYS BY GRUBBS WITH A GRAND TOTAL OF $21268.00, WHICH I WROTE THE HALF DOWN CHECK THEY REQUIRED ON THIS DATE OF $10,634.00 (CASHED 11/13/24). SCHEDULED TO COME INSTALL ON 12/23/24, WHEN THE INSTALL CREW ARRIVED, IS WAS QUITE APPARENT THE TUB WAS NOT GOING TO FIT IN THE BATHROOM IT WAS ORDERED FOR. I HAVE MADE SEVERAL PHONE CALLS TO NO AVAIL ABOUT THE DEPOSIT THAT WAS PAID. OBVIOUSLY, THE SALESMAN DIDNT DO ALL THE MEASURING REQUIRED OR HE WOULD HAVE KNOWN ON THE SALE DATE IT WAS NOT GOING TO WORK. We here at Tubbs by Grubbs are willing to uphold our end of the contract still to this day. We have even sent our installer back to the customers home, after being turned away the first time, to discuss the ways that the safety tub will indeed fit into his bathroom. Tubbs by Grubbs has not once stated that the tub will not fit, in fact, we have done nothing but reassure the customer that we can install it with customer satisfaction in mind. Due to our contract, the legal 3 day right of rescission has passed, as well as, we have all of the customers material here which the down payment covered. Tubbs by Grubbs has been installing walk-in tubs for years now. The tubs themselves are bulky therefore sometimes we might have to temporally remove the vanity as well as the toilet upon installation, or even go through an exterior wall if need be. This is a common occurrence as most bathrooms are not large in size, so we are used to seeing this in different homes. Date of the transaction was July 10, 2014.The cost was $6,900.00. The business was to remove my bathtub and replace it with a walk in shower with a seat with a lifetime guarantee. The seat developed a crack and this was reported to the business on June 18, 2024. Someone came and took pictures of the seat and was supposed to get back in contact with us. They never did. We contacted them again the first week in July and was told again that they would contact us on July 8, 2024 after they checked with the warranty department. They never contacted us. We contacted the business again on August 16, 2024 to inquire of the status of the complaint. We were told again that they had to contact the warranty department. Someone was to come and look at the seat again on August 20,2024. This has not happened. This business has not kept its word nor has it tried to resolve the issue. We do understand that this is very frustrating for our customer but we are trying our best to make this right. The warranty that we offer is based off of the manufacture who produces the material. We have submitted the seat to the manufacture and they no longer make that specific seat so we are working with them to find a solution. I am rejecting this response because: The company has acknowledge since June, 2024 that there is a crack in the seat, but they have refused to correspond with me concerning a solution. Although Donnie Grubbs stated they are working with the manufacture about a seat that is discontinued, I don't understand why the company cannot replace my seat with one that is available. Due to my disability I cannot stand and shower. The seat is a necessity. I believe a solution could have been reached by now, if the company was sincere in their efforts to satisfy their customer.

Owner will not contact me and update me on job status or initiate completion of contracted job. Company installed inital shower walls during 1irst week of January and were to return in a few weeks to install glass door, shelves. grab bar, fix wall trim or adds ceiling panel, and fix caulk areas around shower exteriorIt. It has been well over 6 months and I have not been scheduled for work completion or updated with an anticipated job completion date. Office workers have stated that crews are overwhelmed and carching up new jobs. I would like a partial refund of $1500 to combine with remaining $500 balance to hire another contractor to finish job or have Tubbs send a crew to finish the job they started. Owner will not call me or email me back a courtesy communication about the job completion after several emails and calls to office. This business will not show up when scheduled to do so. They do not call and tell you they are not coming. They will not return your call either. Their employees who answer the phones are rude and condescending. I have rescheduled my other contractors to work around their scheduled installations but they have not shown up causing other repairs to be delayed. In February, I requested three different times that the salesman call me back because I wanted to add additional items to my order. He never called. In addition, they have yet to show up when they have said they would to install my ordered products. They are the one who schedule these installations. I have requested again today for someone in management to call me because I want to discuss my dissatisfaction. I still have not received a call.Business Response

I do apologize about the inconvenience that we have caused. Unfortunately, when dealing with construction there is no guarantee when our contractors will be able to complete the job that they were currently working on. In turn, caused us to have to move this job back one day so our contractors were able to complete the project they were working on so they could give *** ****** their full attention to her project. I am rejecting this response because: the job was very poorly done. There is a 1/2 inch gap between the door and the frame which I’ve had to hire another contractor to fix. This new contra tor said the work Tubbs by Grubbs did was shoddy. Tubbs by Grubbs never contacted me . I did talk to someone ******** when I called their office and again asked that someone from the company call me. I wanted to discuss the inferior work. They have never contacted me. I would say 7 years ago. I paid 8000.00 for this shower that has to have the caulk replaced several times a year, About 1 year ago one of the there workers scratched the acrylic. This shower has life time warranty. I have worked on this for a long time..They will not replace it and it is there fault. I cannot scratch it under this caulk they use. The shower has black mold on it also. This has to be the worse company in Louisiana that I have ever used. Since mine, I have heard of two more couples in Arkansas that have the same problem. entered into a contract with this company to replace my tub for a total of $8750. The contract and loan was approved. I started making payments while waiting for company to come install my tub. I waited months almost 2 months past the date that they supposedly started . They never showed nor answered my calls. I finally got them on the phone and told them I would like to cancel since they didn’t fulfill their end of the contract. They won’t cancel my contract and still yet it’s been over 3 more months and still haven’t started. The fins e company that financed the loan for them is demanding their money. Since I enter into the contract over 5 months ago and they guaranteed me they would get started in a couple of weeks and did not. I needed to refunded the down payment and full amount of payments that I have made and be they should negotiate contract with loan company that I don’t owe. They need to pay all debts. We would like to first apologize for the delay. Dealing with manufactures and shipping can be very aggravating not only for our customers but for us as well. If we would have known that it would have taken this long to receive the material in, we would have quoted an estimated time frame more in line with the actual shipping. Had shower installed end of 2020. In may 2023 called with issues with mold and the floor being bouncy. On approximately June 22, 2023 a foreman can to look at the shower and said it sounds like the floor delaminated. Also stated shower door was installed improperly and that is why water gets in the floor. Said should be no issue as he had seen this before. Called on July 17 and 18 and was told someone would call me back. On July 20th was told it was covered by warranty and they were ordering everything. Called on august 18, 19 and 21 to get status and was told I would get a call back. Never received a call after 3 hours and called again on August 21st to be told that they could order the new shower but had to return the old one to the warranty company to make sure I did not cause the issue. How could I cause a floor to delaminate? So they want me to pay for another $10,000 shower after less than 3 years. At this point I want my money back as they do not stand behind their warranty.Business Response

As we do not produce the material that we install we do rely on our manufacture for any warranty claims. We include with each and every customer a free labor warranty for up to 2 years from date of installation. Under this circumstance we sent in pictures and videos to our manufacture for review, they can not determine if it was a manufacture defect, which is what they cover, without receiving the shower pan back for physical review. In order to send them the base we would have to tear the shower completely out, therefore in order to leave our customer with a shower we have to order everything and then install it as well. All of that at our, the companys', expense to merely see if the shower pan alone will be covered. We did not ask the customer to pay $10,000 at all, we informed her that if it was not covered under warranty she would have to provide the material cost only. I am rejecting this response because I have never had a warranty on an item that needs to be removed to verify. There is no guarantee that it will not be further damaged in the process of removing. I refuse to pay an additional $4,500 for an item that their foreman said was delaminated and had seen it happen before. Like stated previously, the foreman pointed out many items that were done incorrectly with the install which he should have advised the company of.

In April of 2023 a representative from Tubbs by Grubbs came to our home. We engaged in a contract for a disabled vet who needs a updated shower with bench and shower door. Told us be one to day max turn around on installaton. Stated needed time to order ALL supplies and fixtures and would be begin project in May. Came out in May as they stated all materials were in and could begin project. Day one not completed as needed time for cement to dry. Came back out day two and added one grab bar, the bench and a shelf. Did not have the other grab bar or the shower head or the door. When they were told we needed the shower head so we could take a shower they went to the local hardware store and bought a small shower head. They then stated that they would come back out another day to do the door, grab bar and correct shower head. DId not come back. When began calling about the door they said they had to order it. After several weeks of calling back they said they could no longer get the door on the contract. Still several more weeks of back and forth over the door, grab bar, and shower head and them asking for the remainder balance. August 11, 2023 as of this date still not the finished project and states they are not in the shower door business and want to only put in a shower rod. We reminded them that this project was only started to get a shower door to be safer for a disabled vet with bathing. They offered a different color door but will not replace fixtures to match the color of the door. Overall material looks cheap to be a $13,000 project.Business Response

We have been in contact with the customer about this situation. All of the customers fixtures and shower door was supposed to be gold in color. Once we installed her shower we sent the order to our manufacture for the customers shower door. We finally received notification that they were unable to provide us with a gold framed shower door. We then called all of our local shower door companies to try and place an order for a gold framed shower door. Between all of the companies we reached out to we only found one place that can provide us with the product but it would be powder coated with a astronomical price, instead of a gold faced material that we prefer to use. We presented this information to the customer with a couple of options that we could do, which was, for us to take the price off of the door off of the remaining balance (that has not been paid yet) or add in an extra expense to be able to cover the new price of the shower door. The customer insisted that she must have the gold shower door an was unwilling to provide any extra funds for this unexpected issue, which is why our best course of action would be to just take the price of the door off in total and not install a shower door. They were not willing to do that and continuously hung up on us when we try to discuss and find a solution for this issue.Business Response

Due to the size of their wet area, the door is a custom size which is why we can not just purchase a door from Lowe's. We welcome the customers to look around to better understand. We are not trying to argue nor go back and forth but yet find a solution. If we would have known we would not be able to get the same color door, we would not of offered the products from the beginning. We did try to offer for them to choose a different color door, the customer informed us that if we did change it then we would we be held responsible to change out the fixtures we just installed along with all of the other fixtures in their bathroom to color match. That is a very drastic form of negotiating considering we have been trying to help resolve this issue that is out of our control, If we manufactured shower doors we would be more than happy to make one that suites their needs.Customer Answer

They put in a shower tub replacement on 7/7/23 and I paid them. This was in the middle of lunch and upon inspection later that day I found they had left a large hole in the floor where the new water lines were installed. The hole is large enough for a Possum to get into the house much less rats or snakes. this is the start of the third week with no word from them on a fix. I spoke to them last Monday and they said they would get back with me but I have heard nothing from them. I have photos of the hole on my phone but don't know how to include them.Business Response

In November, on the 23rd, 2022, I called to inquire about getting a shower installed asap, and a gentleman came out and told me how I could get my construction financed through GreenSky. I explained to him that I wanted to get this scheduled and he indicated that materials were running a few weeks behind but they would be in touch with me. By the second week in December when I hadn't heard from the ****** ******, I called them on my day off and asked why I haven't heard to schedule the installation of my walk-in shower, the young lady informed me that materials were running a few weeks late and it would be January before they could install. I told her I was not happy at all, and when I realized my account was being drafted for a product that I didn't have, I really had a problem with ****** ******. I began calling the company and telling them I wanted to cancel the order, they told me I'd have to call GreenSky. When I spoke to GreenSky they informed that ****** ****** would have to issue a refund and they refused to listen every time I called, they just kept saying the product was on the way. I kept calling until I asked to speak to the owner of the company, and **** returned the call, and informed me again that the product was on the way. I explained to **** that I had spoke to GreenSky and I wanted ****** ****** to issue me a refund, they had breached the contract. **** told me she wouldn't cancel the contract, she had seen pictures of my current shower and I needed to replace it, or I'd pay for the product anyway. ****** ****** will not be welcomed into my home, for any reason, ever. **** is redlining, and discriminating, telling me she's seen photos of my shower, and I need a new one. Well she's right, I have well water and it's hard, turns everything red, my tub, shower wall, etc.. but again, ****** ****** will not be the contractor to meet my needs. I’m sorry she's so upset about having to wait longer than you should have but this was never promised by Tubbs By Grubbs nor is there anything on the contract reflecting anything like that. She signed a contract to get her bath redone this is special order material that you can’t just go down the road to purchase. This contract that was sign was mailed to them and a letter explaining our system for your review. We are at the suppliers mercy on when we receive material and we do try to relay any information to the customer. Your material was already been purchased to the suppliers with your down payment and is on its way this is why we cant just cancel. My manufacturer can only send us so many jobs a week which why we have shipment dates. Her material is here and has been here for a couple of week. On page 3 bulletin number 1 on her contract explains the delievery stipulations. Her contract was signed right before Thanksgivng as well as Christmas and New Years which cause delays in production from our manufacture.
