I hired this company to do a 100,000 addition. The deposit was 25k. He took the deposit and vanished. Now I need to sue him. Stay away!Business response

We originally hired this contractor to install laminate flooring on the first floor, carpeting, and a new deck. Due to his inability to perform the job in a timely manner, he was ultimately dismissed without installing carpet or deck.. We released him because he made such slow progress, failed to communicate with us after he was paid in full, and did not appear able to meet the agreed-upon deadline. We paid him roughly $10,000. He promised more than a $500 refund since he dud not provide any carpeting, communicated in frequently and minimally, and left the jobsite with one case of laminate flooring we had paid for. We have a video of the contractor agreeing to reimburse us. On July 16 he was again contacted inwriting, requesting the refund. He has not communicated since he completed the flooring work.Business response

I was hired to perform several different services including a deck replacement, flooring replacement, and carpet replacement. The deck work was originally scheduled for 7/17 with a completion date of 7/31. The flooring replacement was to begin right after with all work to be completed by mid to end of August. Due to a lot of rain in the forecast, i offered to get the flooring started and then do the deck, which they agreed to. I did have other scheduled outdoor work that i was working on when the weather was good. Once the flooring work was started, i was informed that the timeline for the work would have to be moved up by almost a month and i stated that i would try my best to accommodate the request but there was other work already in process with other customers. I only started the flooring so we could work inside while the weather was rainy. This also allowed the customer to have listing photos completed early. I was removed from doing the deck after they had paid me because the work needed to get done on a schedule that i was not able to meet. I did offer to refund some of the money once all of the work was complete and associated costs were taken into consideration. The original communication stated that the customer was not going to list the house for sale until September and then it was moved to the end of July. If this had not changed, all work would have been completed on time. I am still willing to offer a fair refund of the remaining money and look forward to resolving this peacefully.Customer response

I entered into contract with Upper Deck Builders on June 9, 2022 providing a $2500 deposit. *********************** met with me on June 8th to review a list of tasks related to the completion of a deck rebuild. ***** came recommended by Koopman Lumber in Andover, which I felt provided a level of credibility for me to trust that ***** would do the work he agreed to. Rather, ***************** me along for weeks with reasons he was unable to show. First it was a wedding. Next was a worker who was a close contact for COVID. Next was a really bad case of allergies. Next was weather. Finally we decided to part ways and he agreed to return my $2500 deposit. This began another string of explanations where he said initially the check was in the mail but never picked up. Then he drove the check to the post office. Later he offered to drive it to my house (never did). Finally, he offered to ***** me the money, which I had to decline due to my concern for credit card fraud. I have every exchange with ***** in email and text documented. I have even spoke with the GM of Koopman Andover (*****************) and provided him with physical copies of said exchanges. I did this because Koopman recommended *****. It was clear when I met with **** that he was familiar *****. I explained the situation along with the other BBB complaint, and **** said hed be calling *****. However, despite this, no resolution came and its my understanding that ******* continues to do business with *****. I do understand that my complaint is with *********************** of Upper Deck Builders, but it seems a bit suspicious that ******* Lumber in ******* (a store oddly far away from ****** town of ********************) would continue to do business with an individual that is stealing customer deposits.
