Mediate Management company has been the management company in place for my condominium since I moved in, in 2017. Over the course of the last 5 years, there are significant issues that are left unaddressed, ignored or claimed theyre being attended to with no resolution ever being reached. This building is riddled with rodents, both mice and rats and in addition, bugs. On multiple occasions a rodent has gained access to my individual unit, when I have taken every necessary precaution to prevent this from happening. I have purchased traps, purchased wood and caulking to seal off holes the rodents have made since the time I have moved in. I have sprayed for bugs, and yet this building is filled with flies from the dead rodents in the walls, that I have had to cut into my wall to remove, and live ones that continue to thrive. The management company claims that they have a pest control service taking care of these issues but every single day there is a new problem. The wooden door on the side entrance was trimmed due to swelling from the weather, and now slams every time it is closed and shakes all individual units doors and walls. The hallways constantly smell like smoke from cigarettes and marijuana from individual tenants units, and yet nothing is addressed or remediated. I have tried to contact them after catching a live rat under a bowl in my unit and was told pest control would be coming out, but again, nothing was ever fixed as the rodents and bugs are still here. There is a woman in this building who is a hoarder and the door to her unit is cracked and broken, resulting in a repulsive smell to fill the hallway; and more bugs and rodents to thrive. This is now a significant health concern and I cannot justify paying over $500 a month in condo fees for such poor and downright disgusting living conditions. I do not have time to chase down a company whose entire job is to ensure the health and safety of the tenants who pay $6,000 annually, and are unable to do so.Business response

While we strive to maintain the highest standards at our managed properties, we do not have free reign as we operate in conjunction with the ***** of ******** and must also ************* limitations when faced with situations of hoarding.
To the specific issues cited:
Pest Management:
The association has been using Eco Pest Control as the pest control vendor for the property since July of 2016 which started with a weekly service and switched to the current twice monthly visits in 2018. The ***** approved in-unit pest management visits in April and June of 2022 for those who requested it. The ***** is satisfied with the current pest management vendor and has declined to change companies.Cigarette and marijuana smoke emanating from units:
Unless the ***** wishes to amend the condominium documents to restrict smoking within units, we are not able to restrict or govern those who choose to smoke in their units.Hoarder Unit:
We have been working with the ***** since July 2021 to mitigate the related issues, they initially hoped to resolve it amicably without counsel. The ***** approved that legal counsel be brought in as of August, 2022.Inspectional Services has also been involved and citations were issued. Hoarding is a mental health issue and has significant protections under housing law which severely limits how we are able to act, particularly when access is denied by the resident as it has been in this case. We are currently awaiting a final judgment from the court so the ***** can determine next steps.Condo Fees:
Your condo fees, along with those of your neighbors, contribute to services to the building such as building utilities,snow removal, exterminating, landscaping, common area repairs and maintenance,fire safety system maintenance and testing, property insurance and a contribution to an operating reserve account in addition to the management fees. Management fees are a small percentage of the budget and include support from your property manager, accounting personnel, our client services team, and access to 24/7 emergency response.While we sympathize that you and your neighbors are living with some challenging conditions, we are working with the ***** to resolve them and,in the interim, you have benefitted from the services your fees contributed to.

Circulating pump proposal approved 3/23, scheduled for installation 4/23
4/23- Damaged trash bin replacement
4/23- Hallway carpet cleaningIt is at the *****s discretion to select the management company and/or to consider your request for refunding fees. Please note that others,including ********, are impacted by the conditions you describe as well and refunding condo fees to any resident would put the Association in a negative cash flow position thereby eliminating the ability of the Trust to operate or make further improvements.
