On April 6, 2024, I walked into Landers Jewelers, and the owner asked me what I was looking for. I said I was looking for a charm, but they did not have what I was looking for. The owner then proceeded to tell me that he could get whatever I wanted. He then showed me a book of jewelry that he offers because he was persistent that anything he does not currently have in store, he can get shipped in. I then chose a butterfly charm for $336. He told me that he would have it available by Tuesday, April 10, 2024. I picked up the charm on April 12, 2024, and he told me that if the charm did not fit my chain, that he would be able to fix it and adjust the chain. He did not disclose that it would be for an additional fee. I came back on the following Saturday, April 14, 2024, because the charm did not fit my chain, and he asked me for $80 to add more gold to the charm. I declined to spend more money and said that I would need to return the charm. He said you cannot return it. Its a special order. I said you did not tell me that. He said it was on the receipt, but the transaction had already been completed. It was very misleading because at no point did he say that it was a special order. The charm had not been altered any way, and it is a piece of jewelry that he could have in his any given time. It was just not in his possession at the time. It was not a piece that was made for me because it was in stock in his warehouse. He refused to give me a refund and only offered a small ring to keep the charm on the chain. I do believe I am entitled to a refund because this is not a special order, and I dont believe that you can misuse a term to deny customers a refund. I want to return the charm and receive my refund because I cannot use the charm the way it was intended as it does not fit my chain. If I had known that this was a special order and it was nonrefundable, I would not have ordered the charm because I didnt know whether or not it would have fit my chain.
