      bought a pickup truck from the company, found out after a week of having the truck, gas tank pump was leaking gas,while under the truck assessing the problem found big chunks of missing metal all over the frame, setup an appointment to get fixed 2 cross bars were fixed by company but not with correct parts, they used black conduit tubing and wielded parts that were cut off original parts which have rust damage, I requested the frame be replaced because other damage but refused,had to pay for the fuel pump out of pocket and was told I was lucky they were fixing the cross members because they had to spend money to fix the trade in, paid $25000 for the truck and in a few year might have to pay another $5000 to replace the frame,not to happy with company

      We are writing in response to a letter from your office regarding a complaint filed by ************************* who purchased a vehicle from us at 039 Auto Sales. We wish to clarify the situation and provide our perspective on the matter.

      At the time of sale, we signed a Bill of Sale and a Purchase Agreement with ****************. Both documents clearly state that the vehicle comes with an implied Lemon Law warranty. The attached documentation, which includes the Bill of Sale and the Purchase Agreement, confirms that the vehicle was not sold "as is." 

      It appears that the paperwork the customer sent to your office as proof of the vehicle being sold "as is" actually refers to the period after the Lemon Law warranty has expired. This applies because the customer refused to purchase an extended rebateable product, meaning that once the Lemon Law period ends, the vehicle no longer carries a warranty. We wish the customer had sent you the Bill of Sale, which clearly indicates the Lemon Law warranty.

      Furthermore, on July 25, 2024, we contacted ***************************** to address the customers concerns. We invited **************** to bring the vehicle back for inspection so we could assess and resolve any issues. Unfortunately, instead of reaching out to us directly, the customer chose to file a complaint with your office. Despite our request for the customer to deliver the vehicle to us as soon as possible for inspection and resolution, the customer decided not to bring the truck immediately, choosing to take his time and notify us later about the time of delivery.

      As a gesture of goodwill, we have offered  Mr. ************ a reimbursement for fuel pump and assured them of a prompt resolution. We are waiting for the customer to inform us of a convenient time to bring the vehicle in for inspection. 

      We deeply regret any inconvenience this situation may have caused and are committed to resolving it amicably. We appreciate your understanding and assistance in this matter.

      truck was delivered on July 27 and received July, pumped was worked on and told parts on order, wanted to included the buyers guide, that says as is sale, dealership does not provide a warranty, which was not uploaded and is considered by attorney general as legal document. please note doesn't say anything about extended warranty, an express form was uploaded with dealership forms, but the buyer guid was not. if the truck is fixed as agreed will be looking to get this complaint closed

      Purchased 2011 GMC ****** for $18995. Took delivery on 1/21/2023.On 2/11/2023 I returned the vehicle to the dealer as the frame cross member was broken. While Onur and I were under the truck looking, I pointed out several areas where the frame was rotted and the *** module had rusted away from the frame. The check engine light was on for an Evap leak. I requested a refund under the lemon law, but he refused. He said he would take care of it all so I left the truck with him.On 2/24/2023 my son picked up the truck and brought it home. The check engine light came back on for the same reason before he was home. The frame cross members were replaced. Additionally, the spare tire was cut from the underbed winch and put in the bed, there was significant paint damage from carelessly removing the bed and a significant gas leak from the fuel pump.On 3/20/2023 the main brake line from the master cylinder to the *** module ruptured. I took the truck to my local mechanic for repair and he deemed the truck as unsafe due to excessive frame rot which was covered up with sheet metal that was glued on with RTV. Additional breaches in the frame were covered up with some sort of putty. He refused to work on the truck due to the liability. He also noted that the replacement frame cross members were shoddily welded and the welds were not structurally sound.I took the truck to another independent mechanic with the same result.I now have an ~$19k truck that cannot be driven. The current inspection sticker was obtained by 039 Auto.I am demanding a refund in full and believe there is sufficient evidence to pursue legal action for dealer fraud.Mass ************************ ************* ******** will also be formally notified in an attempt to resolve the issue prior to legal action which may entitle me to treble damages due to the willful coverup of the actual frame condition.

      **** **** Ranger Super Cab - ****** miles 9/25/22- $900- deposit on truck (cash with receipt)9/29/22-$9,150-balance, paid in full (cash with receipt) Truck picked up 10/8/22 as dealership requested w/ inspection sticker.Received with no horn or reverse lights called dealership 10/8. On 10/10 - 10/12 shaking over 40, engine light on, truck wet inside the cab when rains and other issues.Truck now parked. Truck brought in 10/25/22 as requested with a list. Contacted to pick up on 11/19/22 told all issues were fixed. Upon driving home still shaking. Following morning turning truck on noticed hint of light on dash where the engine light should be,realized even turning to on position you could not see but a tiny bit of light instead of the full engine light. At that point we decided to bring the truck to a different mechanic . He found several codes for engine light, needed drive shaft as there was a lift kit installed on truck w/wrong parts and unsafe, front shaft seized at slip yoke, catalytic converter, purge valve, wires to rear lights cut out (reason for no rear lights) needs new harness/wiring, the engine light never went off dash taken apart and tape put in front of the bulb in the gauge cluster. Brought this to dealership attention and were told to bring back for repair we explained we were not comfortable considering someone put tape on engine light to hide, we will have another mechanic do repairs. We were told to send him the bills and would look over. We had the truck partially repaired between 2 different shops as needed (most important things first.) paid for repairs out of pocket. We sent receipts and he will not cover. Current bills do not include all repairs needed. We were also informed sold a truck with ****** miles but it is not original engine, not the correct engine or bolts no way to tell the mileage on truck which should have been disclosed to us. Being told lemon law passed time all brought to attention with 3 days of receiving truck.

Please note that the vehicle was sold with off-road modifications, including a lift kit and signal modifications, which were discussed with you before the purchase and you had the opportunity to test drive the vehicle twice.

      We attempted to address the issues you reported to us, but you refused to bring the truck back to us for repairs and took it to a different mechanic instead. We have already reimbursed the cost of the catalytic converter repair, even though it was outside the lemon law coverage period. However, we cannot cover the additional repair costs you incurred as they are not related to the original issues reported and the vehicle is out of warranty, both in terms of mileage and the lemon law period.

      Hello, Thank you for getting back to me. We were not sold an off road truck but a $9000 truck that should be road worthy as well as safe. A $900- deposit was placed on 9/25/22, the balance of $9150-was paid in cash on 9/29/22. You had us leave the vehicle  for an inspection sticker and registry run as well as a few repairs. We picked up the truck as asked by you on 10/7/22 that is the first time we took possession of the truck (it was in your possession for 12 days).The truck was bought with 88, 864 miles when picked up on 10/8/22 it had ****** (we have photographs with dates). We brought to your attention that it had no plate lights, no reverse lights, no horn, truck shaking, engine light on and truck filling with water when it rained as well as other issues, all within 3 days of having the truck which was within the time frame of the lemon law. You asked for us to bring the truck in for repairs on 10/25/22 which we did. We drove 40 minutes to your mechanic dropping the truck off it had ******, at this point the ruck was with you from 10/25/22 until 11/19/22 and picking up with ****** miles and the truck was in your possession for another 25 days, bringing the total number of days the truck was in your possession to 37 days. The reason we brought it to a mechanic here and called you to let you know we were doing so is After you claim to have repaired the truck we still had the shaking issue, a leaking issue and the engine light was still on. You repaired nothing. However after the mechanic looked at the truck you did manage to take the dashboard apart and PUT DUCT TAPE OVER THE ENGINE LIGHT TO HIDE THE **** THAT YOU DID NOT REPAIR anything  at all. At that point I was not comfortable with you repairing the truck. We did not have anything fixed that we did not bring to your attention within the time frame of the lemon law. We sent you the bills for those repairs. We still have allot to repair for the truck to be driven safely and without leaking but we were not asking for those future repairs, we made a bad decision buying this vehicle from your dealership so we were willing to cut our losses after the first set of repairs if you were honest about it,  which you are  apparently not.  To say the least it is very dishonest and illegal to cover an engine light and say you made repairs as well as get an inspection sticker put on a vehicle with no back lights, no plate lights, no horn and several other issues it should not have passed at all. So yes I am uncomfortable with you fixing our vehicle. I also received your check for $319.31 yesterday and let you know we would not be cashing as the repairs bills total $1,617.85. That we had to pay out of pocket and still have several more repairs to be done for a $9000- truck. I was hoping to settle this here but it seems you think you have no fault and did nothing wrong or illegal.

      Thank you for your response. We apologize for any inconvenience caused by the issues with the truck you purchased. As previously discussed, we have fixed the mentioned items that been sent to us by **** (****, headlight mounting, radio) and we even have the text message by **** confirming that everything works perfectly fine except the issue with catalyc. We  agreed to pay for the catalytic converter after you will sent us the reciept as a proof because **** didn't want to deliver back to our mechanic and that issue happened during the coverage period. By the way check for that repair  has been sent to you. And we explained to  **** we have nothing to do with a tape.  That truck been on your facility and been inspected by your mechanic. 
      Regarding the rear drive shaft repair, it was fixed in January 2023, and we were not informed of the issue within the lemon law timeframe. As for the other concerns mentioned in your email, we regret that we were unable to meet your expectations despite our efforts to repair the truck. However, we assure you that we did not intentionally hide any issues or attempt to deceive you.
      We understand that you have incurred additional expenses, and we regret that we could not assist you further. We hope to resolve this matter amicably and put this situation behind us. If there is anything else we can do to assist you, please let us know.

      Good evening, The rear drive shaft is what was causing  the shaking in the truck that we complained about ton day 3 and we also have texts, as well as photos and videos that we have taken and photos from mechanic who after looking over suggested reversing the sale as the truck was not safe to drive and never should have passed inspection for several reasons.. The truck was brought to a mechanic here a few days after getting back from your mechanic in November, and we let you know we were bringing to a mechanic here. The bill was for ******* because that is when the truck was finished being repaired. There were several repairs to be done and the drive shaft had to be rebuilt because it was too small and did not support the truck and that is what was causing the severe shaking and turns out very dangerous. We bought a truck that has been in the shop since we bought it.  Seeing there seems to be a problem with honesty here,  I do see we are not going to agree so it is best to move forward and allow a court to go over everything and settle this matter.       Once we drove the truck off the lot, the nice moods turned nasty, we had questions of the brake work they claimed they did, but they refused to provide a receipt, then the rims accumulated a huge amount of brake dust, so we believe they used substandard brake pads or didn't do the work at all but still have our $350. We couldn't get an answer or receipt, we couldn't verify they even did the brakes. Once I (beware they have issues with strong American women questioning them) questioned them two men got on the phone and both started laughing, screaming and suddenly could no longer speak english, refused to answer our questions. After months they finally gave a receipt for the brakes but it appears fraudulent and why withhold the receipt so long? We are filing small claims case, but the manager will not provide the company owners name, to file small claims you must have a name, BBB just gave us the owners name.       If you noticed all the complaint was built up on consumption "  so we believe they used substandard brake pads or didn't do the work at all" . "We believe" doesn't mean professional inspection report and decision.  We are totally  agree that the required receipt been sent late. And we delivered our apologies for that. Eventually receipt  been sent and the customer received that.  We keep all the text messages and the email dialogs , while we try to talk to a customer and try to clear up the reason of dissatisfaction, she wasn't be able to give us any reason, just because the receipt been sent late, she is planning to take us to a court.

      Dealer sold me a truck that they claimed had 0 issues other then the fuel gauge and check engine light that was for a fuel rail pressure sensor they said they would fix those before pick up I picked it up and both things stopped working the next day so they just cleared the codes and tried to make it look like they had fixed it I also had to wait an extra 3 weeks to pick it up because they kept messing up the paperwork for the *** I took the truck back and they said they would fix it I picked it up again and check engine light came back so they once again just cleared the code and claimed it was fixed I took it back again they said theyd fix it and then I went to pick it up again and they broken more parts the injectors no longer worked the check engine light was on fuel gauge didnt work so I couldnt even drive it home it stayed with them for a month while they claimed to fix it again I got it back and the check engine light was gone and fuel gauge worked but now it leaks diesel fuel two injectors are blown out and it leaks coolant dealership wont return my calls or texts I was asking for my money back this entire time and dealer refuses to give me me money back says theyll fix it but they just keep breaking it more and more might I add they claimed they put new injectors in it and they left the skid plate for my fuel tank in the truck bed and never mounted it back up the mechanic they use cussed me out and told me not to call and again they will not answer my calls or texts I believe the inspection sticker on my truck and all other vehicles they sell to be fake as well

      My daughter left a $300 deposit w the owner for a truck on the lot that was supposedly fully refundable. The owner now eill not refund the deposit. Again no agreement was signed and he was specifically told it was agreed to that the truck was being purchased and she had to wait for her father(me) due to the fact I had to finance it w her. He will not refund the deposit. Can u help?

      Customer stopped by discussed the  price and shared her concern about the tires. Said: "I am going to wait for my Father", but in the main time paid $300 (Three hundred dollars) as a deposit to hold the vehicle for her. We did mentioned that tire replacement might take extra time and we agreed tire to be replaced before her father stop by at the dealership. While we orally agreed that we would take care of that tires , we did mentioned that after required work been performed paid deposit wouldn't be refundable. So we basically orally agreed and stated that we will not refund paid deposit if you change your mind after. Now the father of the customer mentioned that they found another truck and want that money been refunded. Unfortunately we can't refund the money now based on our agreement.

      I have never in my life dealt with anything like I have with this dealership. Purchased a **** f-150 in March from 039 motors. It was given to me with a red rejection sticker and the dealership was supposed to fix the issues that the truck failed for. Was told it originally failed for the ebrake. Before I could bring it back to get fixed within the first few weeks of having the truck a slew of problems were discovered with it, including a power steering leak, check engine light came on for a catalytic converter issue also. 2 weeks after purchasing the truck the rear end blew out in the highway and I brought it to the dealership right away. They had the truck for 2 weeks and were supposed to fix the rear end and the list of other problems the truck had so I could get a passing inspection. They only fixed the rear end with a used part the dealership provided and did not fix anything else. Truck recently started shaking on the highway and after having my own mechanic check the truck thoroughly he told me that not only is the rear end that was put in no good and needs to be replaced, that the truck has many problems and will require several thousand dollars worth of work. Also now has airbag sensors failing which is a huge safety concern. I called the dealership who refuses to even fix the problem with the rear end even though it was them who replaced it with the bad part. I have no warranty or anything. They are telling me that because of the time frame and that I did not purchase an extended warranty they are not responsible. I have NEVER had a passing inspection on this truck that I am 17k into a loan with and have only made 2 payments on. I want a refund on the truck and they are refusing. I am now in the process of taking legal action against them to get my money back for this truck. Horrible business I wish I paid attention to my instinct when I had a bad feeling about them.

      That is  true, the truck was purchased in march 03/14/22. The truck was then registered 3/16/22 and failed the inspection because of the emergency brake and plate lights. We provided the customer a full report and offered to take care of the problems within one business day. The customer was in rush and pushed us to take the truck with the rejection sticker.   We agreed to schedule an appointment 1 week later to repair the **brake and plate lights, but the customer failed to show up at scheduled appointment date on 2 occasions. On March 24th (3/24/22) the customer called and informed us that on the high way, the rear differential (pumpkin) blew up.  We advised that they deliver the truck to us immediately so we can inspect and take care of the truck. After inspection by our mechanic we found that this issue to the pumpkin was caused by engaging 4wd while in motion . We then took care of all issues.  (emergency brake, plate lights and pumpkin). Customer insisted to do a final inspection herself. We advised to take the truck to the inspection as soon as possible and send us an inspection report. We didn't hear back from the customer until 05/23/22. The truck was sold at the mileage of ******. The mileage shown on the customers most recent report shows the vehicle has been driven more than ***** miles, ending the warranty.
