We signed a client engagement letter for tax preparation services on April 30th, 2023. We sought out this company to work on a 2021 amendment that had to do with education credits with our son and complete 2022 taxes. Our son amended his taxes and the *** received his return on June 6,2023. ***** Wachsler was given power of attorney to speak directly to the *** to complete a 2021 amendment and set up a payment plan while 2022 taxes were being completed. ***** stopped communications with us (phone, email, portal chat) from 10/13/23-1/2/2024 when we terminated her services. When ***** did not correspond with us, we drove to the business address to see if we could talk to someone but she has a residential office only and would not speak with us. ***** was collecting money and did not carry out what she was hired to do. She also tried collecting payment on 1/4/2024 even after we terminated her services (we had to stop payment and open a new bank account). After speaking to the *** on 12/18/23, ***** did not speak to them on the dates she told us and never filed a 2021 amendment, or worked on our 2022 taxes all while being paid directly from our bank account. She also violated the power of attorney terms by speaking to an advocate from the *** on 2/5/2024 after her services were terminated. She has refused to refund our money and has not addressed our requests. Not only are we out ******** but we have nothing to show for it. We have accrued additional costs and penalties due to hiring a different accountant who completed a 2021 amendment and 2022 taxes.Customer response

On January 16, 2023, we provided ***** Wachsler / Wachsler CPA with a $1,000 deposit by credit card with an agreement that she would complete our 2022 tax returns in a professional manner. Over the next 3 months, ***** left several of our key questions unanswered, was very slow to offer updates and was unable/unwilling to meet with us by video meeting or via phone, was consistently elusive about our question of whether we should plan to be in need of filing an extension as we steadily approached the tax deadline, etc. Finally, approximately 48 hours prior to the tax filing deadline, she was trying to then ask us questions and seeking information, providing us with 3 different sets of estimated tax payment figures in the course of an hour. At this time, we lost all faith in her and her professionalism, and we terminated our contract, requesting a full refund for having not done our taxes as agreed. ***** countered saying she had done some work, and for that time spent, would refund us $800 of the $1000 deposit, within 30 days that we requested. Those 30 days have now come and gone. At Day 30, we emailed ***** indicating that we now wished to receive the full $1000 refund in light of yet another failed agreement, and gave her 7 days to provide refund by check or refunded to our credit card. At Day 35, we finally tried calling her once more to implore her to provide our refund and put this behind us, or we would be filing complaints with the BBB, the Secretary of State, the *********** of ************ and ultimately if needed in small claims court. There has been zero response. At this juncture, especially upon reading other recent online reviews of ***** and her business operations, we have zero faith in either and wish to receive a direct refund to our credit card or a certified bank check from ***** for the $1000 deposit.Business response

Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. Please add your rejection comments below; if you do not provide any details, your complaint will be closed as Answered.
This response from Ms. ********************** is false and incomplete. Even with over 2.5 months of time at her disposal, the fact is that she did NOT complete our taxes. We changed from our former tax preparer of six years to her specifically for her claimed experience with cryptocurrency and NFTs. Between January and *****, we left her voicemails with questions that went unanswered; she responded eventually indicating that she does not check her voicemail and to pose all questions through her portal. In turn, we did that, and she still left certain questions answered and was incredibly slow in her responses overall. She did not speak with us by phone about her inability to ascertain information/figures needed to complete the return until Friday afternoon, April 14, at approximately 3pm. She requested a website resource from us to find data needed; we said we would get it right to her momentarily, and she said, "Oh, no rush. I'm going to attend a graduation... Family comes first as you know." She then didn't engage again more significantly with us until Sunday morning and early afternoon, April 16 -- 48 hours prior to the tax deadline. We pushed for an immediate Zoom call at that time; she ignored the request, offering to speak at a time we were not available later than night. She then provided us with 3 different tax payment estimates within an hour's time, leaving us with zero trust left in her services and professionalism. We were finally forced to file an extension ourselves on April 17 as we terminated our contract with her. We requested a full $1000 refund of our deposit; she said instead that she would refund $800 because, paraphrasing, "some work had been done" and we were "provided with payment estimates" -- again, 3 totally different sets of estimates in a brief period of time. Seemingly without option, we told her to return that amount within 30 days. Then, we emailed her twice within that 30 day period to learn when and how the refund would be proceeded, and she did not reply. At Day 30, with no refund, we emailed her once more with a final 7 day demand, this time, wishing to be refunded the entire $1000, due to her second failure to fulfill an agreement. At Day 35, I (****) called her and left a very sincere message, imploring her to refund us the full amount by Day 37, before we proceeded with filing complaints such as this one and if needed filing in small claims court. At Day 37, with no refund still, we reluctantly filed this BBB complaint. Only then after did she finally authorize the partial $800 refund to our credit card. Then, following another email exchange in which I reiterated our call for a full $1000 refund expressed in both emails and the voicemail to preempt further complaints being file, she then said she would "donate $200" to the nonprofit I work for instead of just honoring our request for a proper and full refund. She has acted unprofessionally throughout, start to finish. Finally, she indicated in her BBB response that we were "upset that we needed to pay the State." This is an outright falsehood; we have never been angry to pay our fair share of taxes owed, which includes last tax year, when we paid a not insignificant amount. We were upset that she provided us 3 wildly different payment estimates, again, in a short period of time. Thank you.

All work was completed except for pricing for specific NFTs. The client wanted to assign a basis of $0 against both cost (which is ok) and sales (which is NOT ok). I told client how much to pay for estimated State taxes (Federal was a refund). There was no negative impact as deadline is October 16, 2023.
