Klistenes DaCosta (KD) signed a home addition project with me on June 20, 2022, in the amount of $116,700, excluding material. We had two architect designs, the 2nd was revision based on the 1st to stay within the scope of the contract. Permit was issued on July 6, 2023. The construction started July 2023. I paid the permit fee and extra for architect revision, which is covered by the contract. Due to surprises and complications found in structure, mistakes in the design or made during construction, he sent me invoices for so-called 'extra' services. To resolve the conflict and accommodate reasonable changes to the plan, we signed a contract amendment increasing 10% on labor fee, which gives $128,370 total for labor only.DaCosta rushed me for payments. By Jan 9, 2024, I have paid $100K for 4 out of total 5 installments on the contract, and $7500 on the amendment. Yet the project is still in rough phase as of today. Since only the last payment is left, he started to invoice me all sorts of 'extra' services, most of which are covered in the contract/design, never mentioned to me as 'extra' and price forced upon me without agreement after completion. Since material is not included in the contract, he has mishandled project material: my credit card charged without receipts, material taken away from site without permission, material ****** bought and wasted, returns not done timely. All these have put unreasonably high material expense on me.There are quality issues related to his or subcontractors' work. The foundation has water issue and the roof has experienced many times of leak. These jobs didn't follow the design and the Mass code. The unprofessional siding and exterior job has many visible mistakes. My request to address the issues hasn't been met since Jan 2024. He has delayed the project since Feb, asking for extra payment, refusing to talk. His intention of breaching contract becomes apparent after taking away extra payment of about $25K.
