      I hired Patrick J Gannon Construction (DBA: SE Gannon Construction) on May 3 ****, to complete a variety of projects at my home. Those projects included but were not limited to the repair/reconstruction of 3 decks - all requiring that permits be pulled) and the facilitation of manufacture and installation of kitchen counter tops. The contract was in consideration of $18,860 (that was broken down by individual project value) plus $3680 for full payment of the counters. Gannon assured me at time the contract was signed that despite the state's website saying his HIC and CSL had expired in July 21st, his CLS was active, blaming the state for being behind on updating their website. I was assured he would still be allowed to pull permits. Between May 11th and July 18th Gannon and/or his crew showed up a handful of times. Several projects were initiated but only a few were actually complete. By July 6, 2022 Gannon had been paid $12,768 toward the contract price, plus the $3680 for the counters. Had he completed the deck projects Gannon would have earned $12, 560, which means he was paid $226 over the contract price. The last communication I had with Gannon was by text message of July 19th. Despite my efforts to get Gannon to return to finish the work or refund my money he has declined to do so. My last attempt to communicate with Gannon was by email dated August 17th, however Gannon failed to respond. In summary the contractor lied about the status of his credentials at the time he was hired failed to pull required permits for the contracted work abandoned job and has ceased all communication with me took funds far more than what he earned and refuses to provide me with a refund.

      Hello, this ***** Patricks wife I thought our office assistant sent out messages to current jobs and clients Patrick had two lung surgeries in July he was out of commission for a bit we are back on track and this job will be completed by our crew our first number one crew by the mid to the end of October. And we will follow up on these countertops.

      Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. Please add your rejection comments below; if you do not provide any details, your complaint will be closed as Answered. 

      I am submitting this email in response to ***** **********************'s answer to my complaint.

      The allegations of Mr. **********************'s illness (if true) is quite unfortunate, however, it does not explain many of the issues noted in my complainant, nor does it explain why the work was not completed between May 3rd and July 19th. Mr. ********************** called my cell phone at 10:15 am on August 8th but declined to leave a message. I returned that call on August 11th, but he did not answer. I left a voicemail message, but never heard from Mr. ********************** again. I am finding it hard to believe he could call my phone in August but could not be bothered to leave me a message or have somebody else call me back.  After receiving my email of August 17th, it was clear that I was unaware of his alleged medical condition, yet he made no attempt to contact me himself or through Mrs. ********************** or his assistant. 

      Setting my personal feelings or opinions aside this is my counter offer to the half hearted promise noted below.

      1- Mr. ********************** will pull the required permit for the deck renovations. The cost of which will be paid by Mr. **********************.
      2 - The boards/platform on the front deck were cut unevenly leaving multiple gaps between the house and the platform. In addition to completing the rail system, these boards are to be replaced, or reset and trimmed so that the edges are flush with the house.
      3- The railings on the back deck will be completed and the remainder of the deck and stairs will be stained. 
      4- The flooring in the living room should have been fully or partially leveled before the laminate was installed.  There were not. This needs to be corrected, using the $200 paid and allocated for misc repairs as written in our executed contract.
      5- I want something in writing with Mr. **********************'s signature stating that this work will be COMPLETED NO LATER THAN NOVEMBER 5, 2022.
      6- Lastly, as requested multiple times between May and August, I want some form of written proof that Mr. ********************** actually ordered the  countertops along with some assurance that the price of these counters will not exceed the quote he provided to me on May 16th, by more that $300 (My budget allowed for $4000 for kitchen counters). If Mr. ********************** is unable to provide me with that proof of purchase/order I expect a full refund of the $3680 within the next 30 days. 

      If Mr. ********************** is unable or unwilling to agree to these terms and/or comply with the  agreement, I will be forced to file a complaint in Plymouth District Court, at which time I will ask the court for the value of the incomplete work plus damages.
