On 6/12/21 I purchased a 2008 Chevy silverado for a purchase price of $15,500 with a signed guarantee that the vehicle would pass state inspection. I brought it to be inspected and it failed I contacted the dealer in which he said everything would be fixed properly and to drop it off. After almost 3 weeks I was able to pick it up and not all the repairs would properly fixed which I pointed out and they told me it would pass. I brought it back to be re inspected and it failed again. I have been fighting with the dealer ever since to have the repairs made properly and as of today 12/29/21 the vehicle is still not inspected.

      Business response

      02/02/2022

Business Response /* (1000, 10, 2022/01/15) */ The truck was sold on 6/18/21 with 133,000 miles. Because it had more than 125,000 miles on it, it did not qualify for the used vehicle warranty. However, It is covered by the lemon aid law which states that if a vehicle fails inspection within 7 days of the sale and the repairs are more than 10% of purchase price, dealer can refund or repair the vehicle. On July 5th the vehicle was taken to get inspected, and failed a New Hampshire inspection for several items ( none of these items would fail a mass inspection ). The truck was not inspected within the 7 days required to qualify for the lemon aid law, therefore I was not liable to make repairs or refunds. In good faith, and under no obligation, I asked the customer to drop off the vehicle and inspection report, and I would take care of the issues. I had everything fixed on the inspection report. Truck was dropped off to me on 7/9/21 and was ready for pick up 7/24/21. Even though it needed to go to a body shop and then a mechanic shop, it did not take 3 weeks. The customer picked up the truck on 7/26/21. At pickup he pointed out a concern with the inner fender arches ( not structural). I stated that I believed it would pass inspection, but if he wanted to replace them, I can buy the parts and provide them to him. He stated that he was happy with that because he had someone to replace it for him. I ordered the parts and on 8/5/21 we met up and I gave him the parts. A month later on 9/7/21 the customer reached out to tell me it failed inspection again. I have not been presented with an inspection report stating that it was reinspected and failed. After some back and forth communication with him, on 10/26/21 I informed him that I was able to schedule him a drop off appointment for 11/5/21 to have the parts replaced that he had agreed to install , and he agreed to drop it off. On 11/4/21 he said he was going to let me know if he would be able to make it to the appointment the next day. That is the last communication I have received from him. He has my cell number, office number, Facebook messenger, and email address. I did not receive any communication from him after 11/4, until I received this claim from the BBB. I have had nothing but pleasant communication with this customer from before the sale, to now. I was blindsided by this claim because i have maintained open communication with him, and have always been willing to help, even though I'm not required to by law. He stopped communicating with me, not the other way around. At this point, I still have not been provided with an inspection report stating it failed re-inspection. Consumer Response /* (3000, 12, 2022/01/20) */ (The consumer indicated he/she DID NOT accept the response from the business.) When I picked up the vehicle the first time I had dropped it off and pointed out the bad work that had been done to it the response I got was that he was done putting money into it and that it was a bad deal for him from the beginning. I also pointed out that the truck looked like it had gone off roading and that someone had hit something in the front in which he had no response for. the work that still needs to be done as of New Hampshire inspection is structural. The dealership did order the inner wheel arches even though it needed inner and outer wheel arches and told me to find someone to install them and I told him I would see if I could but when every shop I contacted told me it would be a minimum of $1500 to repair it I contacted the dealer again in which it took several weeks to get a response. When I finally got a response he told me to drop it off to him and he would drop it off to his body guy and I stated the date and time he wanted it dropped off did not work for me due to our other vehicle being in the shop at that time and with having to drop my vehicle off to him over an hour away would be difficult to find a ride home. The work that had been done was only supposed to take a few days not over 2 weeks but they lost the key to the lug nuts and had to locate a new one so the truck just sat with nothing being done to it. Every time I pointed out anything he had no concerns about it because it was up to Mass standards and he wasn't concerned about New Hampshire inspection standards. If selling to a New Hampshire resident was such a concern for the different standards in inspection he should have not sold the truck with a singed guarantee it would pass inspection.
