Bought a used 2012 ***** equinox from 4th dimension Auto Price $7999.00 after tax and fees total price $8958.94 paid deposit of $1958.94 balance to finance $7000. N&B car sales (******************) wrote up the financing paperwork car price $9795. sales tax $612.19 and added an optional service contact to A.U.L. Corp for $1395. *** told me this was the taxes, interest and fees I would pay over the term of the loan but the contract clearly states this is an optional coverage to add to the loan & was not what *** told me it was. I have MS and have limited income & would not have agreed to that extra charge on my loan. Avi conveniently forgot to send me the contract until 4/26/24. which was after West lake financial excepted the financing and sent me a bill on 4/16/24 and they started charging me interest on the loan from the day I decided to purchase the car 3/25/24 the car wasn't ready for pick up until 4/4/23.

I honestly don't know how this get to this.  Here is a Screen shot of the conversation that i have with you before i start the contract i now.

and i also call you and explain everything before we start the contract. that contract was sent to your email for you to sing. you were aware of all of the numbers.

and the bank that we used for you is a subprime bank they have fee depending on the credit score of the costumer.

And i know i said that i was going to give you that money that you said that was over charge but i don't have to do that because before you sign the contract you were aware of all that charge

      FAQ

I understand he sent me the loan amount of $9795 but *** told me he adjusted the down payment amount so I would be charged the price of the car  and payments were going to be $304.94 which they were. so I took him at his word, when in actuality he did change the price of the car and down payment amount which also changed the sales tax all of which did not add up to the amount that was left to finance for the car I purchased. Avi has been ignoring my inquiries except to respond on here which is fine I guess but talk about bad customer service. And not only has he decided to not respond to me directly any more but he only responded here after I sent him the differences in cost he stiffed me with and asked he not pay out of his pocket but to simply adjust the contract and I would pay the entire thing off immediately. I also asked him if I should just pay the whole thing and take him to small claims court for the difference in what I was charged. Regardless that *** told me he was adjusting the #'s to"get more out of the bank" (his words not mine) the Numbers should have reflected in the end the actual amount I was financing.. honestly I didn't understand why he was changing the numbers but when the payment amounts matched I stopped trying to figure out what he was explaining and thought well the payment amounts are the same so I guess he knows what he's doing. But apparently he knows how to change#'s so the customer doesn't realize what's going on until it is to late. And *** told me he's been doing this for (I think he Said) 7 years how many other unsuspecting customers has he ripped off in that time. This has got to stop! If not to help me than so he can't keep doing this to other people.

I want to clarify a few points. Before we started the contract, I called and informed you that the bank we were using is a sub-prime lender, and that there would be fees involved for customers with no credit or bad credit. I also mentioned that the extended warranty would increase the loan amount. Please understand that I didn't take any extra money from you. I helped the dealership to assist you, and I even went to your job to try and expedite the process. I hope you can see that I did my best to help you.I sent you a text and also emailed you the contract. I had mentioned that I would give you some money back as I didn't want to deal with the situation, but we both agreed on the stipulations of the contract. Therefore, I'm not obligated to give you that money back, as I offered you a service. I'm sorry if this has caused any problems, but just like you, I have bills to pay and can't provide my services for free.

      FAQ

You never used the words "subprime" when talking about the lender but did explain what lender you were using for bad or no credit and did explain there would be fees. However you never said anything about a the "optional service contact" optional being the key word here you told me the amount in that space of the contract was the amount in fees and interest I would pay over the course of the loan which was a blatant lie and once I called you out on it you offered to see if you could have it removed which at the time I told you I had already spoken w them they sent me an email address with instructions on what info to send to have it removed. Which I did several times but it still wasn't removed I asked you if you could assist w that as my emails kept getting queued I Even tried to send the info from my husband's email and that didn't work either I sent you the info to forward to them and got no response from you or them, & the service contact is still on my bill so I assume either you had the same trouble as I did which should warrant a response from you letting me know or you just agreed to help and then ignored the issue. And why would I pay extra for a optional service contact if I knew I would be completely paying off the car the next month?  I asked ******'s partner when I picked up the car about maintenance services offered with the loan (some dealerships offer this) he told me they don't do anything like that so this optional service contact is not for maintenance on the vehicle so what is it? It still has never been explained what it actually is for (obviously your original explanation was false, it is not interest and fees). On the point of you coming to my job to expedite the paperwork yes, you did as you knew I had no car at the time. I offered to get a ride to you, you said going to ******** was no issue you have done it for several people and needed the contact signed ****. And the point of you not providing a service for free is null and void as you charged me $300 for the service of writing and submitting my loan application/contact which I had no issue with. The issue I have still remains the same the price of the car was changed which changes the sales tax the deposit was not accurate which you told me was to off set the change in the car price I trusted you that the numbers matched up but they didn't. I asked you to fix the contact to reflect the actual numbers but you refused and added the optional service contact I asked you to remove it and you still haven't. I would think in the interest of customer service you would fix the contact and eat the fees I've incurred since you have been dragging your feet & flat out refusing to fix the issues you caused with the false information you put on the sales contract. As a customer I should have been more diligent at reading every line before I signed but I didn't I trusted you at your word what each thing meant this is what you do for a living so you would know better than I would about contacts. I feal taken advantage of, and reported you so you wouldn't do the same thing to another unsuspecting customer. At this point I'm racking up interest on a loan that could have been paid off before the first bill was due but I choose to wait until the first bill came and would have the accurate account#'s when paying, and then I found all the mistakes that were made so I didn't pay anything since you should fix them before I'm locked in to paying $3,162.19 over the amount of the original purchase agreement on the vehicle. $3,162.19 is not a mistake an oops, that feels intentional and if it wasn't intentional than why wouldn't you just fix it? I don't want you to pay out of your pocket so you "don't have to deal w this" I want you to fix the contact so it is accurate. As a customer I do not think this is asking to much.
