My credit reports show an alleged account with inaccurate information. The **** requires that all data on a consumer's report be 100% ACCURATE, 100% VERIFIABLE, and 100% TIMELY. This means no data can be reported that isn't 100% accurate. I checked my credit reports and found this assumed collection account ************* @ $5,584.00 from this company with different and inaccurate opening dates, balances, first date of delinquency, balance due, and/or last date of activities for their same exact account. I have never had an account with this company, had any record of first notice of debt including rights to dispute from this company, nor informed by a representative that I had a right or timeframe to dispute this debt.I never signed any type of acknowledgement receipt from a mailing service for any mail from this company. Had I signed a receipt of notice for the legal documentation required, I wouldve responded asking for verification of debt or copy of court ordered judgement well within the 30 days allotted, forcing them to cease collection attempts until proof of verification is complete. Not only did they break FDCPA communications protocol, but they also broke FDCPA False or Misleading Representations protocol as well. A debt collector, in collecting a debt, may not use any false, deceptive, or misleading representation. Specifically, a debt collector may not falsely represent the character, amount, or legal status of the debt, or of any services rendered, or compensation he or she may receive for collecting the debt. A debt collector may not communicate, or threaten to communicate, false credit information or information that should be known to be false, including not identifying disputed debts as such. Each of my 3 credit reports show different, inaccurate information. This is considered false and misleading representation by this company. They are telling me I owe a debt that insurance was supposed to cover. They are very rude and dismissive, and do not comply with the Fair Credit Reporting Act. The man on the phone was trying to gaslight me and said Youre not willing to do anything Im offering after offering nothing. I think they are under the impression that I dont know the law or my rights, but they would probably be surprised to know how well educated I am on the law, and specifically on the Fair Credit Reporting Act. I believe they think this is my first time hearing about it, and that I havent been collecting evidence on the matter since 2020. They told me the only way to remove that debt is to pay it. That is simply not true. If the medical office makes a mistake and doesnt go through the insurance I provided them, and hastily sells the debt to a debt collector, that problem is between the debt collector and medical office to resolve, and that is the responsibility that All Debt Solutions takes on by simply being a debt collector. That is part of the job description of a debt collector and written into the Fair Credit Reporting Act. When your job is to buy debt, you are risking buying the inconsistencies and errors in the debt as well. It is the nature of the job. You bought a debt that is invalid. That is your loss, too bad so sad. If the debt collector wants their money, they have to get with the medical office and hash it out together and figure out why the insurance wasnt claimed. Please remove the collection promptly. I am not responsible for this debt and I am not your middleman, the only way I will be involving myself in this situation another time is with a lawyer in a courtroom. I still have the insurance card and a copy of my policy stating that my policy was valid at the time of the procedure, attached to my complaint against the medical office. Either the health insurance, medical provider, or debt collector are now responsible for this bill. I am the last one responsible.
