I paid Apple Creek Farm $2,000.00 deposit to purchase a horse. Two days after submitting the deposit due to unforeseen circumstances I had to cancel the purchase. The seller is refusing to refund my deposit. We have no signed agreement permitting them to keep my deposit.

The owner of the farm sold me a horse she advertised as being one you could put grandma or grandpa on he was so quiet and good natured. He seemed unusually docile when I brought him home. It was because he was very sick (temperature ***** on my third day). I called her right away and she told me not to let the vet do a strangles test. The vet did the test and it was positive causing her barn and mine to be quarantined. She refused to pay the vet bills because I didn't use her vet and she had an ongoing issue with my vet because she refused to do work at her farm. With antibiotics both he and my other horse got well until the 3rd week of quarantine when he developed fevers and severe swelling in his legs. It was a sequelae that occurs with a few horses after strangles. Tissue on his pasterns and legs became necrotic and sloughed of leaving raw open wounds. It took me 3 months and hours of nursing care daily to pull him through. He is badly scarred. I used her vet for the final testing to lift the quarantine and she still refused to pay after telling me if I used her vet she would. He is now well but an energetic spit fire who bolts easily. I have been badly injured. The bottom line is she totally misrepresented the horse, hid the fact that he was ill by telling me not to get a strangles test, and was untruthful about the vet bills. She is an unscrupulous horse trader for sure.

    Apple Creek Farm Response

**** came to our farm looking for a horse. We had a great time riding a few in and out of the ring. After she decided on a nice young horse, her knowing possibly too young for her needs, she went home to get her trailer. Going against our suggestion of a vet exam for all health and soundness concerns. She came back with the trailer and a horse that she had raised at her farm. This horse was also young but she had ridden him all over and took him to other stables even recently to specific barns that are known for having auction and sale horses in and out regularly. I did not like her horse but agreed to trade with her. Not a good business decision on my part but was sure helping her. The very next day, the young one I received from her was coughing and runny nose. Having a good idea what this was I moved him to quarantine immediately. Now, this sickness called strangles has a 7-10 day incubation period so I am very well aware he did not get sick with me. No other horse at my farm was sick. Knowing who her vet is, she is known all over this area for her lack of knowledge, care and kindness, I offered for Ruth to bring the horse back to my farm and I would take care of him until better. She declined. I suggested to her not to have the test performed only because that will prolong the Horse getting the medication needed, it is a costly test, and if she just could start him on the proper anabiotic‘s immediately it would be the best for him in the long run. She went against my suggestion, and had him tested, therefore not starting him on meds for over a week. The horse I received from her I started on meds immediately and he was all better within 10 days. Since she did have the test done in the state, got involved and quarantined both her stable and mine. My veterinarian handled my quarantine and it was lifted in 30 days because we treated the horse immediately and properly. Ruth’s quarantine lasted much longer because her veterinarian was not taken care of what she needed to do, and her horse was not treated in a timely fashion. Ruth, then finally took my suggestion and switched to my veterinarian, who made everybody better and her quarantine was lifted as well. I cannot say for certain that the sickness came from where Ruth was taking her horse to ride, but I am fairly certain it did not come from here since her horse was sick before the incubation. Period would have made it from here. I did not hold Ruth responsible for any vet, bills or medication required , I did offer to have her horse here and I would take care of him in every way, but she declined so I am unsure how this is my fault when nobody knows where the sickness originated.
