      Contract signed 2021. We learned of  **** via a coworker of his from Bay Path HS. After speaking with him several times in the summer of 2021 we agreed to move forward with the addition to our home. Construction began Oct 11 2021 when they removed the front porch of the house. The project remains unfinished. The new furnace has not been installed, the 2nd bathroom has drywall and subfloor ( no plumbing ,no tile) We have paid Mr Koliss around 160,000 dollars to date and have not received the value of this in supplies or labor. We have requested a breakdown of expenses, receipts of purchased flooring, tile, wood, etc. He has not provided these, but states the after we make the next payment (25,000) he will work on it. Weeks will go by and no one does a thing. The plumber notified us that he can "no longer work for free". He explained that **** owes him a lot for the work he has completed. We want the Project completed within an agreed upon time limit. We are not interested in continuing to pay for additional cost increases due to the estimate being written over a year ago. It is NOT our fault the project has been mismanaged and that costs increase over time. There are far too many issues to list here. I need to know if this is something the BBB can help with. If so i can provided details.

      After reading the complaint I will explain the delay in the project and why another payment is needed to proceed with the project
      This is the first time in 30 plus years of contracting I have had a complaint filed against me

      Delay in project
      You can check with any contractor and they will tell you the same thing. Im buried with work and, the timeline has to work to be on site, and make sure everything is ready. When they show up on a job, they need to stay there and complete.Can not come back and forth on project. I have explained numerous times to homeowners.
      Stone veneer
      Mason estimated project, the plans do not jive with the actual site. There are 3 more stone steps and more courses of veneer to be purchased and installed. The customer will not commit to the extra price, this is why exterior veneer is not complete. Homeowner does not want mason on site because of a hissy fit, which Im not sure what she means. He took on another project. I feel they still have a problem with the extra work at the beginning of the project where a footing and masonry wall had to be constructed to hold back dry stack foundation from collapsing. This has been thrown in my face a couple times and his replay was I complain about that as much as I want. Vinyl siding cannot be done until stone. Need to start along end of stone run.

      Exterior veneer would be complete if homeowner committed to extra charge



      As for the payments,my contract states a series of payments. The homeowner is deciding that they have paid enough so far. They dont understand that materials increased throughout the project. I did not stop project, discuss and collect extra payment because I usually do that at the end of project.

Master bath could have been completed if decision of tile was made. Still no decision on master carpet.

      Stone Veneer:

      Last year the ***** was here working on the old foundation of the house.  It was decided that instead of supporting the house, and pouring a new foundation wall, they would build another wall in front of the crumbling foundation.  They used CMU blocks to make the wall, and filled the space in between the old foundation, and new block wall, with pea stone and capped it roughly with cement.  In doing this, 2 feet of what was to be my storage area with shelves on each side, was lost.  It is now a hallway and shelves can only be on one side.   Storage was one the reasons for the new foundation under the new addition.  A crawlspace under the new section would have been substantially cheaper.  When the wall was completed we received a bill for the additional materials and labor needed to stabilize the unexpected crumbling of a 90 yr old foundation. Before the project continued we were asked to pay the ***** $8,000.   An estimate was not provided in advance.  I was shocked that a 5-foot high, 20ft simple cement block wall could cost that much.   In the end we paid the bill and insisted that going forward, an estimate would be provided for projects not considered in the original estimate. 

       Fast forward 6 months to the expected application of the stone veneer.  We waited months for the ***** to be available, as he was busy with other jobs.  We were notified; that because our original drawings did not match with the structure they built from them, that it would cost more than the original estimate.  Before agreeing to pay, my husband asked for a breakdown of extra material and installation costs. (ex.additional # of square ft of stone needed, cost of stone, cost of install labor)  Only a partial answer was provided without supply or labor costs.  Months later, we still do not have the requested info.  

      The new primary bedroom and bathroom is still bare plywood floor.  The drain pan for the shower is not fully installed because the carpentry work to support the shower seat isnt built, neither is the half-wall between the shower and the toilet.  Tilework cannot begin until the shower wall pan and cement board are on the walls - its still bare 2x4s from the original house.  The plumbing fixtures are incomplete and the wastewater drain from the new bathroom stops in the ceiling in the basement - its not connected to the sewer.   The bathroom vanity, purchased this spring, sits in the basement.  The plumber is not working on the house because what hes been paid is less even than his supplies cost him.  Its 25F as Im writing this, and *********** - that is supposed to have heated floors and baseboard heating-  is basically the same temperature because the furnace that has been sitting on the basement floor for months isnt installed.

      Note on the furnace: It is difficult to understand why we face another winter without our new furnace.  Our current system (ancient) is not up to the task anymore which is why we bought a new one.  Showers are miserable in the winter here.  The current system prioritizes the heating system, not the hot water for the shower.  Its a mystery as to whether today's shower will start cold, end cold, or stay tepid throughout.  Another feature of our old furnace is it is not strong enough to heat the second floor.  The first floor has to reach unreasonably hot temperatures before it is able to push the hot water to the end of the line (upstairs).  My daughter's room and our bedroom upstairs are always cold.

       

       The architectural plans that we had an architect create prior to starting this called for cross beams in the sunroom.  On the advice of the general contractor, we paid him and his consultant approximately $**** to concur that beams were, in fact, needed.  We have asked the contractor multiple times to procure and install the beams; theyre LVL beams and an in-stock item at *********** This needs to be done structurally, and also needs to be in place before finish work of the wood boards can go up over the rest of the ceiling. 

       

      We are still waiting for hardwood flooring in the living room, tile flooring in the sunroom and bathroom, and a cement floor connection between the basements which is currently bare dirt.  The tile and hardwood choices have been known by all parties for nearly a year.  Paint colors have likewise been known.

       

      We have signed a contract with **** stipulating a price and what would be done.  Cost increases that are discussed and approved in advance, as was done with the metal roof, are fine.  We have asked a dozen times - I can provide the email and texts - for a breakdown of costs incurred and to be incurred, and gotten nothing in response.  The builder has all but stopped work again for an undetermined amount of money that will surely increase should we hand over a new check.  

      Master Bathroom

      9/8/22 Tile setter was straightening out existing living room floor, asked homeowner about master bath tile and the reply was not sure if I want that tile

      ***** the tile/wood floor installer came one evening and put down the plywood subflooring in the living room.  Mid way through the center of the room is where the new and old house meet.  After the subfloor was installed there was a large hump running across the entire room. ( Pictures can be provided.)  The above comment straightening out the existing living room floor. was actually an attempt to correct the work he had done.  ***** had to remove a  large (4 x 15) section of subfloor that he had installed, grind down areas along the hump that were sticking up, and renailed the subflooring back down.  There are still several areas of concern but we have been assured that the wood flooring will cover, and level out, the remaining hills and valleys.

       

      Sunroom

      9/8/22 Homeowner mentioned ceiling in sunroom, still no decision

      The ceiling material has remained the same from the original drawings from **********   Mr ********************** has had difficulty locating the material for the ceiling of the sunroom.  If tongue and groove pine( with a low amount of knots, not knot free) does not exist at this time, please suggest things that are available. 

       

      Master bedroom

      9/14/22 Carpet installer looked at job

      10/10/22 left 2 voicemails

      10/13/22 no response

      No decision on carpet

      For personal reasons I cannot do business with ***********************.  That is the business I was told to contact for my carpet choices.  I need to know where I should go for this item. In addition the carpet selection is not blocking the installation of anything else. The door casing isnt on the bathroom doorway, no baseboards, no paint, no tile, etc.  I would prefer  not having workers going back and forth across a new carpet in order to work on the bathroom, which is basically an empty space right now except for the shower pan.

       

      As I have explained many times that these delays in decision making holds up other parts of the project

      My finish ********* has 2 days left. Need ceiling material to complete.

      There are doors to frame and hang, two doorway openings to frame, baseboards in all rooms, a transom window to install, two supporting crossbeams to install, and **** linear ft of pine board to nail up on the sunroom ceiling(not a flat surface).  

       

       Cannot paint until finish work is done, my subcontractors are busy and cannot start and stop job

      Tile would be complete in master bathroom if tile was picked out.

      Tile has remained the same, no change.  ******** and I discussed and made design changes.  The area will need to be re-measured before ordering as amounts have changed.

       

      Exterior veneer would be complete if homeowner committed to extra charge.

      As explained earlier in this letter, we are not going to commit to further additional charges without a cost breakdown of labor and supplies. Our trust was damaged after the $8000 wall in the basement and this was a reasonable request to remedy the situation.

       We have paid Mr ********************** over $160,000 and do not feel comfortable handing over the balance for work that *** never get completed. We have made $25,000 payments as requested until now. Weeks have passed by with no one coming to work. Some weeks there have been 1 or 2 guys working on Sat morning, and that is all for the week. 

       They dont understand that materials increased throughout the project. I did not stop project, discuss and collect extra payment because I usually do that at the end of project.

      **** the plumber has not been paid for all the work and supplies that he has done and purchased for this project.  We found this out a couple months ago when he stopped showing up. Eventually he explained that ********** was behind on paying him and the plumbing supply house he gets all his materials from, has temporarily suspended his account until it is paid down. We are willing to give **** a check for any extras outside the contract. For example, we requested an upgrade on the new furnace, we requested additional water faucets outside and in ***********.  If we pay **** directly for these items, since he paid out of pocket, I am concerned that it will not be deducted from our balance with *********

      This project has been going on for over a year.  It needs to be completed promptly, for the agreed upon price, with the quality workmanship we expected.  So much of the work has been completed on nights and weekends, this project has been a destructive force on family life.  Our ability to entertain family and friends has been eliminated.  We go from 8am sawz alls on the weekend, to no one is here for weeks.

      The businesss response is not satisfactory to me.  It is full of inaccuracies and entirely lacks a plan on how to finish the job.  It is a request for additional funds when we have not received the value of the money we have given.  According to my records (and checkbook), the amount that remains unpaid is $27,880 plus the money we will pay directly to the plumber.  We have given Mr ********************** $164,930 dollars so far. I am frustrated that he has mentioned several times to us that due to the amount of time this project has taken, prices have increased over that time, and we owe more.  This was not meant to be a multi year project with a flexible bottom line. It is soul crushing that in 14 months I'm still living in a construction site and cannot host any holiday events with loved ones.

      I want a plan of what will be done to complete this job.  I need deadlines to be set and followed whenever humanly possible.

      **** the plumber has not been paid for all the work and supplies that he has done and purchased for this project.  We found this out a couple months ago when he stopped showing up. Eventually he explained that ********** was behind on paying him and the plumbing supply house he gets all his materials from, has temporarily suspended his account until it is paid down. We are willing to give **** a check for any extras outside the contract. For example, we requested an upgrade on the new furnace, we requested additional water faucets outside and in ***********.  If we pay **** directly for these items, since he paid out of pocket, I am concerned that it will not be deducted from our balance with *********

      In summary, exterior can not be complete until extra material price is agreed upon, and we find a new *****. Finish work has to be done before paint and stain, no decision on sunroom ceiling. Master bath could have been completed if decision of tile was made. Still no decision on master carpet.

      This project has been going on for over a year.  It needs to be completed promptly, for the agreed upon price, with the quality workmanship we expected.  So much of the work has been completed on nights and weekends, this project has been a destructive force on family life.  Our ability to entertain family and friends has been eliminated.  We go from 8am sawz alls on the weekend, to no one is here for weeks.

      The businesss response is not satisfactory to me.  It is full of inaccuracies and entirely lacks a plan on how to finish the job.  It is a request for additional funds when we have not received the value of the money we have given.  According to my records (and checkbook), the amount that remains unpaid is $27,880 plus the money we will pay directly to the plumber.  We have given Mr ********************** $164,930 dollars so far. I am frustrated that he has mentioned several times to us that due to the amount of time this project has taken, prices have increased over that time, and we owe more.  This was not meant to be a multi year project with a flexible bottom line. It is soul crushing that in 14 months I'm still living in a construction site and cannot host any holiday events with loved ones.

      I want a plan of what will be done to complete this job.  I need deadlines to be set and followed whenever humanly possible.

      First off I would like to say that my response from the original complaint is very accurate
      By getting the architect involved in the decision making we finally have an answer on the sunroom ceiling and bathroom tile
      I am fully aware of the money I have received per contract,however I am also aware of the moneys I have paid out for materials and subcontractors.
      The increase in material did not happen during the duration of the project, it spiked in the early stage of the project, and is not what I calculated to create the proposal, and this is why I will be looking to get compensated
      I am not looking for the compensation now, just looking for the next payment from the contract to proceed with project

      ******: Of course you would say that your response was accurate, even if it were inaccurate, which it was.

      ******: The 'architect' is trying to move this disaster along, and would like us to avoid further conflict. To clarify, the material for the sunroom ceiling has always been pine boards.  You were unable to locate tongue and groove pine that was noted in the original drawings.  Seeing this as an obstacle to progress, ******** stepped in and located the boards. He gave you the information and I have not received a delivery date as of yet.  I was not responsible for this delay.   In addition, there are two structural support beams missing from the sunroom.  It is my understanding that they need to go in before the tongue and groove ceiling is installed.

      ******: **** stopped working on this project a months back because of the amount of money owed to him.  The plumbing supply house he works with froze his account because of the large amount owed.  At some point **** gave **** a partial payment of 5 grand so he could continue working.   He came a couple times after that and we haven't seen him since.  Xmas vacation he lost his brother-in-law and did not work here all week.  Monday Jan 9th **** texted to ask if anyone would be here Friday (today). I told him yes, and we haven't heard from him and he did not come today.

      ******:  My take away on this is you should have shared financial data about a year ago so that we could be braced for the tremendous change in cost. We are estimating that IF everything was done now, we would owe you 30,000.   I have mentioned not understanding why you would need more $$ now. Instead of going over receipts or bills from subcontractors etc you kept pushing it off.

      ******:  We had a meeting scheduled weeks ago.  *** asked for some financial data to explain the need for more money when there is so much left to be done.   **** responded stating that another payment would be required before he released that information.   I wasn't comfortable giving another ****** at this time when every area of the project is unfinished.

      So much has been taken from us over the length of this project.  We all have, and continue to, experience health issues related to the prolonged stress of this.  Instead of bickering and finger pointing, may I recommend drafting a plan on how to get this project completed.  Shouldn't that be the bottom line here?? Most homeowners I know would have resorted to other measures of getting this settled. My kindness has gotten me nowhere. Prove me wrong.
