      This marketing company promises they will get you clients and work for free until you recoup your cost with them. I paid them $15000 dollars for there fee however I am spending more than a thousand of dollars in month between ad spend and additional fees. Even though they aren't charging me anymore because I paid the entire $15000 I am still losing more than a thousand dollars a month since they are only bringing in 1-2 clients a month. They only tell you they will work until you recoup there fee but that is worthless when in the end I am at a net loss when they are making me pay thousands of dollars in ad spend. I tired to request a partial refund but they will not entertain the idea at all. The worst part of this company is when you don't communicate the with them the exact way they want you to, they scold you for it.

      I reached out to ****, in regards to launching a new marketing campaign. He sent me a $10,000 proposal that I was very skeptical about. In order to get me sign he offered me a money back guarantee if the program was unsuccessful. I have this on recording via a video that he sent me stating so. With this guarantee I moved forward. 6 months later I had nothing to show for it, after investing over $15k with **** and his recommended vendors. He fraudulently offered a money back guarantee, to earn my business. Now I'm out $15,000 with nothing to show for it.

      This office represents ******************* of Integrator And Co., located at ******************************************************************************** (Integrator).  We are in receipt of the Final notice to respond to BBB complaint letter dated June 16, 2022.  Let me start by apologizing for any delays in responding to your notice(s).  Unfortunately, it took quite some time for my client to gather all the communications concerning Mr. *************************** (which were numerous and involved waiting for a third-party communications channel to produce transcripts), and to create the timeline of events, as well as to have counsel review all the materials.  
       
      Having had the opportunity to review several Loom videos and communications between the parties, as well as the parties written agreements, I provide the following response on behalf of my client:

      It appears that ******************** is misrepresenting the parties agreement, either intentionally or due to a lack of understanding of its terms.  ******************** did not hire Integrator And Co. to simply launch a new marketing campaign as he suggests in his Complaint.  Rather, according to the agreement between the parties, ******************** hired Integrator for funnel building services which involves the designing, building and functionality testing of a back-end technology system that is able to convert leads once they have already been generated on a given platform, and for which the client must then pitch and close the sales deal (the Services).  The purpose of the funnel was to direct potential customers to book a consultation with the client, which would give the client the opportunity to pitch additional services or his program to the customer.  ***** services did not include the creation of any actual advertisements or other marketing materials, which was all outside the scope of the parties agreement.  In fact, ******************** hired a separate marketing professional to prepare ads for the purpose of generating leads. 
       
      In addition, ******************** agreed to the following written terms, amongst several others, with respect to the Services:

                Earnings Disclaimer. You acknowledge that we have not and do not make any representations as to the health physical, mental, emotional, spiritual or health benefits, future income, expenses, sales volume or potential profitability or loss of any kind that *** be derived as a result of your participation in this Services, and Materials. We cannot and do not guarantee that you will attain a particular result, positive or negative, financial or otherwise, through the use of our Services, and Materials and you accept and understand that results differ for each individual. We also expressly disclaim responsibility in any way for the choices, actions, results, use, misuse or nonuse of the information provided or obtained through any of our Services, and Materials. You agree that your results are strictly your own and we are not liable or responsible in any way for your results.

               Warranties Disclaimer. WE MAKE NO WARRANTIES AS TO OUR SERVICES AND MATERIALS. YOU AGREE THAT SERVICES, AND MATERIALS ARE PROVIDED AS IS AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF OUR SERVICESS MATERIALS OR ON THIRD-PARTY WEBSITES IN TERMS OF THEIR CORRECTNESS, ACCURACY, TIMELINESS, RELIABILITY OR OTHERWISE.

               In the event of a dispute between us, you agree to not engage in any conduct or communications, public or private, including on social media, designed to disparage us, our Company, or any of our Services. Where requested by law or arbitration, of course, you are not prohibited from sharing your thoughts and opinions as a part of the legal process.

      ******************** further agreed to the following Refund Policy:

                Your satisfaction with your Services is important to us. Yet, because of the extensive time, effort, preparation and care that goes into creating and/or providing our Services, and Materials, we have a very strict refund policy. Most of our content is digital and therefore, a lengthy refund policy could result in the theft of our materials.

                Unless otherwise provided by law, you acknowledge that we do not offer refunds for any portion of your payment for any of our 1:1 Services or If you are unhappy with your purchase, we welcome you to email us at ******************************** to provide feedback.

      At no point did Integrator offer a money-back guaranty for a marketing campaign as that is not what Integrator was hired to do.  However, Integrator did advise ******************** that if the funnel system failed to function as intended, or was somehow faulty, then Integrator would return ********************** money.  Because the funnel system works as intended and is fully functional, Integrator cannot be compelled to return any funds.  Further, Integrator cannot be compelled to return any funds paid by ******************** to any third-party vendor.

      Finally, with respect to the actual services performed, it is important to note that in fully satisfying its obligations under the agreement, Integrator spent over 100 hours on the design, build and technical functionality of the funnel system with the capabilities of processing leads, of which ******************** has benefited, and went above and beyond the scope of Services to additionally create important materials for inclusion in ********************** webinar program (which ******************** had failed to mention he did not already have).  For these Services, Integrator was paid only a nominal amount, far below what most any other funnel building agency charges.  
       
      Moreover, any failure of ******************** to benefit from any advertisement campaign was likely due to ********************** failure to follow through with his own advertising spend commitments and terminating the ad campaign and the services of his third-party marketing vendors before the campaign was able to generate sufficient leads.     
       
      Ultimately, a poor BBB review or **** on Integrators record is simply not warranted under these facts as there has been no fraud or intentional misrepresentation, nor any unfair trade practices, on the part of Integrator.
