      My husband and I paid this architect in full in July 2021 for our new build house plans that we assumed were correct. Initially, he had verbally promised we would get all the designs in a 3D model but strung us along promising we would get it by the final design. He stated that his systems were down and all he had to do was contact the company. He argued with my husband and I for final payment statng that he didn't have to provide us with a 3D model as it wasn't in the contact even though he promised over and over again he would. We have proof via email and text messages. Fast forward to March 2022, we are wrapping up with our builder and attempting to break ground but we can not finalize a contract as 3 lumbar yards have stated the house he designed is not buildable and has major flaws. He has trusses going through our roof, walls that do not allign, closets and staircases in locations that are not possible. Architect continuously ignores emails, texts and calls myself, my husband, builder and lumbar yard workers have attempted. After two weeks of pestering him, He finally responded on March 22 stating that he would correct all the issues and speak to whoever needed. He has since continued to ignore us all and failed to respond and correct any of the issues. He was paid in full for the amount of $3,300.00 in July for our new build house design. These issues are not visible to the eye on the plans so being that we thought it was correct we paid. We are now left with a non buildable plan and need to find another architect to correct and design our house. I am requesting a full refund. I have given *************************** ample notice and opportunity to correct the issues and have attempted to resolve this amicably. He has again reverted to ignoring all our contacts. Our pre approval expires in 2 weeks and we can not proceed because of him. He is well aware of the situation and time frame as we discussed all this on March 22, 2022 via phone. We are requesting a full refund.

      The following are some milestones for the record:

       

      Contact was executed on April 5, 2021
      The scope of work is clearly noted. One point I would like to reference is no renderings are included in the scope. ****************** continues to claim this was included. Executed contract attached.
      Final Construction plans were prepared and deliver on or a few days after July 25, 2021.
      An updated and revised set was delivered on or a few days after Aug 2, 2021 based on revisions the owner requested.
      On or about the first week of March 2021, 8 months after the delivery of the plans, the owner contacted me regarding questions from a builder who was pricing out the project, claiming things were wrong. The problem was partly the owner did not understand the plans after I walked thru the design more than 3 or 4 times. Some of the issues, were her choice to change some features and others were clarification to the builder. At this time I was in the hospital and due for surgery at any point. The owner continued to contact me to performed changes to the plan. At this point I could not accommodate her request
      On April 8, 2021 at 10:06 AM I made the decision to refund the DeSousas 100% of the contract amount with the stipulation that no negative comments would be directed to Traditional Design from now until perpetuity. As you will see she agreed to those terms as long as payment was made by 5pm. As you will see she acknowledges receipt and wishes me well.
      Immediately after receiving full payment back and her agreement of no negative, the owner contacted your agency and filed a complaint.
       

      I feel with this info, the complaint against Traditional Design should be denied and removed.
