      On April 5th, 2022, I contracted and left a deposit with Jessica ********* (dba Leena's Bartending and Catering) to provide bartending and waitstaff services for my housewarming event in Weston, MA on April 30th, 2022 for 5:20 pm to midnight. The day before the event, I confirmed with ********* that the bartender and waitstaff will be coming to the event. The day of the event, the service providers failed to show up. At 5:33pm, I emailed ********* without a response. At 5:38 pm, 5:58 pm, and 7:02 pm, I called and left voicemails for *********, without response. To a text message sent to ********* at 5:59 pm, I received a response at 7:06 pm stating "Hi so sorry just seeing this as I am doing an event of 3000 plus... let me check and see why the bartender is not there." I responded at 7:33 pm with "See what you can do" with no response or action that entire event evening. Our approximately 50 guests were without the services of a professional bartender nor waitstaff to serve our catered food. To mitigate damages, I attempted to find alternative professional bartending and waitstaff services, to no avail. Further, given Jessica *********'s latest response, there was continued reliance on the contract up to the end of the event.

      Business Response /* (1000, 5, 2022/05/24) */ My bartender and waitstaff were on the way to the event when they got in a car accident, suffered head Trama and needed stiches. I responded to the client and let them know I would contact the staff and see what was going on. Unfortunately, I was not able to send a replacement staff as I was working a large event myself. I sent the client the hospital document. I apologized several times to the client, refunded the deposit. The client has already filed a compliant with the BBB Complaint Case #: ****** Consumer: ************** Date Activity Description 05/12/2022 Case Closed as Beyond Purview 05/12/2022 Inform Business Beyond Scope 05/12/2022 Inform Consumer - Case Closed Out of Purview 05/12/2022 Case judged to be Out of BBB Purview 05/11/2022 Complaint Received by BBB The judged ruled it out. The client has been harrassing me non stop for $7000 in which we did not do since staff was not there. In addition they filed a compliant with peoples court in which it was ruled out. He also wrote reviews on google, yelp,thumbtack and continues to fine away to persue further in which it continues to be ruled out. Unfortunately I spoke with a lawyer and I am protected under the unforeseen circumstances act. This situation was completely out of my control and staff were injured. He continues to send me threatening messages. I am happy to send pictures of the car, face injuries and any other documentation you need. We are a 4.9 star rating company with hundreds of hires each year. I take pride in my company and would never intentionally jeopardize anyones event. Again i apologize for the inconvenience. There continues to be lies by Jessica ********* (dba Leena's Bartending and Catering). 1). A judge did not rule on this case, 2) she did NOT return my deposit, 3) the People's Court took on the case, but the Defendant/business REFUSED to show-up likely because of her GUILT, 4) no documentation was ever provided to me, 5) false and outrageous accusations of harassing/threats for which I will be filing a lawsuit for defamation/slander. Simply put, this is unprofessional and underhanded business which lies to customers and doesn't deliver on their service contract. I was never required to go to peoples court, its a TV show not a legal court and I was not sent any physical demand letter requiring my appearance, Therefore there was no refusal to show up. I have screen shot of the deposit being sent to cash app so check your cash app. In addition I have all the document I need for my staff, pictures of the injuries and pictures of the vehicle not to mention not once did you even ask if they were okay you just continue to demand money. I am not paying anyone 7000. I refunded the deposit even tho my contract states all deposits are non refundable. I have apologized and I will not continue to be harassed any longer. The only thing I am guilty of is my staff not showing up, however, emergency situations happen and unpredictable things occur. Its life. Unfortunately it was completely out of my control! Since it doesnt allow up to upload all my documentation and it can be requested at any time. I did not lie about anything staff was injured and therefore did not attend your event. A termination clause should not be confused with the terms of cancellation. Termination pertains to cancellation due to unforeseeable events that are beyond control of contractor (Leena's Bartending and Catering.) This may include weather-related incidents, car accident, employee injury, emergency death or hospitalization of immediate family (child, spouse, mother/father or sibling) a government shutdown, a pandemic, or another disaster. Leena's Bartending and Catering will not be responsible for any thing owed to client. Under Hourly-Rate Contracts, Leena's Bartending and Catering may terminate the Service Contract at any time for any or no reason. However, the Client remains obligated to pay for any time Leena's Bartending worked prior to termination. The Client may terminate under cancellation policy but may not recover any payments already made. Consumer Response /* (4200, 13, 2022/05/25) */ (The consumer indicated he/she DID NOT accept the response from the business.) I am very grateful that the defendant here, Jessica ********* dba Leena's Bartending and Catering, has finally supplied the medical documentation that she used as the excuse for no-show after the material breach of contract and it proves my case. Damningly for *********, it verifies that she is lying as the urgent care doctor excuse slip states that the medical appointment for one of her workers was on the day of our event but at 1:30pm; her business workers were contractually supposed to come to my event at 5:20pm. The Wilbraham urgent care is exactly a 75 minute drive to the event location. This PROVES the sick worker was NOT on her way to my event and DID NOT sustain an injury leading to the business's breach of contract. Additionally, my contract with the defendant commissioned for two personnel - a bartender and a waitstaff. She tellingly did NOT supply any documentation regarding the whereabouts the second worker. Further, when the defendant breached the contract and I had to reach out multiple times, she didn't call or email back, finally at 7p returned a text that she didn't know where the crew was - by this documentation, she did at 1:30pm, or should have. Frankly, even his ********* didn't lie, she is operating a business which failed their client. Nonetheless, I will use this new evidence to seek full damages to be returned. Further, she has not returned my deposit. Bottom line, we have a contract, ********* violated it as a contracted service provider and business, and there are real-world consequences. Thus far, she has blamed everyone under the sun but herself, has lied on repeated occasions, and has not taken full responsibilities for 1) not providing contracted services, 2) leaving us high and dry waiting for a bartender, waitstaff, and portable bar the midst of our event, 3) prioritized a larger event client over ours, and 4) running an unprofessional business. I should note, she is now sharing medical documents and identifiable images of her worker containing Protected Health Information that violates HIPPA. Her worker may have a claim against her now too. Her damages are compounding.
