      11/3/22 signed construction agreement with start date of 3/6/23. Paid 25% deposit of $6250 via check #***. Check cashed 11/14/22. Decision to use YD Construction was based on info provided by ***** at initial meeting at my home. Key info was they are licensed and insured, they do not use subcontractors, they pull all permits, they try to maintain on time scheduling, but some delays are unavoidable. If a delay were to happen, he explained they would be in communication to keep us informed about what is going on and work towards getting the project complete. ***** also mentioned their many positive online reviews and that is proof they keep their customers happy. I now question the validity of these reviews. 1/31/23 ******* comes to take final measurements, while at my home raises questions about my desire to do this project with a permit. This was a red flag. 2/22/23 I ask about the status of the permit as the project start date is coming up. I'm told they applied "a little while ago". The start date passes with no communication from them. I email 3/13/23 asking again about the permit, they apologize for the delay and say it would be available that week. Week passes, 3/17/23 I call my ******************************** to see if a permit has been issued and I am told they applied for the Permit on 3/5/23 and it was issued 3/13/23. ***** lied when he told me they applied in Feb. Same day 3/17/23 with no communication from them a dumpster shows up at my home which I had to turn away since I wasn't comfortable working with an untrustworthy contractor. ******* and ***** called to see what the issue was, I explained the lying about the permit and would not be continuing with them. Sent a letter to rescind the contract and requested full deposit back. ******** response was he would not be returning my deposit but the reasons listed in his response are lies. I want my full deposit back from this deceitful business.

      We have signed a contracts back in November stating that work will start on OR about 3/6/2023. In February we applied for permit . There was an issue with town hall which was not out fault (they couldnt find the owner in their files ). I had to go back few times with documents when they finally found the owner in their system and took application. All of that was done in February. I have no control on when Town Hall reviews application. We were
      In contact with ***** and she was aware that work will start with delay which she agreed on . Permit was finally approved and we notified her on exact start day. During all that time I worked on arranging plumber, electrician and a dumpster for the start date and paid them a deposit out of deposit that Chuna provided . ( no one will reserve time without a deposit). 
      On the start date the dumpster arrived at construction site and Chuna did not let them to settle the dumpster. She ordered them
      To leave . I got a call from the company stating that customer refused the service. I contacted Chuna and was notified that she will
      Not speak with me
      And will send a letter. After that I received very nasty letter from her stating that she will
      Not work with us and demands her deposit back. She was accusing us of lying and bad communication how we we have texted back of forth about the progress and start date . It takes time for Town Hall to issues permit and we applied ahead. It doesnt alway mean that application will be reviewed on the day received. Whoever talked to her from Town Hall told her the date application was actually reviews however did not tell her when it was received. 
      Deposit that was provided by Chuna went on securing electrician,
      Plumber, dumpster, Purchasing the tub and materials required for her project. I am
      Also at loss as amount spend was more than deposit paid by Chuna.
      I also lost income As I did not brake other projects for this time period as time was secured back in November per contract. I have send ***** a letter explaining all of that. We were ready to start on her project and everything was arranged. Again she did not let us property and did not notified of her decision before.
      I offers to discuss the matter further but instead for this complaint. 
      As stated above ***** did not let work to start after new start date(10 days from original start date) was set and agreed on by both parties.
      Now she is trying to defame us by filing a complaint.

      The delay isnt my primary issue. The issue is deceptive business practice and lying. The explanation about the permit delay again is a lie. The town has an online permitting process which is very straightforward and transparent. My issue with the lying is not being addressed or acknowledged. I'm still being lied to. All of the documents I provided with my initial complaint basically contradict what I'm being told as for reasons why from November to March was not adequate time to secure a permit. I have attached a more detailed response to this form which addresses some of the statements in the contractors response.

      We are bot confused about what we lied about. There was nowhere in contract stayed at which point of time we had to apply for a permit. The time we applied was sufficient to our knowledge. We are in business for a long time and never  had such an issues with a client. Unfortunately delay happened with paper work however permit was ready March 5th. Never in my our experience customer investigated what date application was reviewed and received . How does that matter if we were ready to start the work. In text messages i did let you know that there is a delay with permit and you agreed. How it works is that town hall

      contacts us about status of permit and its never on the day it is issued. I understand that people who is not involved with permits on daily basis may think it is easy and everything is sone promptly.  

      There was never am attempt to lie and i dont understand why would i if work was scheduled. 
      i can apologize on behave of Town Hall for delay in letting us know of the status of a permit.

      Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. Please add your rejection comments below; if you do not provide any details, your complaint will be closed as Answered. 

      Again, this issue is not about the time delay, the issue is erosion of trust. The permit is just the most blatant example. Applying for a permit one day before an anticipated start date is not sufficient. The deposit check was cashed 11/14,10 days after the agreement was signed and one would think you would begin the permitting sometime soon after and much before 3/5. Maybe with other customers,they just took your word and they did not feel the need to do the level of due diligence I did. Again, we never communicated via text. The emails I submitted with this complaint show the communication about the delay. The emails from 3/13 say: From me, Hi, I wanted to check in as I haven't heard anything, we are a week past March 6th and I am getting a little concerned. I understand delays happen but a delay with permitting seems worrisome. My main concern is that although the contract was signed in November, it seems a permit was just applied for recently and the application is currently waiting on missing documentation. Any updates would be appreciated. Your response, Hi Chuna I apologize for the delay, the permit will be available this week and we will start March 21 Tuesday. Thank you. My response, Thank you for the update. Could you let me know when you get it?. Your response, Will do!. That was not an agreement to start work at the delayed date (we would have needed an amended contract for that). I was asking to be informed when you had the permit. I waited to hear from you until the end of that week 3/17 and you never contacted me. Now, thinking this permit was pending since Feb (thats what ***** told me), I called the Town Building & ***************** to see what was going on. Something seemed off as I know a permit would not be delayed from Feb to March unless something was significantly wrong. This is when I learn it was only submitted on 3/5, attachments of insurance and drawing submitted 3/12, payment made 3/13 and permit approved 3/13. Those delays have nothing to do with my town. Of course this matters even though you were ready to do the project 3/21. It matters greatly because I dont want a contractor that I do not trust doing a large renovation project in my home. I dont want an issue to come up during the project and have it hidden from me or be lied to about it. At that point I wouldnt know and would likely find out from more delays, work falling apart later down the road or injuries on the job. Additionally, even the applicants name on the permit was not yours or YD construction, it is *************************** DBA Roma Construction. Same with the insurance. There are just way to many red flags that I want nothing to do with. I want my deposit back so I can put this behind me and move on. $6K is a lot of money and it seems you are trying to take advantage of this situation.
