      I am filing this complaint to address an unresolved issue re: a const project undertaken by Bayside Build and Remodel, ***** a 400 sqft in-law unit built for my 80-year-old mother.The project commenced in Apr23 and concluded in Sep23, with two outstanding issues remaining. Firstly, there was an issue with the grading in the backyard, resulting in substantial flooding in the basement of the in-law unit. We took it upon ourselves to rectify this problem by installing a drywell, which has effectively resolved the flooding issue.However, the primary concern remains with the Pioneer Mini Split unit installed by Bayside, which has never functioned since its installation, consistently displaying an E9 error code. Despite numerous attempts to resolve this matter through correspondence with Bayside, the issue persisted without resolution.As winter approached, and with no progress from Bayside, in Nov23 I engaged an independent licensed HVAC installer to diagnose the problem. Regrettably, diagnostic testing concluded that the system was irreparably damaged, necessitating a complete replacement at a cost of $7,250. I promptly notified Bayside of this finding, prompting them to order a replacement unit. However, only the outside unit was installed, with no attention given to the inside unit or the lines connecting the two. Consequently, the E9 error code persists, and my mother has had to rely on a portable electric heatera significant fire hazardfor warmth throughout the winter months.Due to the demands of my profession as a tax accountant, my ability to pursue resolution of this matter was limited during the busy tax season. Nonetheless, sporadic communication with Bayside yielded no progress in rectifying the issue. Now, after six months of patience and persistence, I find myself in desperate need of assistance and resolution. Given the unacceptable living conditions endured by my elderly mother, I trust that immediate action to address this matter satisfactorily.

      I have heard from ********************* at Bayside Build and Remodel, **** on April 24th stating that he will be replacing the heating/cooling system at no charge to me.  This was in a form of a voicemail message to me.  I have transcribed the message and attached it here.  He is working on getting this done for me however I do not want to close this complaint until the job is actually done.  He did have a professional HVAC company come out on May 1st like he said in his message but the quote they gave him was too expensive so he needs to reach out to other companies.  Thank you.

      Voicemail received on April 24, 2024 at 4:43 PM:  Hi ****** it is ****** Bayside Build and Remodel.  Listen um I have a rescheduling thing from when I initially scheduled, possibly scheduled, I have uh between the hours of 8am and noon time on May 1st for a uh evaluation of a brand new system instead of using the pioneer system so we are gonna take care of this for you so dont worry about it.  The pioneer system went through their warranty information and how I was treated through ********** and Pioneer, we are going to remove the pioneer system in its entirety and have a brand new system installed so if you could bear with us not too worry between the hours of 8 am and 12 noon it will be evaluated  new system that would be a better system so if you could call me back, text me or email me and let me know I dont know of an exact time yet but it will be between the hours of 8 am and noon next Wednesday May 1st.   I looked at the stuff pioneer sent me through the ********** warranty department and they sent me the wrong stuff so I dont want to waste any more of your time and my time on this so we are going to remove that system and put in a brand new system at no charge not too worry um so dont sweat it. We are going to get everything corrected for you. I apologize for the delay but I looked at the product they sent me compared to the product I have back at the Warehouse for the replacement wall unit as well that they sent and they sent the wrong one.  Um so that is going to be sent back and I am going to have a professional HVAC company come in and do a brand new system.  Ok so not to worry we will get this all rectified and I appreciate your business really and I am trying my best here with due diligence here to try and get everything corrected for you.

      I am in receipt of your complaint from a ***************************** of 23 Head of the ******. *********. We were contracted for a small ADU addition at the residence located at **********************************. ******. The project was completed just on or around Labor Day 2023. We were not contracted for any type of French Drain. The disturbed areas around the new foundation footprint only included grading of such to swail the water runoff down and around the new addition dwelling within 12' of the new foundation. We had made extensive landscape removal and improvements for her and sister that I know personally for free. We had mentioned to the homeowner that a French drain to a small drywell would be required to keep any gutter downspout stormwater runoff away from the foundation that was new and the pre-existing foundation. The pre-existing foundation is made up of hollow 6"x8"x16" concrete block that is in need of complete repairs and water proofing and filling the hollow cores with concrete. The client ***************************** declined to hire us for those repairs. The homeowner also declined to hire us for the French drain that was required for stormwater drainage from the gutter downspouts. Her husband **** who is a landscape contractor had installed the French drain but had installed the 4" corrugated pipe to the drywell uphill rather than a 2% grade downhill. The basement in the new addition does not have any water issues. The new foundation was sealed with waterproof sealant and signed off by the town of ****** Building ***** It was also sealed to the existing foundation with waterproof sealant and hydraulic cement. I met with the property owner on Wednesday May 1, ************************************************************* the new addition crawl space or the new lower crawl space basement area. As far as the mini split issue is concerned the mini split ac and heater was working fine when we originally installed the unit. ************************ Mom has placed a small electric space heater in the Adu unit because she likes her room temperature very hot. The ac unit on the mini split unit works fine. The heat pump on the mini split unit does not work nor active the digital thermostat for heat pump activation over temperatures of 88 degrees. At most times when i checked the temperature inside of the Adu unit it read over 88 degrees and at times 96 degrees I have numerous text messages stating this from *****************************.. This has caused the heat pump on the mini split unit to not work.. I had ordered a new Pioneer mini split unit and it was installed late last Fall 2023 the same issue had continued to occur. So I ordered a new digital thermostat through Pioneer and ********** where the product was originally purchased. I have kept in contact with ***************************** on numerous occasions and have records to prove such events have transpired and my remedies have been ongoing to correct this issue. Since we have discovered that the units in which ***************************** had asked us to purchase through ********** have proven to be either defective or not a good product for her household we had a firm come out to make an Evalution of the existing unit and to price a new mini split unit for her.. Her original allowance for the pioneer mini split unit was $1100 and the Labor Allowance was $1500. This was for a pioneer mini split unit as she had stated she wanted the least expensive way out to heat the new Adu unit. My recommendation was to branch off the existing hot water heating system in the home which is more efficient and the best way to heat the addition. She also declined on this suggestion so we went with the Pioneer mini split option. We have to date for upgraded mini split quotes, one at $7500 from her outside company and one at $9000 from our professional subcontract company that works with us on numerous projects. I also mentioned to her we can get 2 other quotes. She has a credit of $2600.00 from us for an upgraded unit or we can do a complete replacement of the pioneer mini split unit at no charge. she stated she wanted an upgraded unit at this time. I have put a call out to 2 other subcontract companies we use for mini split systems one stated the job is too far and outside their service area and the other one I am awaiting a response back as to a day and time for field call inspection and price I have always 100% kept in contact with ***************************** regarding this matter and am trying to make the best possible professional resolution to this matter.
