Date of Transaction :5/18/2021 Amount Paid: $24,250 cash *********** agreed to rip up existing asphalt ,repitch the driveway to get the water away from the house and garage and then resurface the driveway .5/13/21- Driveway was paved. Before ******** left, I discussed that there was no lip at garage door and not enough pitch. He responded that there was plenty of pitch I contacted *************************** several times . On 5/25/21@ 5:51pm I sent a photo of the driveway and how unhappy I was via text message.5/25/21@6:06 pm he responded via text that he would cut it all out and would repitch the driveway , repave the section of the driveway and infrared the seems. 6/18/21@2;49pm *************************** and ********* arrived and only infrared the section at the garage door and still was not correct. ***** said the water wasn't flowing away from the house / garage due to oil coming out of the asphalt. The dispute is that the pitch of the driveway is still not correct, to remove the water away from the garage and house. The water has flowed back into the garage this past winter. I have contacted *************************** several times until present. He has stated that he will correct it and has not done done so as of now.My concern is that there *** one year warranty and he is not responding now. I have other photos and text messages if needed.Business response

i had already submitted a reply when i ***** received complaint. As i stated not once have we not been in contact with customer. His complaint is that water is going into his garage and the repair was already made last summer. we neber recieved a single call or message from ***** until feburary of 2022 during an ice storm. no water issues have been found by us or even during heavy rain. we have stayed in contact with Mr ******* thru the entire process of complaint and have already agrred on a repair again. date unknow due to scheduling another job close to his repair for proper materials handling and extreme cost of fuel.Customer response

I have texted ************** on a number of occassions, as that was how we communicated most of the time. Unfortunately there has been some miscommunication along the way.
On or about 6/17/21, ************** did return to try to correct the problem, he used infrared only to repitch the driveway, but unfortunately it did not correct the problem.
Originally, he said he would cut it out and repitch the driveway and repave the entire section and infrared the seams to correct the problem after the work was done.
After ***** K contacted me on 5/3/22, he said , he would be out in approximately 2 weeks when he was in the area doing another job..
I look forward to having this work corrected with repitching it to get the water away from the garage/ house.
I would like to have a time frame to expect this work to be done
I look forward to resolving this completely.Business response

The customers claim water is running into garage is just not true. We made an original repair to driveway where he asked us to leave finish asphalt lowere than garage floor and was warned this would cause puddling. after puddling did happen we then came and made a repair using infrared heating machine to blend in asphalt to area for a flush finish to garage floor. Customer agreed after running multiple test with water hose across enitre front of garage the issue was taken care of. We then received a compalint in feburary of 2022 with photos showing water puddling in his garage. clearly seeing he had not plowed his driveway and a large amount of rain fell after it had snowed it was just a matter of the snow dams and slush needed to be cleaned up. Today june 9 ********************************* a heavy rain i saw no evidence that water ran into his garage from driveway. water running off a small over hang splashed down on to his garage doors and ran dwon door in to his garage. i took video and photos that show no wate runs into garage from driveway at all. i informed customer by installing a gutter along overhang that would stop splash back from hitting doors and going into his garage. i also found that the customers garage floor has low areas and does not have a good pitch to allow water to flow out but in instead. Our workmanship and grade has been checked with a smart level that measures pitch and lazer transit that finds 1.5" pitch in in a 10 fot area this is more than enough to allow water to flow. I had offered to pay to install gutter free of cost to customer and had already made a succesfull repair. He has not reached out once after repair and afte arecord rain fall last summer with a complaint. his only time was in winter during a storm that switched from snow to rain and casued slush and ice to dam up water flow. I find no evidence or reasons to make any further attempts to satifiy this customer.Customer response

I dont know how we got from ************** saying he was going to rip it up and redo it, to infrared 1 area, AND now our garage floor has low areas and we need a gutter.
I will address the following claims he stated in his response 6/9/2022
There was only one so called repair to one area with infrared.
After the infrared in one area, I did run water on it. At the time I questioned the movement of water. ************** said it was because oil was coming out of the asphalt. NOTE: THEY TOOK A WHEEL BARREL FULL OF PAVEMENT OUT OF THAT AREA
The fact he said, that the driveway was not plowed in the winter is not true. It is plowed every storm and hand shoveled in front of garage doors. So again ************** coming to the conclusion, that driveway is not plowed and that it was snow dams and slush is not true.
The over hang is there to keep water from hitting the garage doors. This is a new problem since the new paving job.
The garage floor has no low areas as after reading his response, I had someone check it with a level. NOTE: THE ASPHALT IS HIGHER THAN THE GARAGE FLOOR IN AREAS.
***** Ks first solution, of ripping up and repitching and putting a lip at garage like what was agreed would have eliminated these problems.
On the day ************** was paid cash, in full, I questioned the lip at the doors and the pitch of the driveway.
Asphalt is up the trim on side of door and above threshold of side door, so we are unable to repair at this time
FYI- At the start of the job, the existing asphalt and dirt was removed to give it pitch and then sub base was brought in when he wasnt ready yet and was put in front of the garage and was spread. That changed the grade.
I have other issues with the work that has been done by BK and Sons ****, but my only issue is the pitching the water away from the house that was the whole point of the job and was not accomplished

I am no longer interested in the back and forth with this customer. My statements are true and video and photo evidence will prove this. 6/10/21 BK Paving installed a new driveway, removed an old basketball hoop and installed a new basketball hoop. The cement footing for the hoop was installed on 6/10. It was NOT done to the manufacturer's specifications. I told Brian K******* (owner) that the specs said a 4' depth hole. He said he had installed them before, the depth he had was fine. He also DID NOT use the rebar that was included with the anchor kit that came with the hoop. 2/18/22 I noticed the hoop was leaning. I contacted BK Paving. Spoke with Tom. Told him the whole hoop, including the cement foundation was leaning. He said he would let Brian know. 2/23/22 called BK again. Spoke with Tom. Said Brian had not made contact. Tom asked me to send photos and he would send them to Brian. Tom said Brian was away until Sunday, 2/27/22. I texted Tom 2 photos of the hoop. 3/4/22. I texted Tom to let him know I had not heard from Brian and the hoop was getting worse, that I was afraid it was going to fall. 3/6/22 Still no contact from Brian, so I texted BK a resolution. BK to take down hoop before it falls and refund $500 paid for install, plus $150 for new anchor kit. Roughly 30 minutes later, Brian himself texted that it was Sunday, he would be in touch on Monday. Monday came and went, no contact. 3/8/22 I texted Tom told him still no contact from Brian. Told him the replacement cost of the hoop was $1200 should it fall, plus any damage to property. Asked if there was another person to deal with who would be more responsive. Tom replied that Brian would be in touch that day after 12. He did not make contact. No one from BK Paving has contacted me as of 3/8. The hoop weighs over 800 lbs. I fear it will fall as the ground thaws, winds and rain in the forecast. I have contacted a vendor who will take down what Brian did and reinstall the hoop properly, at an additional cost.Business response
