Contract stated 1/3 down and remainder at completion. Gave contractor $8000.00 check based on $24000.00 total value of attached contract. Contractor, Mountain View Remodeling, purchased and delivered materials and sent $6100.00 invoice for payment and demanded payment for it prior to starting work. Contractor returned $1781.00 but kept $150.00 for trash removal in trailer that was parked on a public street stating $150.00 was for trailer trash removal. The contractor was advised to place trailer in driveway but elected to place it where his workers could access it better. Parking on a public street was MVRs decision which I do not feel I should be held responsible for. Would like the$150.00 returned.

Please see attached photos where their company truck was parked and blocked our trailer. While the trailer was at the home, there was toilets and trash dumped into it. This is also consideration that not only did we have to dump the trash, but we also delivered the materials to the homeowner that was approximately 45 minutes away each way. We didn’t charge the homeowner for a trip charge nor a delivery one. Just to take the trailer to the dump and dump the debris.

      Complaint: ********

I am rejecting this response because: Mountain View Remodeling's trailer was parked on a public street.  It was not parked on my private property. Nor was it parked on an access way to my property.  It was parked on Doe Meadow Court.  Mountain View Remodeling was advised to park it in my driveway which is in the front of my house but made the decision to park it on Doe Meadow Ct which is  a side public street for the convenience of their workers  to place removed materials from my deck in it because my deck is in the rear of my house and the trailer would be closer to my deck allowing Mountain View Remodeling workers closer access to the trailer  which they parked on Doe Meadow Court. Which anyone with a truck and a hitch could of pulled up to the trailer and pulled away with the new material that was stored in it.  One of my deck boards was damaged as a result of this decision as well.  It would make no sense at all for me to throw a toilet into a trailer where new material is stored for the resurfacing of my deck.  It makes no sense.  My deck materiel was damaged as well. as a result of this decision.  Additionally, I have no authority over equipment parked on a public street  Doe Meadow Court. Mountain View Remodeling took the risk to make it easier for its employees and is now trying to shift the consequences of accepting that risk on to me, the consumer and former customer.  As for charging me for delivering materials, that was not part of the documented contract.

      Sincerely,

      Maurice ********

Date of transaction: March 2021 Amount of Money paid to business: $30,000 estimated Business committed to provide: Installation of siding and windows Nature of Dispute: The company has abandoned the job (almost a year) and no permits were filed through "Howard County Inspection License and Permit" for the scope of work that needs to be completed. Windows were installed wrong, no screens provided, and no lock provided for the window(s). The financial company has made every effort over the past several months to try and mediate and rectify the situation, but since the owner has not and will not reach out to us as the customers nor the finance company....The finance company has cut off all business relations with Mountain View Remodeling. Now a permit has to be put in to have all the siding ripped off which will now leave the house exposed to more possible damage. Account Number: ********

      Business response

      06/14/2022

Business Response /* (1000, 11, 2022/06/14) */ The client is still active in our database to complete their windows. The siding has been completed and installed several months ago. The client had ordered a permit in their own name after signing off on the job on 2 completion certificates. Consumer Response /* (3000, 13, 2022/06/15) */ (The consumer indicated he/she DID NOT accept the response from the business.) The siding is still not complete. The J Channels for the siding still need to be replaced where the damage was done when the windows were installed...along with the trimming of the siding. The 6 vent block has not been installed. And the water paper around the house was never fully replaced and there is no flashing around the windows. We never took out a permit. That is something MVR was suppose to do when they replaced 22 pieces of plywood. Per Howard county permit Office that is suppose to be pulled by MVR. In regards to the completion certificate we (the customers) were informed by the onsite sales rep it needed to be signed for financial reasons in order to finish the work. But MVR was suppose to come back and complete the work and they never did. Business Response /* (1000, 20, 2022/06/29) */ The replacement window was ordered for the bedroom. The j-channel which will be repaired when window install is complete. Consumer Response /* (3000, 22, 2022/06/29) */ (The consumer indicated he/she DID NOT accept the response from the business.) Here is the message that was sent to the company yesterday (6/29/2022) upon MVR's coordinator contacting us (6/29/2022 at 11:53am. "Good afternoon *****, thank you for the update. All future communication and correspondence(s) needs to go through the "Department of Labor Division Of Occupational And Professional Licensing Home Improvement Commission Office (DLOPLMHIC-Labor)" at this point. As the inspector from that office will coordinate everything. Part of this decision was made since we have not had any communication in over a year since the job started to get things resolved with the windows and the 16 missing screens and to include the siding as well (which is still not completed). Please note: The DLOPLMHIC-Labor office should have already been in touch with the owner and your management team in regards to this matter for the Windows and Siding." All communication and correspondence has to go through the Commission Office. As an inspector/investigator has been assigned. Business Response /* (4000, 26, 2022/07/07) */ The one window we are waiting on is in production as and should be done in 2-4 weeks. From that time, we can install. We have emailed the client weekly for an answer and have yet to receive one. We will not be giving out free windows but have no problem making the windows perfect as the others are. Consumer Response /* (4200, 28, 2022/07/07) */ (The consumer indicated he/she DID NOT accept the response from the business.) There are two windows that need to be replaced. The window in the family room was installed backwards with no lock and the 2nd window in the Master Bedroom was measured wrong leaving a big gap that is noticeable. We are still missing 16 screens to all the windows as well. Also the siding is still not completed. MVR was notified about this last year once the installers left the work site. Emails and pictures have been sent to MVR back when the concern was brought up last year. The customers (myself and my husband) are waiting to hear back from the Department of Labor Division Of Occupational And Professional Licensing Home Improvement Commission Office (DLOPLMHIC-Labor) with a way moving forward to resolve this issue. Business Response /* (4000, 30, 2022/07/09) */ There was never a mention of a window issue in the bedroom until now. I've already stated I ordered the window for the one that did not fit properly. It was not installed backwards, that's not physically possible. In terms of the screens we can have them sent out as well. We keep saying the same things over and over, this claim will never move forward until you except a response. For the siding, it's been done, you have signed to completion certificates on it, and the only issue with that currently is the J channel that needs to be finished with the windows. There's been nothing but false facts Made about this job and would like to resolve this. Business Response /* (4000, 36, 2022/07/15) */ We are waiting for the new family room window, we will reinstall the bedroom window, we have all of the screens, and when the family room window is in, we will be able to match the j channel to the window. Thus completing the job. Consumer Response /* (4200, 39, 2022/07/19) */ (The consumer indicated he/she DID NOT accept the response from the business.) Please see attached the updated pictures. -All JChannels need to be replaced around all 16 windows. Not just the two windows that are being replaced. -Please note you would have to get the correct measurements for the bedroom window before you can replace it. -The issues with the siding still has not been addressed from the previous response. - There is still no permit in place for the 22 sheets of plywood they replaced. - All other line items that as documented on July 13, 2022 has not been addressed either. So the siding is not completed. Note: I will submit more pictures. All pictures are recent as of Monday (7/18/2022).
