We signed a contract with Mr. P. to do various home improvement jobs on our home. A copy of the contract is attached. The total costs were to be $2,225. We paid the down payment of $1125 on 10/31/21. My husband paid the balance when Mr. P. left on 11/11/21 of $1250 - an overpayment of $150. My husband did not have a copy of the contract when he paid the balance, as Mr. P. had the contract in his possession. Mr. P. cashed the check for $1250 on 11/12/21 - the same day my husband tried to reach Mr. P. by phone to inform him of the overpayment. Mr. P. did not respond to this phone call or any subsequent attempts to contact him by phone, so ***** began contacting Mr. P. on 11/27/21 by email to create a written record (email pictures attached). Mr. P. acknowledged the overpayment and said he would send a check in the amount of $150. ***** has contacted Mr. P. a total of 5 times regarding returning the overpayment. Mr. P. only responded once on 12/1/21 asking for our address and saying he would mail the check. (The two attempts to contact Mr.P. after he said he would mail the check on 12/1/21 went unanswered.) Mr. P. and his crew did a nice job but we would like our $150 back. We feel we have given Mr. P. ample time to do the right thing and return our money.Business response
