I hired Barnes Paving to Re Asphalt my driveway. I was informed over the phone via the owner, and in the contract I signed that there would need to be dirt removed, and Compacting would need to be done. Barnes paving neglected to bnow says that the plumber that did the job before him is responsible for the work they laid out in the contract.

Business Response /* (1000, 5, 2022/03/17) */ Good Afternoon, I am in receipt of complaint number ******** and offer the following response: In November of 2021 we performed a small patch job for **********, the complainant for the above referenced complaint. In February of 2022 he contacted us and let us know that the area that was repaired was failing and sent some photos along. I spoke to **** and discovered that the area we installed new asphalt on was the result of a sewer line repair he had performed in 2021. I advised Mr. ***** that he should contact his utility contractor as the photos and description he gave me eluded to a utility failure. The following week he contacted me again and told me he could not get ahold of his utility contractor but that he wanted me to fix the issue for him. I let him know that I could not repair the plumbers potential issues without him incurring an additional cost. At that point he was verbally abusive and told me this was our problem to address. After I calmed him down he agreed to give me his plumbers telephone number so I could try to speak to him. His plumbers name is ********** (************). I called Mr. ***** and he informed me that the sewer line he installed was 10-12 feet below the surface grade that I paved and he confirmed that his crew did not compact the trench they dug. He told me he would call Mr. ***** and schedule to go to the job and investigate with me. I relayed this info to Mr. ***** through text message. A few days later Mr. ***** called me again to tell me the plumber wouldn't come to his residence unless Mr. ***** paid him to review the work. Mr. ***** again decided that this should be an issue for Barnes Paving to deal with and he told us to come fix the work. I reminded him again that there would be a cost as the failing piece of the work was not in our scope, and since the plumber wouldn't own responsibility for his failure that I would have to charge a cost to repair the plumbers work. He was verbally abusive again and told me he would see me in court before hanging up the phone. I have reached out to Mr. ***** several times in order to try to assist him as best I can, unfortunately he has not been willing to listen to reason in these conversations. I have attached a few of our correspondences here for the record. Bob B*** Consumer Response /* (3000, 7, 2022/03/18) */ (The consumer indicated he/she DID NOT accept the response from the business.) I'm not sure why my plumber should be responsible for the contract that was written by Barnes paving. The contract that clearly states the scope of the work. Which includes removing old dirt. Which includes grading and compacting. I just don't know what my plumber has to do with Barnes paving not doing the prep work required. Consumer Response /* (2001, 18, 2022/03/25) */ I was offered and I accepted a full refund from Barnes Paving.
