      I used Marty B******* from Bay State Custom Homes, LLC for a home remodel and addition. The job was completed April of 2021. In our contract with him it states "Our labor is warranted for 2 years". Now after a bit over 1 year we have cracks in the drywall, cracks in the moldings is many places and grout coming out of one of the master bathroom floor. I reached out to him repeatedly to send someone to make these repairs as we are well within the 2 year warranty period. After several requests he tells me that the warranty only covers structural issues and not these types of repairs! About 6 months after we moved in the grout was coming out and he sent someone to repair it. He did not do a good job so its happening again. I have had nothing but frustration with Marty. He has breached many other parts of our agreement. I heard as well from several of his sub-contractors that he constantly has disagreements with his clients at the end of a job. He is just not an honest fellow unfortunately. I would like for him to uphold the terms of our contract!

      Bluntly, *** ********* is not being honest.  The job was finaled on February 16, 2021.  They have had sole possession of the house for almost a year and a half (17 months).  Settlement cracks are a normal part of house aging as it goes through various temperature and humidity cycles.  ** ******* complained about settlement cracks before and I sent out someone to correct them.  He was not satisfied with *********************** work so I sent out a second crew who satisfied ** *******.  Warranty companies, i.e. ***, give the client 7 days from final to identify cracks etc and does even mention them in their warranty after 1 year.  The same for grout cracks.  I told ** ******* the 2 year warranty is not for cosmetic issues or settlement cracks or paint touch up (which we did for him after he was in the house for almost a year)but is for structural issues.

      I did not breach our agreement.  Bluntly, he is one of those clients that beliefs the contractor should do everything he wants for as long as he wants.  During construction, we bent over backwards doing extras and not charging .  His standard line was  "it will only take 5 minutes more" when in reality he knowingly underestimated the time and materials required for his beyond numerous requests.

      Since he stated he heard from several on my subs that I have constant disagreements with clients at end of a job.  Then I challenge him to provide the names of the subs that told him this information. Also, as you know this the first complaint every sent to BBB on Bay State.  ********************* apparently assumes everyone is like him and bad mouths their boss or in his case his bosses wife behind their backs

      For him to call me "not an honest fellow" will be checked to determine if it is libel.

      I am rejecting this response because: The contractor is lying about the facts. I have texts to him on September 5th 2021 telling him that the grout came out from the day before when the guy supposedly fixed the grout. He never responded to that. I attached a picture of the texts. Of course the grout got worse now. It can't be from settling if it's happening in only one bathroom and only in 1 specific place. There are other parts of the contract that he said he gave me credit for. I would like for him to show me where he gave the credit to me. Painting the exterior brick was included. He said he's not doing it and he gave me credit for it. That never occured. 
      Also- it does not say anywhere in tje contract that the 2 year warranty is only on structural issues. It says "our labor is warranted for 2 years"! That means any issues with labor. 
      The rest of what he said about being demanding is garbage. We were extremely flexible with him on the entire project. He had a 4 month time frame for project completion in the contract. It took 12 months until we could move in.

      I respect the work of the BBB and have enjoyed going decades without a bad review.  Sometimes one comes across a client for whom you have bent over backwards and he/she still wants more.  I am not going to argue back and forth with ********************** all that does is play into his game.  If ********************** feels that he has received shoddy work then he can take me to court.  I have never drawn that line in the proverbial sand before.  But then I have never dealt with a client like ********************** before.
