Failure to perform pavement work after complete payment was made. Delaying the pavement work by more than 18 months. We contracted paving work to Testa Asphalt in April 2022 for two phases of work at *********************************************************************************** Some additional work was added to the contract end of 2022 for which terms and cost was revised. First phase was to complete base for pavement and second phase to complete the paved road with Asphalt. The contractor performed a part of phase-1 work at sub standard quality in 2022. Contractor laid base for 16 feet wide pavement instead of the contracted 20 feet width. The contractor when notified of failed base work promised to take care of it when they perform phase-2 work.The contractor showed up for phase-2 and collected the complete payment for the work in Jan 2023, but one of the machine broke and they abandoned the phase-2 work. The contractor is not showing up to complete the work after continued reminders and the county inspectors are demanding corrective actions to the failed base work to be completed to avoid penalties. We continue to remind the contractor to come and finish the work for which payment has been made. The contractor refuse to answer our text or phone calls promptly. Do not answer phone at all. At times when the contractor decide to respond to a text message after months of requests they say they are busy and need additional time. We request the contractor to come and perform the work based on the contractual terms without any more delays. The delays are causing considerable amount of our time trying to contact the vendor and additional cost to keep permits current. The contractor is behaving very unprofessional and not courteous at all. We wouldn't have done business with the contractor if we had known of their business practices.Business Response

In August, 2023, we had our driveway replaced after a high pressure sales pitch from ***** ********************, son of ***** ********************, owner of ******************** Paving. While we were told that we could drive on the driveway in 90 minute, we waited two days, with concern that doing so would damage the driveway. Shortly thereafter, however, areas of damage were observed. The elder Mr. ***** informed us that we were driving incorrectly and not moving the cars forward or backward as we turned the front wheels. He sent three employees to our house to patch the problematic areas. Subsequently, however, the areas of concern expanded, with multiple areas losing many pebbles that seemed to be part of the macadam or whatever substance they used everyday. The situation and involved areas are getting worse. I have made multiple attempts to communicate with Mr. ******************** via text messages (would be happy to share our correspondence) to request his help in resolving this issue. We have already returned to cookies home numerous times since the driveway was complete
Basically, her issue is tire scrub.
This is caused by turning the wheels of your vehicle while sitting on one spot on fresh asphalt.,We installed her driveway exactly the same way we do three driveways a year and pick up the material from a state controlled asphalt production facility.
Nevertheless, return again before the end of this month to do a application of a commercial sealant this will mitigate the tire, scrub and fill in any diets may have been caused by this

Testa did work for us in early September. We wrote them a check for the work ($7700), which they said bounced and had been kept by their bank. We provided them another check for the same amount, and it appears that they cashed both (they've collected $15,400 but were only due $7700). They are still claiming that the first check bounced and refusing to return the extra funds. Our bank has indicated that in order to refund the $7700 to us they need a copy of the returned check (which Testa's bank is legally obligated to provide to them). I've tried reaching out to multiple **** at the company over the past 6 weeks and despite promising to send the returned check multiple times we have yet to receive it.Business Response

The contractor left the job with many repairs needed and has repeatedly promised to come back and honor his work. The contract states that they guarantee their work for 3 years. I have been given numerous days that I was expecting them to show up and they wouldn't.Business Response

Contract entered into 6/30/20 for $17,500 for driveway paving and grading. Comes with 3-year warranty - "fully warrantied for 3 years. we promise to meet or exceed industry standard and to provide you with the highest quality production pavement product applicable to your job". On the day the job was completed, we questioned some of the work, as there appeared to be a seam, some dips and sloping toward the garages. Mr. Testa explained that we needed to let the asphalt cool and settle, and if we have any issues his crew would return to remedy them. We shared with Mr. Testa that the driveway now appeared to be angled toward our garages and not away, as well as there was new puddling in places we hadn't experienced previously - Mr. Testa assured us that his crew had dug-up the driveway in all the right areas so that when he applied the 2.0" of asphalt across the entire driveway and then compacted it the driveway would be like brand new and we would have no puddles and we would have no cracking. In fact, he said that although he is only warrantying it for 3 years, we should have no issues for 20 years if we care for it properly. We have complained numerous times over the last 2+ years and he has said on multiple occasions that he would remedy, yet he has not returned to evaluate the situation and he has not come by to repave. His last text to me was July 22, 2022, when he would have "a plan for you today", and he has not responded to texts or phone calls since. We now have a 6+ foot "crack" right in front of our house, which keeps growing and getting wider, and we get flooding in our garage when it rains. Please help!Initial Complaint

Testa Asphalt Paving XXX-XXX-XXXX and Vito their representative. Verbal contract; discussed with Vito Driveway unique issue of water coming onto garage floor if height of driveway surface was not 1-2 inches below garage floor surface. I discussed issue and pointed out existing difference with driveway surface and garage surface. A fee of $3,500.00 was negotiated with an additional $400.00 for sealant. A 10-year warranty was to come with work. August 28,2022 Testa and Vito came to do the work. My wife confirmed with Vito that there would be 1-2 inches difference between height of driveway and Garage floor. He said he would take care of it. Upon completion there was no 1-2 inches difference between surface heights as he promised. Multiple phone conversations and texts and promises to return to do the work as discussed were made by Vito. Promise by Vito to repair damage caused by Testa to flagstone walkway transition from driveway to walkway have not been met. First rain after resurface we had water on garage floor. Photos and video of water on garage floor were texted to Vito with acknowledge of receipt. As of this date no corrective work has been performed on driveway. On 8/8/22 we hired Testa to pave and extend out driveway, paid in full on 8/8/22 and was told they would be here on 8/17/22 to complete the job. 8/16/22 I contacted from Testa to see what time they were going to be here and they told us they couldn't come due to being behind due to recants rains, which is very understandable. Told us they would be here 8/19/22 no show, texted Vito and got no response. 8/21/22 texted Vito to see if they were going to come Monday, Got a response from Vito Sunday, he apologized for not showing up on Friday due to his hauler getting on an accident when someone was trying to "race" them. Told me he would call on Monday once he got calendar in order 8/24/22 finally got a repose which Vito said they would shoot for next Friday. 8/26/22 after contacting Vito again he stated that he was sorry again that his PTO system went out yesterday (Thurs). He should have the truck back up and running by the end of the day and to my driveway on Monday (8/29/22). I let them know that if it could not be done on Monday we would like to cancel the services and requested a refund (1st Attempt) 8/30/22, I asked if the driveway was getting done today, Vito responded later that day that they were still waiting on a part for the truck I let them know since the communication was so poor, and being rescheduled 3 times already I let them know we would not be continuing with their service. (2nd Attempt) The excuses go on for 2 more weeks Sept. 14 we told them not to reschedule aging and return out money(3rd attempt) no response from Vito. I decided to call the other owner James, Vito's father. He apologized for his son and said he couldn't refund our money. To not cancel James promised to be out on 9/16/22 and he was providing us with a $400 courtesy check due to all of the issues his son caused. On March 3, 2022, I signed a contract with Testa Asphalt Paving to re-pave my driveway. The contract (which is attached) stated, among other things: "All unsuitable sections removed as needed for stability and correct level." Testa re-paved my driveway about one week later, and I paid the contract price of $3800. Within days, I noticed two relatively minor issues. First, the side of the driveway opposite the garage was raised several inches above the prior level, so that there was a steep drop from the driveway to the lawn. We asked Testa to promptly resolve this so that kids playing on the driveway did not twist ankles or otherwise injure themselves. After numerous assurances by Testa that they would resolve this, and their resulting delays, I opted to pay another vendor to add dirt to level our lawn to the driveway. The second minor issue was that Testa's work resulted in rust patches throughout the driveway, which Testa resolved by coating the driveway. The main issue prompting this Complaint is that the driveway is not level resulting in major ponding of water along the garage entrance. I watched Testa perform the re-paving, and saw that they removed only driveway sections along the garage prior to re-paving. This resulted in a significant uneven driveway level, causing major water ponding on the driveway adjacent the garage. I have attached photos. I told Testa about this months ago, as it is a breach of the contract which requires "correct level." Over the past months, we have sent pictures to Testa, asking for prompt resolution, as this will be a hazard when winter freezing occurs. Testa always provides excuses for delay and inaction. We therefore have started the process of obtaining a reputable, trustworthy vendor to fix the problem before the winter. We no longer will wait for Testa to level the driveway. As such, and because Testa did not perform as the contract states, this Complaint seeks a refund of our contract price ($3800).Business Response

Paid Testa asphalt a deposit in March to extend a portion of my driveway. After many weeks they came and completed it on May 18th. Within 4 weeks in late June and July parts of the driveway started sinking. I called both the son and the father James repeated emails and texts to come and fix it and they said they will but never came. Then they said they will come end of summer but I need a definite date to some and fix it. I need the extension driveway fixed, do something about the sunken portions. They also painted the rest of my driveway and whole portions of it has flaked off. I need them to repaint or do something regarding that as well . They are very difficult to work with. In October 2021, we agreed work to be performed by Testa on or driveway. One specific request was to level out the dip in the center of the driveway. The work was completed a week later. Shortly thereafter, when it rained in November and December, we noticed that the center dip had not been leveled and that it was larger, now spanning from one side to the other across the driveway. We called and left several messages to **** Testa (XXX XXX XXXX). Also over the last months, several potholes developed affecting the integrity of the driveway. Text messages and RESPONSE FROM **** TESTA January 1, 2022 - We reported that a person had fallen due to black ice across the driveway dip, asking Vito to fix. NO RESPONSE February 7, 2022 - We described the problem, illustrating with two photos, and asked to fix that week. VITO REPORTED THAT HIS BUSINESS IS CLOSED UNTIL MARCH 2022. We confirmed that we would wait until then. March 28, 2022 - We asked Vito to stop by this week. NO RESPONSE May 8, 2022 - We asked Vito to stop by this week. NO RESPONSE May 9, 2022 - We wrote to be waiting for Vito's response. VITO COMMITTED TO STOP BY THAT WEEK AND DO THE REPAIRS "AT THE EARLIEST POSSIBLE TIME". We replied "good". This case should not be closed; the complaints remain unresolved. Update follows immediately below. Testa Asphalt Paving was contracted to repair our driveway and to fix a small dip that, during winter, created a small area of black ice, posing a hazard to residents, visitors and service persons. Mr. Vito, Testa Asphalt Paving representative, agreed that the dip could be fixed and specified so in the job contract. The dip was not fixed as agreed in the contract. In fact, it was made wider across the driveway and now poses a greater risk to those approaching our house. In effect, last winter one person fell on the asphalt due to the frozen puddle. Furthermore, one month after the new pavement had been applied, it began dipping and peeling off, reportedly called raveling, and this we also reported to Mr. Vito. After unsuccessful efforts in winter 2021 and spring 2022 to resolve faulty workmanship by Testa Asphalt Paving, we filed complaints with the Better Business Bureau, the Montgomery County Office of Consumer Protection, and the Maryland Consumer Protection Division. Since then: 1. On September 14, 2022, a warm and sunny day, Mr. Vito visited our house to review our complaints. Using our yard hose, Mr. Vito sprayed the driveway dip with water. The water pooled and very slowly ran off. Mr. Vito argued that there was a very small inclination, that it produced the very slow drain, and that it was all that is required by industry standards. We explained that the extremely slow rate at which the water drained was not fast enough for the water to completely run off and dissipate and that during winter it would quickly turn into black ice across the driveway as in fact occurred during last winter. He reiterated that he had met industry standards and defied us to go to court. We maintained that he had not met the terms of the contract. 2. During that same visit (on September 14, 2022), Mr. Vito acknowledged that the driveway had areas where the asphalt was raveling. On this matter, he gave us until 9 am the next morning to accept an offer to cover the driveway with a sealant at no cost. He explained that the sealant would have to be reapplied every 2-3 years. He furthered conditioned the sealing of the driveway on our acceptance of his workmanship regarding the dip. We did not accept his proposal and did not respond to his offer by his deadline. We felt that he was using strong-arm tactics. Furthermore, our main complaint regarding the dip would not be addressed. 3. On October 3, 2022, after 0.52 inches of rain had fallen during the night, we sent Mr. Vito a photograph of the pooled water (taken at 7:41 am; see attachment) hours after the rain had stopped. We reiterated to him that such pooled water across the dip would turn into a sheet of black ice at lower temperatures and would become a hazard, putting at risk our safety and that of anyone else walking up to the house. Mr. Vito repeated his offer to apply a sealant to the driveway and affirmed that he was not obliged to do anything regarding the dip. We are hereby requesting your support regarding our request for Testa Asphalt Paving to correct both issues. We are also requesting that this job be completed under the appropriate temperature at the earliest before winter and that the job be performed with good workmanship. We are both retired persons in our 70s and this situation is stressing us out and constitutes a hardship for us.
