      I contracted ATSGCS LLC, to paint my homes upper and lower levels, replace carpeted flooring the hardwood floors, install recess lights. ATSGCS started the work in August of 2021, the work continued until December of 2021. ATSGCS did not complete the contracted work. The hardwood flooring, painting and recess lighting replacement remains undone. In addition ATSGCS left debris in my garage. I have tried to contact ATSGCS via telephone, text messages and email on several occasions with out success. I requested a partial refund via one the forms of payment that was paid to ATSGCS this was also unsuccessful. I paid ATSGCS an access of over $7,000, I would like a partial refund by ATSGCS to get the remaining work completed.

      This letter is in response to a complaint made by **** ***** regarding residential home improvement service rendered by ATS General Contracting Services (ATS) during the time period beginning  August 2021 through December 23, 2021. In her complaint, **** ***** alleges that ATS did not complete the work as agreed in the contract. This is simply not the case. Despite the many challenges and miscommunication presented by **** *****, all contracted work was completed by ATS General Contracting Services as of December 23, 2021. In addition, some of the work **** ***** alleges was ,"not completed", in fact, was not even work that she hired our company to complete, and therefore does not appear in our contract. Please accept the following as a detailed account of events that transpired during ATS completion of the contracted services.

      On August 1, 2021,  ATS was contacted by an electrician whom **** ***** hired to install recess lights in the ceiling of her family room. The electrician requested ATS Services to come and repair several holes in the ceiling of **** *****s home that were left as a result of the recess lighting installation. This is important because, in her complaint, **** ***** alleges that she contracted ATS services to install  recess lighting job; and that this job remains incomplete to date. 

      On August 03, 2021, ATS reported to the residence occupied by **** *****, to inspect the reported ceiling damage. After inspecting the ceiling, a verbal repair estimate was presented to **** *****. Immediately afterwards, **** ***** asked ATS to give her a second estimate to complete the following tasks:

      1)     paint the ceiling and walls on the 2nd level of her home, to include: living, dining, family room, kitchen, hallway, bathroom, steps, garage door entry area,  front door foyer area, base molding,  upstairs hallway walls and ceiling, base molding.

      2)     remove carpet in family room and install vinyl flooring with new base molding and quarter round trimming

      An written estimate was then created and provided to **** ***** and she accepted.  A contractual agreement was then created and signed by **** ***** and ATS General Contracting Services. The language in the contract scope of work reads "paint the 2nd floor areas, hallway, entry doorway, upstairs hallway, remove carpet and install new vinyl flooring with new base molding trim in family room."

       On August 3rd and 4th of 2021, ATS repaired multiple holes in the ceiling of the family room of said residence. Immediately after completing the ceiling repairs, ATS instructed **** ***** to remove all pictures and items from her walls in the rooms that were getting painted (living, dining, family, kitchen hall, steps, foyer). Additionally, ATS asked **** ***** to remove any fragile items that my be damaged during the painting and flooring repairs. 

      On August 11, 2021, ATS reported to **** ***** residence to begin painting services. Upon entering the residence, ATS  discovered that **** ***** did not remove any of the requested items from the walls, floor areas, or hallway, as verbally agreed. ATS asked **** ***** why the items were not removed. **** ***** replied, "she was busy".  ATS painting crew began removing the items from family room, kitchen and hallway and was instructed by **** ***** where to put theses items. This process was very time consuming and a was done as a courtesy for **** *****. On August 13 - 15, 2021,  ATS painted the 2nd  floor family room and kitchen. 

      On Monday August 16, 2021, ATS purchased and delivered the flooring materials selected by **** ***** for the family room. On Tuesday August 17, 2021, ATS removed the carpet flooring and installed vinyl flooring with the new base molding and quarter round trimming in family room. During the installation of the base molding, **** ***** asked ATS Contracting Services NOT to install the trimming around the fireplace because she did not like the way the white trimming looked around her fireplace. 

       On August 18  - 20, 2021, ATS moved the furniture and other items back into the family room and kitchen area and then painted the 2nd floor bathroom and upstairs hallways. On August 24, 2021,  ATS painted the front doorway foyer area including walls, high ceiling,  window trim and step area.  On August 28, 2021, ATS returned to paint the living room, however **** ***** did not remove any items from the walls and floor area, so again ATS paint crew assisted  **** ***** with moving these items and other movable items to her dining room and garage. 

      After finishing the living room, **** ***** reported that she had contacted a donation company to pick up her china cabinet in the dining room. The dining room was the last room needing to be painted. **** ***** stated that the pickup date was around October 15, 2021 and asked if ATS can wait until then to finish the dining room ( which was the last room). So ATS agreed to wait. 

      While waiting **** ***** then asked ATS to install a new toilet, sink and bathroom lights in the 2nd floor bathroom and ATS agreed. **** ***** selected the bathroom items online and in the stores and ATS went to the each locations and retrieved these items ( no delivered charges). Additionally, **** ***** wanted to change out the light bulbs in the kitchen, 2nd floor hallway, front entry door foyer and upstairs hallway area. So ATS changed out the bulbs in these areas for no charge. 

      On October 16, 2021, ATS asked **** ***** if the donation company pick up the china cabinet and she replied no, but she will call and check on the status. A few days pasted and ATS asked **** ***** again what's the status of the donation company picking up the china cabinet and she replied that she has to find someone else to donate the china cabinet too. Again weeks went by with no update from **** *****. ATS visited **** ***** a few weeks later and asking about the donation company status for picking up the china cabinet and she had no answer, so ATS suggested to bring helpers over to move the heavy china cabinet to ATS Company van and take it to the sanitary dump a few mile away for a small fee and **** ***** refused the services. 

      On October 18, 2021, ATS purchased a scaffold for $600 for **** ***** home to touch up paint in the higher areas around the front door entry foyer since there was going to be a delay finish the dining room. **** ***** agreed to allow ATS to setup the scaffold on October 18, 2021 for two-days. After purchasing the scaffold and returning to **** ***** home, **** ***** abruptly left her home. She stated on the phone that she had other business to attend. 

      On October 28, 2021, ATS sent a text to ****  ***** to schedule a date to complete the painting in the dining room, but did not received a reply. On  November 04, 2021, ATS received a text from **** ***** to schedule a date to return. ATS called and **** ***** and she stated that she found a company that will pickup the china cabinet around November ?, 2021. 

      On December 05, 2021, ATS returned to **** ***** home and moved all necessary items from the dining room (except the china cabinet) to paint the walls and ceiling areas (except for the walls around the china cabinet). Around December 19, 2021, ATS received a text from **** ***** stating that someone will pickup the china cabinet on December 23, 2021 and she wanted to schedule a day for ATS to finish the remaining area in the dining room. We agreed on finishing the painting on December 23, 2021.

      On December 23, 2021, ATS paint crew returned back to **** ***** to finish up all painting. The paint crew completed the paint in the dining room and touched up other areas with the paint as requested by **** *****.  On that same day, ATS paint crew reported the work was completed and **** ***** was happy with the painting.  The ATS painting crew also reported that they help **** ***** moved items to different rooms. 

      The signed contractual agreement by ATS General  Contracting Services and **** ***** was for "Repairing damage to the ceiling area in family room, install vinyl flooring and base molding in family room, purchase interior paint, paint 2nd floor walls, ceiling and hallway."  This is the language that is written in the signed contract agreement. ATS completed 80% of the contract work within 25 days. The dining room was a schedule conflict created by **** *****. ATS went beyond the contractual agreement and purchase additional supplies, material, delivered it and completed non-contractual work for a small fee or no fee. ATS also removed **** ***** items stored in the garage and delivered it to the local dump for no charge. 

      Around December 19, 2021, **** ***** asked the owner of ATS to put up the  Christmas Tree together and decorate it. The owner declined and **** ***** request and she became angry.  After that comment the owner of ATS felt it was best interest to send the paint crew back without the owner to finish the painting in the dining room. 

      ATS did not install or wire the new recess lights in the family room for **** *****. The recess lights was installed by **** ***** electrician prior to ATS starting any work in the contract agreement.

      The complaint about "installment of recessed lights" is miss leading and untruthful. **** ***** is willfully misleading that ATS took up to 6 months to complete the signed contractual agreement with out telling the facts about **** ***** scheduling conflict with removing the china cabinet in the dining room and her electrician install recess lights. This is a untruthful complaint with many untold concerns created by **** *****. 

      On January 19, 2022, ATS received a message through "**** ***" asking to give **** ***** $650 without reasons, ATS didn't reply. On February 03, 2022, ATS received another text through **** *** asking to give **** ***** $650 and again ATS didn't reply. On March 24, 2022, ATS received email from **** ***** stating to send $650 by "**** ***" for work not completed in the signed contractual agreement and send it by March 31, 2022 or she will take legal action against ATS. ATS agreed to send her the $650. On March 31, 2022 while attempting to send **** ***** the requested $650 to resolved this issue, **** ***** sent another email requesting $1537.00 dollars by "**** ***" or she's going to take legal action. This second emailed conflicted with the first email final requested to send $650 to **** ***** by March 31, 2022. 

      After **** ***** multiple attempts to receive cash from ATS by  "**** ***", she then filed a complaint with the BBB. The complaint submitted by **** ***** is untruthful, missed leading and leads out many concerning fact along with her personal interest with the owner of ATS. This complaint should be not be published and dismissed on the merits of the facts submitted by ATS. ATS has a extremely good customer service satisfaction and is open to allow the BBB to call and survey any of ATS previous and current customers.

      Below is ATS response to **** ***** complaint. Also attached is the signed contractual agreement with ATS and **** *****. 

      **** ***** Response August 21, 2021 On Recess Lights Contractual Agreement.

      ATS initially response about the recess lights remained validated by **** ***** response date on the BBB letter April 09, 2022. **** ***** acknowledged in her response that ATS did not install the recess lights and she did not have a contractual agreement with ATS to install new recess lights. ATS spoke with **** ***** electrician ( who is friends with the electrician wife) and he validated that he install the recess lights and **** ***** was aware of the dimming concerns of the lights. ATS had no contractual agreement for installing the recess lights. **** ***** did mention to ATS her concerns with the recess lights not dimming properly. 

      ****************** Response August 18, 2021 Purchase of the Flooring

      **** ***** response on the purchase of the flooring validated ATS response, that the flooring was pick up on a different date then purchased and no additional fees was paid for pickup,  delivery and removal of the flooring boxes from the van. 

      Additionally the fee $325  for the bathroom repairs was for removal and installation of toilet and wall lights in the powder room. **** ***** quoted in her response she paid $325 for the toilet installation only. Not True

      **** ***** Response August 11, 2021 Removal of Fragile Items

      **** ***** was asked to remove anything that was fragile from the walls and flooring area the day before the painters arrived. This was validated by the painting contractor who was present on the morning the painting was started. It true that **** ***** worked from home and could have moved some of these item. 

       

      **** ***** Response October 18,2021 Scaffold and Debris 

      **** ***** left out the fact that she agreed days in advance to allow ATS to set up the scaffold on the schedule day, but left out minutes before ATS arrived at her home with the newly purchased scaffold. Another date had to be rescheduled which was a cost to ATS. The painting contractor was paid for that initial schedule day and refuse to return on the rescheduled date. 

      Th only debris left in **** ***** garage was two paint buckets and few paint brushes. Most of the used paint buckets and brushes used by ATS  was disposed at the local dumb. The paint left in the buckets was residual paint for future use. The remaining paint buckets had the paint coloring identification number marking on it for the homeowner to utilized for future purchases. 

      Also **** ***** acknowledged at her residence that she had a lot of stored items in the garage that she needed to get rid of ( including old paint buckets). ATS help **** ***** remove extra paint buckets and other items that was previously stored in the garage so she could back her newly purchased SUV into the garage without tripping or hitting these items. ATS went to the local dump and paid the local dump for dropping off these items. The paint brushes and bucket left was for **** ***** additional use and coloring identification number. Additionally the paint contractor whom  finished painting the rooms for **** ***** on December 23, 2021, remove additional personal items from **** ***** garage and took it the local dumb. These items included window blinds, flower base and other items.

      **** ***** have listed dates after January 01, 2022, on these dates she was asking for $650 to be sent to her **** *** and ATS did not acknowledge it because there was not a reason for the request. 

      ATS remains committed to customer satisfaction and has an extensive history of providing good services with outstanding customer satisfaction. This concerns with **** ***** is an unusual outcome for ATS and will be evaluated for purposes of  improving customer service related concerns and satisfaction. ATS apologies for any inconvenience that may have caused to **** ***** but completed all contractual agreements on December 23, 2021. Attached is a copy of the signed contract with **** ***** and ATS.
