      Almost 14.5 years ago I had a roof installed at my home residence, **** ******** ****** ******** ** *****. The roof was installed by Hardesty Twin Builders where it specifically says on their website: EXPERT ROOFING, the owner is ****** ********. I was told by ****** ******** that I would have architectural shingles with a 30 yr warrany on the product and 14 yrs on workmanship. I asked for that in writing with a contract and he said, "***** you don't have to worry about the warranties; "you are family and you know I will take care of you". Into about 13.5 of the warranty I called him and told him the roof was leaking and his repsonse was: "what do you want me to do"? I said, "come out here and fix it". To date he has never come out to see the condition of my roof and the water stains on the inside ceiling which is the T 1 -11 and OSB plywood. He downgraded the insdie ceiling with OSB plywood where the plywood was damaged. So you can see in the pictures where I have two different kinds of plywood. He has ruined the whole ceiling inside due to putting architectural shingles on my sunroom where the pitch was way too low for those type of shingles. Should have been a rolled roof due to the pitch. Nails are exposed in my ceiling in the sunrood due to installing the cheaper OSB plywood and installing architectural shingles. There is also water damage on almost all my beams inside my sunroom and walls due to the roof leaking. I have contacted him more than seveal times to come look at the roof and he never came out. I reached back out to him two weeks ago (by text) because the leaking is getting worse and he is not responding. I asked him who was the manufacture of the shingles and where did he get them and he said " I don't remember I will need to look it up". He said in a text he would call me Wed. February 28 and of couse he didn't. Sent me a text on the 29th saying he is still looking for all the paperwork. I told him "there is no paperwork, ***** because you had to have done it under the table and that's why you didn't want to give me anything in writing". I have had two different Roofing Companies come out and tell me it should have been a rolled roof due to hardly no pitch in the sunroom area. No granules on the shingles to date. Moss and Algae growing in between the shingles. This isn't typical of a roof that is 14.5 years old now. With inflation going up I have had a bid for $31,000 and another bid for $23,000. I am a senior citizen living off of Social Security and cannot afford today's prices.

      Unfortunately, the Owner would not give me a warranty in writing or a contract.  I asked him for both and he said, "*****, you don't need to worry about that; we are family and you know I will take care of you.  I have asked ***** again for this information and he says he is still searching his files for them.  Since he is my niece's husband I trusted him.  I don't believe he even put this work under his business since he didn't provide me a contract and warranty when I asked for one.  Again, I trusted him as a family member.  I also asked him for the manufacturer's name for the product and where he bought the shingles and he said I'll have to try and find my paperwork.

      I have had three (3) different roofing companies come out in the last week and all three of them have mentioned to me it was an improper installation.  My sunroom section should have been a roll roof since the pitch was to low for architectural shingles.  He installed architectural shingles and the nails came through to my ceiling in my sunroom due to not being a rolled roof in the sunroom area.  I was also told by all three roofing companines that no water/ice shield was installed on the roof, no granuales on the roof after 13.5 years which shouldn't have that type of wear and tear on a 30-year warranted on product.  Two different of plywoods were used that shows as my ceiling in my sunroom with nails coming through all the plywood, no insultation that is a standard requirement.  All my beams in my sunroom have water damage and stains from where the roof is still leaking.

      ***** ******** texted me today and I called him and he states he has not received anything from you regarding my cpmplaint. 

      You sent me an email asking for the warranty and I responded to that yesterday and you are now waiting to hear back from the Company.  He said he has not received any emails from you and you stated to me that you were waiting to hear back from the Company (Hardesty Twin Builders) to answer some questions.  His email is:  ***********************.  Is this where you sent his email; if not he gave me this email today.  Please respond to the email provided in this message.

      Thank you.  Please verify you received my email regarding your question on the warranty and this ermail. It's not so much the warranty; I was told by my insurance company it was an improper installation which I mentioned in my original complaint.  I have had 3 Roofing companies come out and they all agree it was an improper installation and should have been a roll roof with deck shingles on the sunroom side.  The whole roof was done with architectural shingles.

      On March 4, 2023 ***** ********* owner of Hardesty Twin Builders emailed me and asked me for my email so he could answer my questions.  I responded back and told him you are supposed to send that information to the BBB.  I asked him if he received anything from you and he said, no.  I did provide you with his new email a few days ago.

      He said he is still looking for the paperwork/contract that I signed with him.  Again, I did not sign a contract with him because when I asked him to put his 14 year warranty in the contract he replied, "*****, you don't have to worry about the 14 year workmanship warranty because you are family and you know I will always take care of you."

      I called him asking why he wanted my email and he said to respond to your questions.  Then I asked him why didn't he ever come over when this all started in 2020 to see all the damages and told him my insurance company came out and looked at my roof and denied the claim because they said it was wear and tear, rot, and an improper roof installation.  He then stated to me your damage was an insurance claim through ******* ****** (homewoners insurance company at the time) and said he went through my insurance.  He mentioned that if it was an insurance claim who paid you, *****?  I told him you didn't go through my insurance because when they came out and looked at my damage in my basement with 2ft of water in the basement then looked at my roof.  ******* ****** said we are sending you a check for the two claims and it is up to you to choose who you want to use to do the work.  So I paid him.  I asked him who paid you my insurance company or me?  He said he doesn't remember.  He also said with an insurance claim he is allowed to only offer a 2-3 year warranty.  No one in their right mind would pay $14,000 with a workmanship warranty for 2-3 years.  The minimum roofing companies give you is at least 10 years.  I had three roofers come out in the last week and all their workmanship warranties were 10 years.  The bottom line is not so much about him not telling the truth about the 10 year workmanship warranty he gave me or the 30 year warranty on the product as it is all the Roofing Companies plus my current homeowners (**********) said it was an improper installation.  Attached is a copy of the letter that my insurance company gave me stating that.

      He then told me he did come out and look at my damages and had pictures that he showed me and we sat down and talked about it.  The pictures he described what he said he had sounds like the pictures I sent him so I asked for a copy of the pictures and he has not sent them to me.  He mentioned I have a picture where water was sitting in your gutter and not drainng out, a picture of the cracks and lost singles around the chimney, etc.  He stated that the chimney was not part of a roofing problem.  That is not so.  You have to flash around the chimney and put mortar mix around the chimney so it doesn't crack.  These pictures he is explaining to me are the pictures I sent him to show him the damages since he never came out.  The same pictures I sent you with my original complaint.  Those were my pictures.  So when he said he came out and he showed me pictures and we talked about it I asked him if you came out "what was the resolution"?  He said, "you don't know" and I said, "no, I don't know because you didn't come out so tell me what the resolution was and he said,  "he doesn't remember".

      Hardesty twin builders provides a one year warranty on labor. Some insurance companies may require three years and Hardesty twin builders will comply with insurance requirements. If defective shingles, then GAF provides a limited warranty. Thanks.

        I am rejecting this response because: ***** ******** (family member) told me when I asked about the labor warranty he said; 10 -14 years.  I asked for that in writing and he said, "*****, you do not have to worry about the warranty; you are family and you know I will always take care of you".  He never came out to the property when I first called him (which was about 9 1/2 years into the warranty) to let him know the roof was leaking into my sunroom.  I called many times after that asking him what he was going to do and he still never came out to my property.  He told me over the phone after I filed the complaint that this roof replacement was done through my insurance company and it was not.  We had a tornado in my area and I had 2 feet of water in my basement and shingles blown off my roof.  My insurance estimated the costs for the basement which flooded and my roof and provided me a check made out to me.  The insurance company mailed me my check and said you can contract this work out to any contractor you want to do the work.  So I paid ***** personally for the work with what my insurance company gave me.  So this is totally untrue.  He can't even find a signed contract for this work is what he told me.  I told him you can't find a signed contract because you never provided me with one.  I am really upset how he is not telling the truth. He also said, "I did come out there and took pictures and we talked about it".  I asked him what was the resolution ***** and he said, "you don't know and I said "no I don't know; do you know"?  He said, no.  He said no because he never came out to my house.  Then he said,  "I have pictures and the first picture he described was a picture with water laying in the gutter".  I said, "***** those are NOT your pictures those are the pictures I sent you to show you the damage".  Everything he is saying is not true.

      The fact he is not telling the truth I want a refund for totally being dishonest.  I paid $14,000 for the roof and with inflation I have three quotes from different contractors to replace the roof which was improperly installed and the difference with inflation.  The quotes I received were:  (1) 32,000 (2) $22,100 (3) 24,000.  All companies said it should have been a roll roof installed in the sunroom because the pitch was too low for the architectural shingles and that he should have used the same T-11-1 that I already had on the roof but he used OSB plywood which is very cheap; like $10 per sheet where as the T11-1 I have on the roof for my ceiling is like $42-43 dollars a sheet.  So when you sit in my sunroom and look at my ceiling there is two different types of wood installed with wood rafters.  He also used too big of nails and the nails went right through the plywood so when you look up at the ceiling your see all the nails poking out of the wood.  He also should have installed GAF Weather Watch Ice Shield on all gutter lines and valleys and he did not.

      I am not accepting his two line response saying he went through my insurance because that is a lie also.  The reason he sent you that response about insurance labor is only one year because he cannot find a contract because he didn't give me one since we are family.  I have learned do not use family or friends to do major and expensive work.

      Was his response only the two sentences regarding what insurance companies give you on labor??  Again, he did not go through my insurance.  Or am IO missing the rest of his response somewhere??

      I also forgot to mention all three Roofing companies that gave me prices for the roof have a 10 year labor warranty which is pretty standard in the roofing business.

      As I have mentioned in all my previous responses, ***** did not give me a written contract and warranty.  I took his word for it because he was a family member.  He knows he is wrong and has mentioned to me several times that I signed a contract and have asked him for the signed copy over the years.  Again, he replied; " you don't have to worry about that because you are family and you know I will always take care of you."  He has never mentioned to me one time that I only had a year warranty.  The standard in the industry for roofing is always a minimum of 10 year labor and 20 or 30 years on the shingles.  He did tell me at least 10 year labor warranty and that the shingles had a 30 year warranty due to them being architectural shingles.  He can't even provide me with the Manufacturer of the Shingles or where he bought the shingles.  

      Have you even asked him for a copy of the written contract or written warranty?  Again, when I asked for the warranty in writing he said, "you don't have to worry about that because you are family and I will always take care of you"!  I know you have to understand what I keep telling you. He has not provided you with any information other than the GAF warranty which you can print off the Internet.  The bottom line is that the roof should last between a minimum of 20 years and you saw the letter I showed you from my homeowner's insurance company where it clearly states that the roof was wear and tear and rotten and improperly installed.  If it was installed properly with the right materials then I should not be having these issues nor would the roof be in the condition it is in.   I do not see any attachments that ***** sent you so I have to believe that he didn't report this job under his Company or he would have given me a contract and written warranty.  He probably did this job under the table.  I believe you should also be asking him for a copy of the contract.  If I had a copy I would have sent it to you in my very first complaint.  It has been stated in all my correspondence that he did not provide a warranty.  

      I have no reason to be making this stuff up and trusted and believed him when he told me the warranty was 10 years on the labor.  H\e knows I asked for a written copy and again, "he said, *****, you don't have to worry about that because you are family and I will always take care of you".  I feel like I keep repeating myself because that was stated in the very beginning of my complaint so you have know from the very start that he did not give me a written contract or written warranty.  No one in their right mind would put out $14,000 for a new roof with a one year warranty.  That is not even heard of.

      Please let me know what else he provided you and why you are not asking him for a copy of the contract and warranty when he is the business owner and should have this paperwork securely filed whether it is in a box or on the computer.  If the roof was properly installed I would not be going through these issues of leaking into my sunroom.  I have provided you with pictures, letter from my insurance Company and have two out of the three written contracts I have that was given to me by other roofing companies.  It is quite odd that both of them said the same thing regarding it should have been a "rolled roof on the back of my house over the sunroom.  Even though the shingles starting rotting on the front of my house as well.  I didn't get a written contract from the third roofing company because his bid was higher than the $22,100 bid and told him I had a cheaper price and I would be going with the other Roofing company.  I have done my due diligence in sending you what I have and I don't believe ***** just answers your question about the warranty.  Since I can't see what you asked him I have nothing else to go on except what the other Roofing Companies gave me a contract and came out and looked at the roof.

      It doesn't appear to me that you have asked ***** any questions regarding the improper installation I have reported to you.  Did you even ask him for the contract with the warranty on it stating that he only has a one year warranty.  Again, that is totally not heard of and I would have never gone with anyone providing a one year warranty on a $14,000k job.  I also don't understand why you are not addressing the questions I have asked you in all my communication??

      After re-reading your message regarding mediation the folloiwng statement does not make me feel that a solution will be provided (As BBB is a neutral third party non-government entity, we can not compel the business to provide a specific resolution to your complaint).

      I did speak with someone from the MHIC and it looks more favorable for me to go ahead and file the complaint with them.  She told me if the outcome is favorable for me that I could be paid up to $30,000 from the Guaranty Fund.  Even though I'm seeking less than $30,000 this is the way for me to go.  Being that the BBB can not compel the business to provide a specific resolution that does not make me feel very positive to go into mediation. Since he is licensed and did not follow protocol in many areas I think we would be wasting our time!

      Thank you again for all your help but I believe since there was no written contract and no written warranty and MHIC requires you to have a signed contract and warranty from both parties this is my better choice.  He has lied about so much first saying he went through my insurance, then saying his warranty was only one year, etc. this is the best choice for me.
