      This matters is they said back in 2012 for $$4120.00 for ***** ********* *****. This Company engages in fraudulent practices by seeking out information from over 10 to 15 years ago that does not appear on credit reports. When requesting original documents, Kevin abruptly ended the call, and Mark was unhelpful and dismissive, claiming they were not obligated to provide any evidence. It is imperative to establish laws to prevent such actions. Upon visiting the courthouse, the clerk confirmed there was no record of the matter in question, despite the documents provided by the bank. The company repeatedly associates my Social Security Number with banks and sends altered court documents with forged judge signatures. To address this issue, I will file a police report as the situation has escalated. Despite not having ***** ********* on my credit report, the company continues to change names and utilize the same fraudulent court papers to freeze accounts. Despite my efforts to alert *** Bank of the fraud, they have not taken action, resulting in financial strain and damage to my credit. I have filed complaints with the BBB and fraud reporting sites and will pursue a police report for a restraining order to halt these baseless attacks on my financial record. Leave me alone stop harassing my life.

      This account (originating with ******* and with account number ***********) was purchased by ******** ************ ***. on or about 02/13/12 and the account was assigned to this firm. At that time, the firm name was Peroutka & Peroutka, P.A. (P&P).The firm name is now Klima, Peters & Daly, P.A. (KPD).

      P&P filed suit in the District Court of Prince Georges County on 03/12/12 (Case number **********). The consumer was served a summons and subsequently called P&P and agreed to a Consent Judgment by which the consumer would pay $150 per month until the account was paid in full. The court entered the judgment on 07/09/12. The consumer defaulted on the payment arrangement. 

      In July, 2015, the judgment was sold to ***** *********** *********** *** and subsequently assigned, for collection purposes only, to ******* **** *** ****. The firm continued collection efforts and was in contact with the consumer on multiple occasions. During the time period UC owned the account, the firm garnished the consumer's bank on three occasions and collected a total of $179.42. 

      In September, 2022, the judgment was sold to ***** ******* ******** *** ****. Since that sale, RH has collected $42.72 through a bank garnishment.

      A judgment in Maryland is valid for 12 years from the date the court enters the judgment and can be renewed for an additional 12 years; KPD renewed this judgment on behalf of RH on 11/14/23. The judgment has not expired. Please see attached Maryland District Court Case Search for details.

      KPD will not telephone the consumer; however, KPD will continue collection efforts on behalf of our client.

      I am rejecting this response because: I never received noticed for court or original document. My income from my position at ****** **** *** ******* ******, totaling $600 weekly, is insufficient to meet any debt obligations at this time. Due to recent family tragedies and the demanding care of my mother, who suffers from Dementia, I have made the decision to resign from my job and work part-time. I have obtained full guardianship of my mother as mandated by the courts, and she requires constant supervision, leaving me unable to work full-time.
      Furthermore, the recent loss of my fiancé in a tragic accident has added to my personal challenges. Given these circumstances, I do not anticipate any changes in my financial situation or employment status that would enable me to make payments towards my alleged debt in the foreseeable future. Attached to this correspondence, you will find the court order granting me guardianship of my mother, a summary letter detailing my situation, a description of my current condition, and an explanation of how these factors impact my ability to work. I respectfully request your understanding and forgiveness of my alleged debt, as my current circumstances prevent me from meeting any financial obligations. Please respond to this request in writing at your earliest convenience.       This business Klima, Peters, & Daly, P.A. put a garnishment on my checking account for a collection balance I was paying. I did have returned checks, however Klima, Peters, & Daly, P.A. never advised to me they would put a garnishment on my checking account. My bank charge me a $125 fee for the garnishment. I didn't receive any information , or notification from Klima, Peters & Daly, P.A., so I feel they need to refund me the $125 or apply $125 to the amount I owe. Not notifying me of the garnishment isn't right.

Suit was filed in the Maryland District Court in Washington County on 09/28/22 and the case number is *******************

      Judgment was entered by consent in favor of *** on 10/26/22. The payment agreement was $85.92 paid bi-weekly beginning 10/21/22. The consumer has made $601.44 in payments on the unpaid balance and the remaining balance is $490.39. Since 12/01/22, three checks deposited by the consumer have been returned as insufficient funds. As a result, KPD filed a REQUEST FOR WRIT OF GARNISHMENT OF PROPERTY OTHER THAN WAGES (Md. Rule 3-645 and 3-645.1) in the District Court of Washington County. The bank responded to the writ 03/27/23.  Under Maryland law, a judgment creditor is not required to notify a judgment debtor prior to filing a request for garnishment.

      This company went about this garnishment the wrong way.  They didn’t give me time to call and correct the situation before they submitted the garnishment and I was never made aware of the garnishment.  I offered to pay them with money orders but it was too late the garnishment already was applied.  I demand a credit/compensation that I was charged by my bank which was $125

      On 6/2022 I entered into a stipulation agreement with the Baltimore Courts on behalf of **** ******* and its representative Klima, Peters, Daly PA . The total amount due was 859.65. I made an ACH payment on 7/5/22 and 8/1/2022 and my final payment on 12/29/22 for 3 equal payments of 286.55. On 2/5/2023 I received a notification from my bank that a garnishment was placed on my account ending in 8355 for 366.99 from the plaintiff which has caused an overpayment. I sent an email of concern to the law office on Sunday 2/5/23 and placed a call the next morning and spoke to a representative who told me that my payment on 12/29 was not received yet I have a web tracker number and a posted deduction from my account at PNC. After being berated and disrespected by the customer service agent who was offended that I asked to speak to a manager. I was then transferred to Sean ******* the manager I tried to explain my story and even offered to send receipts of posted amounts and kept getting cut off and rudely spoken to, Sea ******* n then rudely told me to TONE IT DOWN. I mentioned I am speaking to you the way you are speaking to me. We may be in debt but EVERYONE deserves respect and dignity . I was hung up on. I then called back an hour later and was met with another customer service lady who read the notes and then RUDELY said you just spoke to Sean I ll transfer you and then under her breath said he is not going to answer YOUR call and sent me to VOICEMAIL. ALL I NEED IS A RESOLUTION and a refund of the overpayment.

      This complaint is in regard to an account assigned to Klima, Peters & Daly, P.A. (KPD) from our client **** ******* *** on 10/22/21. The original creditor was ****** *** ***** ***. and the account number ended in ****. The KPD account number is **********. Suit was filed in the District Court of Baltimore City (Docket number ***************) on 12/10/21. The consumer's legal representation called the KPD office on 05/29/22 and negotiated a Stipulation Agreement of three monthly payments of $286.55 to be paid by 06/30/22, 07/30/22, and 08/30/22. 


      KPD received all three payments as per the Stipulation Agreement; however, the payments were made with an incorrect file number in the memo section of the check. The third payment was made 12/29/22. When the consumer contacted the KPD office on 02/06/23, KPD investigated, found the payment, and posted the payment to the proper account. Subsequently, the bank attachment was dismissed and the consumer was sent a Paid in Full letter on 02/10/23. No funds were collected pursuant to the bank attachment.  If the consumer has not received this documentation, we would encourage her to please contact our office. 

      The consumer did not overpay the account; three payments of $286.55 were paid and credited as per the Stipulation Agreement. Thank you.

      My credit report still shows as this account not being paid or closed properly or being shown as paid off as it is paid off. This needs to be submitted to the correct credit reporting agencies immediately to resolve this issue. This account is showing not paid and therefore has been sold again to another collection agency. If you need anymore paperwork, i have the individual paystubs showing each garnishment reaching the total amount.

      "Klima, Peters & Daly, P.A. ("KPD") is in receipt of the Complaint Case # ******** filed by ****** ******* ("Ms. *******") on or about 01/03/23. KPD represents **** ******* *** ("****") in attempts to collect Ms. *******' delinquent ******* loan with an account number ending in **** (the "Account"). **** is the current owner of the Account. The Account was originated with ******* and was charged off on 06/02/19.

      KPD filed suit and obtained a judgment in the Virginia General District Court in Prince William County (Case number *************) on 11/09/21.       This weekend on March 26th I received a letter from lawyers saying I had a lawsuit filed against me and I should contact them so they can work out a settlement with the company on my behalf. Not once was I notified about this lawsuit but the company Klima and peters daily says they sent out a letter in December. I never received anything from them. Fast forward I call to try and get a settlement and I'm told they don't take debit card payments so I asked to speak with a supervisor to figure out why is this. I begin speaking with the supervisor and I'm telling him i don't feel comfortable mailing money in when I never even received the mail they supposably sent me. He then goes on and tries to tell me I did receive the mail and that I think I live in a world where I'm supposed to be notified immediately and just begins to get a little to disrespectful. Interrupting me and trying to tell me how I think and how I do this and that. He was so busy being disrespectful he started contradicting himself saying well the first time we got in contact with you was yesterday. And that was my exact point I had to call LVNV funding just to get the name and contact information to call them and try to solve this issue but he swears I received there letter and the info they sent me. You can go back to the phone conversations and everytime I called I told them I don't have a case number because I never got one they then asked for me to verify my mailing and contact info. So if this is you all first time getting in contact with me how am I verifying information you have in your system on me. So y'all did not reach out to and try to call me or send me anything like your supervisor is swearing I received. Long story short I don't appreciate nor accept the harassment and disrespect from the "supervisor" I spoke with and you can hear it in my change of voice during the phone conversation.

      Due to the COVID-19 pandemic and the fact I no longer lived in Delaware, I attended a virtual court session w/ Peroutka, Miller, Klima & Peters, P.A. and a judge at a JOP in Delaware. This was to come to an agreement to make payments towards a debt that Peroutka, Miller, Klima & Peters, P.A. was trying to collect from me on an old Capital One credit card. We had come to an agreement to make a monthly payment via Peroutka, Miller, Klima & Peters, P.A.'s website. I attempted to make the agreed payment 2x and both times the money was removed from my checking account, then returned with no reason. I tried contacting Peroutka, Miller, Klima & Peters, P.A. via their website and phone (Left several voicemails), and none were ever returned. I do not have physical checks *** I use an online bank. Since I could not find a way to pay them, I waited. Several months later, I received a letter in the mail from the JOP court saying a judgment was entered due to failure to pay. I immediately contacted Peroutka, Miller, Klima & Peters, P.A. and explained the situation. This time, I was responded to stating that I could have sent a certified check from a bank or money order. I explained that due to COVID-19 and my health issues that supress my immune system, that is not a viable option to enter public places if I do not need to. Peroutka, Miller, Klima & Peters, P.A. is now ignoring my request for a resolution.

      I received a huge packet in the mail, with a warrant in debt lawsuit attached from this firm trying to collect on a debt I have no knowledge of. The warrant in debt appears to be fake. There is no record in my county court with the date and time they have provided on the notice. None of the documents they attached which supposedly is proof of the debt has my name listed. I will be contacting my attorney, as well as filing a complaint with the consumer protection agency. Also, i contacted all 3 credit bureaus..they have no record of this debt included in my file.

(KPD) on 10/22/21 by Resurgent Capital Services, L.P. regarding an account that originated with Credit One Bank. An initial demand letter was sent to the consumer on 10/27/21. The suit package that was received by the consumer does provide the consumer's name and address and the warrant in debt is not "fake."
