Signed contract 12/28/2022. Completion date for the work Feb 2023. Curbio has breached the contract. I want to terminate the contract and have Curbio pay for damages to my property caused by the contractor they hired to perform work. The contractor abandoned the property and left construction materials from another work site on my front lawn. They damaged my basement bathroom's floor tile, toilet, shower floor, and vanity sink. There is water damage to my basement's ceiling tile, baseboard, and trim. It has been seven months, and Curbio has been very slow to respond and, for several months, nonresponsive to some of my complaints, starting from January 2023 to July 2023. Several project managers were assigned to the job, but the work is still incomplete. I have complained to the Regional Director, sent emails, and made numerous phone calls requesting to terminate the contract due to a breach in the terms and conditions of the contract. They are stalling and ignoring my request. After seven months, they have not done 1% of the agreed-upon work and have damaged my property in the process. It has cost me from January 2023-July 2023 the following: House payments $10,000 House Utilities $3100 Home clean-out $1500 Storage Unit $1120 Furniture Move $ 2000 Rental property $12,600 (month to month) Rental Utilities $2400 Undue Stress $50,000 Damages to Property Basement toilet $3000 (macerating toilet and labor) The basement bathroom tiled wall and trim were removed without permission. $4000 The basement vanity and sink were damaged $600 The basement shower floor installed tile at a higher sloop at one end, and water seeps through cracks in the shower wall onto the floor outside the bathroom. Replacement cost for shower $8000. Cutback of shrubbery, tree limbs, vines, and weeds on the fence as stated in the contract, $5500. I want immediate contract termination and compensation for property damages and undue stress.

The situation is getting worse.  My health is being affected due to the mold forming on the walls and carpet and behind the walls and tile.  I have contacted the company several times asking them to pay for damages.  The last message I received from them stated, they will do the work and will give me 12 to 16 months to pay them for the work.  They caused the damage and now want me to pay for it.  I received a call from their Regional Director apologizing for all the issue I have with the company.  He said they will repair the damages but they wanted to complete the work stated in the contract.  I told the Director, I wanted out of the contract and did not trust them sending another vendor to my house because I have lost faith and trust with the company and I'm afraid they will cause more damage.  The original contract for the work was priced at $23,000 to date I have spent that much out of my pocket repairing the damages they caused.  It's going to cost another $25,000 to $30,000 for the remediation work for the water damage, drying out the walls, disinfecting, and mold removal.  My flooring upstairs, walls and base board will need to be ripped out to dry behind the walls.  My basement tile, carpet, wall, ceiling all have to be removed in order to dry out before any thing can be replaced.  The company is very non-responsive.  I have been asking for updates on the contract and reimbursement for damages, only for my request to fall on deaf ears.  Today is the first I've heard from the company since my last request on July 5, 2023.
