      We have been utilizing this business to file our personal tax returns for over 10 years. The business made an error on both the 2020 and 2021 tax returns in not filing RSU stocks which I sold both years. In 2020, I incurred a significant loss with the stocks but we recently received a bill from the IRS in the amount of $8,000.00. I contacted the business to ask what occurred and I received several explanations as to what happened and why the e-file did not include these stocks. My husband and I turn over all tax related documentation to him every year. I do not believe he is competent to deal with RSU stocks and does not know the tax law surrounding these employer gifted stocks. He advised me to send the documentation again and he would do a re-file for both years. He is now holding our re-file hostage while the IRS accrues interest on unreported income (which we don't even owe) because he wishes to get paid again. We pay him $600/per yearly filing and this is his error. My husband spoke with him to get the issue resolved and Rod's only reply was, "I don't care what you do. I'm retiring next year." We would like to have our re-files submitted without additional charges and we will never go back to this business again.

      Dispute Resolution Team:
      To start with we did not make an error. The error is that they never gave us the forms to file for the stock sales. ******* ***** said to me that info was on her W-2 to file for the sale of stocks. The w-2 only shows that she purchased restricted stock not for the sales.  They also told me that they gave me the forms for 2020 and 2021 tax years. It is actually not possible in that the tax forms are not available until after they came in. We have and always have scanned in all the documents the client gives us when they come in. If they had given us the 10-20 forms for the last two years, it would have been scanned in. My answer to her regarding me not knowing about RSU stock is that I have been licensed with the IRS since 1975 and I also was licensed as a registered Investment Advisor for over 25 years managing over 35 million in assets. I took care of the ** **** letter and mailed it to the IRS and Virginia. They are actually getting refunds for the 2020 return. I have also had to amend the 2021 return because of their failure to give me the documents needed for the sale of her stocks. I charged for the work that had to be redone because of their failure to supply the forms.  I do not file the returns until I am paid. They paid me for amending 2020 return but not for 2021. I basically would not want this client back because they are calling me and my staff liars. I told them to look at the disk I gave them and it shows that they did not gave me the above forementioned info.

      I have provided proof that the tax documents were provided to me from ******* prior to the appointment to complete our taxes.  He is holding our returns hostage over a mistake he made and this is not ethical or acceptable.

      This is in response to my client, ******* *****'s complaint.

      I received ****** information after my client received the ****** IRS Notice. My client, *************************, claims that she provided proof that the documents were provided from ****** when her husband came in for the appointment. However, 10 to 20 pages of ****** information for each year were not given to me. My proof of that is that they were never scanned in for either year. I told the client to check the disk. It is almost impossible for me and my stuff to not have scanned those documents in along with other their records for both years. In addition, as a financial planner, I know that those ****** tax statements would not be available until a later date.
