I paid 650.00 to have my driveway paved, and the patches are lifting up. The owner stated there was no way to fix it, and said it was not in my contract. I got a second opinion from a competitor and they said the patches were done incorrectly. I have pictures of the mess he refuses to fix. I don't want my money back, I want him to make it right!Business response

Consumer Response /* (4200, 7, 2022/06/07) */ ***Document Attached*** Here are some previous emails when the job was done. The owner stated there was nothing he could do, and stated not to pay him. Then sent me an invoice, claiming I refused to pay him for the work he did. I paid him, even though the work was not up to par. Consumer Response /* (3000, 9, 2022/06/07) */ ***Document Attached*** I sent pictures of the lifting patches to the owner the same day I filed the complaint. I didn't get a response. I then filed the complaint with BBB. That night he emailed me agreeing to look at it the problem again. After he received notice of complaint from BBB, he sent this very threatening email. Please see attached. Business Response /* (4000, 16, 2022/07/14) */ Mike ***** Construction LLC. July 14, 2022 To begin, My company has gone above and beyond to satisfy the complainant. After four trips to the complainant's house to fix the problem; they were still not satisfied with the crack filling, and sealcoating service provided (not paving as the complainant states). After exchanging several (non- threatening) emails and phone calls, in hopes to come to a solution to this issue, the complainant was still not happy. Prior to this situation, the complainant signed a contract on March 18, 2022, simply agreeing to the fact that my company is not responsible for tire scuffing and shrinkage, which the complainant was dissatisfied about. In situations where the customer is not satisfied with the work provided, my company will not accept payment. After the complaint filed with the BBB a check was sent for our services provided. Our company did not accept the payment and returned it to the sender. Consumer Response /* (4200, 18, 2022/07/16) */ (The consumer indicated he/she DID NOT accept the response from the business.) To begin, I am the complaintant not the complainant. This company did not go above and beyond to fix the problem they created. The owner did not even meet with me personally after I sent pictures of the debacle. I had 2 competitive companies come and assess the problems, and not confirmed it was not done correctly, and the work was shabby. After 4 emails from the owner, stating he didn't have to fix it and it was not in contract, but he would "see what he could do, if anything at all," I decided to contact BBB. After he received the complaint, he sent a hostile email saying he was done with me, and that he would sue me for harassment, if I tried to contact him again. He returned my check of 650.00. This company showed me no respect, and was extremely unprofessional when I showed my dissatisfaction. I didn't want my money back, I wanted my driveway sealed correctly. I consulted with 3 people about this company, and every single one said he was arrogant, unprofessional, and the work was not up to par. Gratefully , I have another reputable company, that has fixed the mess, and my driveway looks the way it should. The problem is resolved, but I would never recommend ***** Construction in the future.
