I signed a 12 1/2 month lease on June 8, 2021 with Salisbury Housing to begin July 1, 2021 and ending July 15, 2022 for **** South Division *** ********** ** XXXXX. It was not until I attempted to pay $370 for my final rent payment covering July 1 - July 15 that Therman Brown informed me that I owed the entire month's rent and that if I did not pay it on time, there would be a late charge and it would affect my credit score. I reached out several times by phone and email to resolve this, but Mr. Brown insisted that I owed the entire $740. On July 1, 2022, I paid the entire $740 because I did not want a negative report on my credit history. I am now seeking the $370.00 that was overpaid since my tenancy, as stated on the original lease, ended July 15, 2022. Salisbury Housing drafted the lease and there was nothing in the lease that specified I had to pay the full monthly rent for July 1-15, 2022.Business response

Business Response /* (1000, 20, 2022/12/01) */ When **** ********** called about her final payment, we explained to her how it works and how it is written in the lease she sign and she was provided a copy of the lease. Monthly payments are paid in advance without any deductions or setoff. I have attached page one of her lease which explains the terms of her lease. If you have any questions or concerns, please feel free to contact us at anytime. Thank you, Consumer Response /* (3000, 22, 2022/12/06) */ (The consumer indicated he/she DID NOT accept the response from the business.) Deductions or set-offs are not in question. The original lease is clear that lease term ends July 15, 2022. No where does it state that rent is owed past the lease term. Consumer Response /* (2000, 34, 2022/12/27) */ The email I received from BBB stated "Frequently your BBB can resolve a disputed issue through arbitration; however both parties are currently unwilling to proceed with arbitration." I am more than willing to proceed with arbitration. Please update the complaint.
