Back in 09/2022, I signed a contract with Burch Masonry LLC to build a retaining wall in my backyard. The wall was finally completed without satisfaction. The bricks are uneven, there were no caps put on them, the yard was left a mess. I had to contact **. ********** on several occasions to begin the project, after he promised he would be to my house on certain days to see when he would arrived. When he finally came, he sent an associate, which he did his job. However, while he was working and waiting for dirt to be delivered to even the yard, they advised the dump truck to dump the dirt in the middle of a residential street, in which the Code Enforcement agent came and adivised they would issue me a citation if the dirt was not moved immediately. After speaking with the agent I assured him that it would be up within 30mins; he gave me an hour. While talking to the agent, I noticed that a truck was offloading a bull dozer. I questioned the associate about this machine. He indicated that the bull dozer was to transport the dirt from the street to our backyard. I questioned as to why a rabbit or something smaller was not being used instead, because its very narrow between the two houses. The bull dozer proceeded to bring the dirt while the agent and myself observed. Please be advised that my husband just had our driveway and steps done via cement. While transporting the dirt the bulldozer cracked our driveway, two steps and a slap of cement in our backyard. I contacted **. ********* about the incident that occured. It took him some time to come to look at the damages but eventually he did. I advised him of the broken cement and that he should allow the same guy who completed the job to redo it again. **. ******** indicated he knew how to do the cement which was not true. He replaced the broken pieces, instead of replacing the entire steps and slab of cement. So now all the pieces have cracked again and are split. Need to be replaced. Would like my money back.Business response

I am aware that he did Crack the cement steps and slab in the back. I did have some things going on at the time that didn't allow me to be there full time to prevent that. Not saying it's your fault, but at the same time I am human. You did get the retaining wall, and the dirt brought in to level the yard along with the fence tore down, which cost a lot out of my pocket. The final balance was never paid I believe somewhere in the range of $500. We.can definitely work out a settlement, but a full refund is a bit much. I'm definitely willing to work with you and do apologize.Customer response

I am rejecting this response because:
I contacted *** ********** several times about the damages, his company caused to my cement (partial driveway, steps leading to backyard and patio) while completing the retaining wall.
Once we finally spoke, I informed him to just pay the business who originally completed the job, so that the cement would look the same. He advised me no, and that he could complete the job, and was familiar with cement. When he did come out to repair the damages, it was like the horrific job he did on the retaining wall; rushed and not professionally done. I even advised him during one of our conversations, that he could not just patch the broken pieces, and that the entire slab of concrete would need to be completed removed and replaced on each broken piece, he did it anyway and look the pieces he attempted to repair, BROKE AGAIN, IE; the steps have cracked and crumbled, the edge of the driveway is cracking, the patio in the backyard has cracked and is separating from the rest of the cement, and he do not think he should compensate me fully for the price of the cement? I DO NOT want him or anyone from his business completing this job again for me. He has showed me that he is not capable of completing the job(s) satisfactory.At this point, YES I would like to be compensated, so I can pay the same company to come back and repair the problem CORRECTLY, and put this nightmare behind us!
**. **********, mentioned about he had a lot going on and I'm curious, what did I have to do with that? This was NOTHING PERSONAL between he and I, he didn't do me no favor. I PAID HIM for HIS services.,in full and upfront. I expected HIM to render service and do the job correctly, which did not occur.
As a business owner, If your busy and cannot provide good customer service to your clients this is an issue, and not the right profession for him. On numerous occasions, he failed to contact me, because he had other things going on…unacceptable !!
Yes, its obvious we are human and humans make mistakes. However, as a business owner he has to accept OWNERSHIP and do whatever it takes to satisfy his clients, and not make them feel they are being scammed. Its evident, he has a PATTERN with the way he treats his clients. I researched his business and found out, I'm not the only one that has complained and/or had an issue with him and his business ethics. I work extremely hard for my money, and expect what I paid to be done correctly, upfront. If he knew he was to busy to complete the work professionally, then he should have stated that before he accepted my money!!
Therefore, its only fair he pay me (($1500.00)) for the damages to my cement caused by his business, and the deplorable work he completed on my retaining wall built, which includes
Bricks protruding
Mortar placed and thrown all over bricks (sloppy)
Trash stashed inside bricks
No weep holes placed in wall, therefore, when it rains the wall will maintain the water and eventually collapse
Bricks are not aligned correctly on wall
