      A Hobie Evolve V2 Motor Kit was bought "new" from Gull Lake Marine's **** seller on April 14th, 2024 for $2,229.06. When the motor arrived, it was clearly not new as listed, and the seller was contacted at which point they admitted they did not send a new motor as advertised and provided a 25% discount bringing the total down to $1,677.31.I used the motor twice, after which it never worked again. Hobie requested it be sent to their repair facility, at which time it was discovered that not only was the motor used, it was over ten years old and had been discontinued. They stated that the seller would be the party that needed to rectify the incorrectly sold item.Gull Lake Marine has been contacted many times over multiple weeks and they continue to refuse to accept a return or refund the falsely advertised item. They further listed the sale as not accepting of returns, so when **** was contacted, they stated that Gull Lake Marine would have to agree to the return process, which they have continued to refuse. **** said their is nothing else they can do from their end and it will need to be resolved with the seller.I'm not even asking that they pay for the shipping costs I have incurred, through this ordeal, or for the $1,000 battery that I no longer have a use for. I just think they should rectify their false sale and refund the remaining $1,677.31.Thanks for your consideration,***

      The referenced part was ordered on April 14, 2024. On April 17, after receiving the part, we were messaged about the "new" part not being new. We promptly acknowledged that it was a "new-other" part, meaning it was a display item and not used. We offered a return or partial refund. The customer agreed to a partial refund of $500 and thanked us for our prompt service. The refund was applied the same day.

      We did not hear from this customer again until 4 months later on Aug 16. We have in the **** messages that the part had been used. Additionally, the part was past **** returns timeframe for eligibility. Our team assisted this customer to the best of our abilities and **** policies. We value our **** customers and appreciate the business.

      I am rejecting this response because:

       

      The response from Gull Lake Marine is a falsification. The motor was not listed as "new-other" as they are trying to portray and was simply sold as new, as shown in the documentation of this claim. The ten year old motor that was sold as new was clearly not a floor model and was heavily used (it just takes a quick glance at the provided photograph to confirm this). I contacted them when it was first received, and contacted them again when it promptly broke. This is all clearly documented, and their predatory practices have been passed on to Hobie and ********. I would appreciate the support of BBB to avoid escalating to small claims court.

      Paid around ***** dollars for a brand new boat and dealership delivered it sinking among many other things wrong. ****** tried to fix it twice with no success and I had someone else fix it correctly and asked dealer to pay for it. They said they would pay for it if I signed a release agreement absolving them from any responsibility in the future. Pay that kind of money and have no warranty on the boat is absurd. Past practice from the dealership warrants them paying for it because they paid outside sources in the past with me when they couldnt fix issues I had. They violated the consumer protection act in my opinion and shouldnt be able to take peoples money without delivering a fair product and simply walk away from any responsibility. I didnt feel comfortable having them try to fix it a 3rd time due to their incompetence
