      On 4/27/2021, entered into an agreement to Have Ultimate Outdoor service deliver, install soil, ************ on our property. Services were performed May.15th. Payment in full via cash was made given to the owner, ****** His instructions were to water 2x daily to promote grass growth. This was done for 5 straight weeks & 1x daily thereafter. Grass was growing, everything was fine. However, beginning of August, bare spots started to surface where the work was performed. Gravel was starting to come through the bare spots. I called ***** at that ********* said he would come out to look at it. A week later, I called him again since he did not show up. He said he did not have time but would come out this week. Two weeks later, again I called ***** advising him that he needs to come out to take a look this mess that we have in our back yard or I will need to take further action..

      BBB Case # ******** - Ultimate Outdoor Service

      Ultimate Outdoor Service entered into a contract with ***************************** on April 27, 2021 (see exhibit #1).  The work was performed on May 17, 2021 and paid for.   Topsoil was purchased from *************************  and shade seed was purchased from Country Oaks Landscaping.  When I met with ******************** I explained to her that growing grass on top of tree roots would be a challenge, the large tree roots would be taking most of the water and nutrients.  With this information ******************** wanted to proceed, the grass grew great for months, what happened after that could be lack of water, etc.   All screened topsoil may have small stones that do get through the screening process, that is with any topsoil purchased from any vendor.  The services ******************** paid for were performed to the highest quality, the topsoil was installed and as well as the grass seed and straw mat, no warranty was ever discussed.  If the grass had never grown, I would have been more than happy to come out and install more grass seed and straw mat.  When she called me she stated it had grown nicely and then died, that is not something I can control.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of why I am rejecting this response appear below:

      It is important to understand that my main complaint was not with the initial discussion we had, instructions that were given and followed or the overall installation of the soil, seed or hay. The the overall aesthetic value of the work was fine however a few months revealed an incredible amount of gravel that was part of the topsoil mix that was paid for and installed.  The amount of gravel cannot be described as merely "some" gravel but is instead excessive to the point that it ended up taking space from where grass should be growing.  It appears to be approaching 30% of the mixture and simply is not acceptable. Watering the grass to the precise landscaper's instructions exposed this to such a degree that simply throwing more seed on the area will not produce a desired result. Again my main complaint is NOT that grass hasn't grown but rather a topsoil mixture containing too many stones was used and delivered that poor result.  We did not pay for stones, we paid for top soil. After contracting the landscaper 3 times and hearing him promise to come by for a look, he never showed up or called back.  Poor business.
